So irresponsible media reporting. Why would they jeopardise a trial? Are there no subjudice laws forbidding it?

  • #503
AW did not provide HLN with the document. They actually spoke to a reporter from the local news affiliate WCTI who had obtained the documents. Clearly, the documents have been released to the media. AB stated that copies of the report were sent to K(H)W and AW.

My understanding what father provided them, if I am wrong I apologize. I can't see CPS releasing documents to media within a few days of receiving a report.

The reports were released to the media. Blame the system, not the reporters. MOO

ETA: It May be a case of both AW and media not following the request of withholding information [emoji17]

Here's the thing, none of this will bring Mariah back. Airing every CPS report won't change what happened. What all of this is doing is interfering in an ACTIVE CRIMINAL INVESTIGATION. It doesn't matter if we think KW and EK are evil, very evil, super evil, or the devil incarnate. All that matters is what a prosecutor puts in front of a jury, and what the jury finds beyond a reasonable doubt.

The only thing I care about is the people responsible for this horrific crime being convicted for it and spending the rest of their lives in prison. There's a reason LE doesn't disclose every fact of their investigation to national news organizations, and I'm shocked at people clutching pearls at every criticism of the dad's poor judgment on display again and again today. Publicity and press will not influence the prosecutor and can only hurt the case.

You're using logic to explain why release of this report is bad for the case. You're right. It's not prudent. But walk a mile. It's hard to use logic when your three year old has been brutally abused and murdered.

They had to have been released to the media by a parent. CPS documents are confidential. CPS would never release those documents.

True, but given the fact that they were returned to the abuser (EK for sure) last year after speaking out, would they have any assurance they wouldn't returned and punished for what they reported? One of the boys had just gotten punched in the face by EK the day before Mariah disappeared, they had to have been so scared. Such bravery for them to be Mariah's voice.

Which incident are you talking about? The first one that we knew about was re the bruises on one of the boys and an excuse of falling out of the bunk bed was given and the case was resolved. Things escalated after that I am assuming. I imagine that the Mariah was never taken to the dr for well child chk ups so signs of any abuse would be noticed. Mariah didn't go to preschool, I do not think, so no one would really notice any strange behavior either.

Ruthless profiteers.

Did you watch the segment? I did. They spoke to the WCTI reporter and then they discussed the contents of the report; they did not get it from AW.

In my experience, the media usually respects a request to not publish information about the abuse of a child. I have not seen any local reporters writing about it, just HLN.

If that is the case then someone provided it to WCTI first. The were the ones who in turn gave it to HLN.

So either someone in CPS was so disgusted that they leaked it, or the media were lying when they said the documents were sent to them and they didn't get them via AW?

Because he has a history we can’t discuss. He’s not a good father IMO, but I agree she would likely be alive had he had custody.

I think 99 percent of people knew she wasn’t abducted.

do you have link for his history?

No one would listen to him before and now one of his kids is dead. Maybe, just maybe, he is desperate that someone will listen now and he can save the other two. I don't think it is wise but I understand the motivation.

Oh and all this information was bound to come out anyway, eventually, at trial.

Yes the info would come out eventually but not a smart move if one of the parents circulated a copy of the report. Very much frowned on regarding that especially when dependency hearings are currently going on. Once a child is in the system, a parent can not make choices freely for their kids. I am surprised in a legal way this was not emphasized to the players in this case.

Or someone searching the trailer found it.

We're not allowed to sleuth non-POI family members or discuss things about them that haven't been stated in the media.

I am also wondering what the other incident with the older boy was?

CPS reports are confidential. Reporters would have to file the state equivalent of a FOIA (which would be denied since this involves minor children) for the reports. It is easier to get this evidence during trial because they're introduced into the court record and you have a stronger case that they are public information that can be disclosed. Still, CPS reports are usually sealed even then to protect the minor children on the periphery of a case.

Those children lived in hell....I'm struggling with finding any compassion for their mother. how many times did she look away ?
Or did she just not care ?
Wish she would've kicked his butt out of that house !!!
Also hearing (unsure if true) that Earl was unemployed. So where'd he get $$ for drugs ?? HER job ?
GRRRR !!!
