Here is what I read....

Prosecutors then told the judge they do not intend to seek the death penalty against Antoinette Davis.

West said that after consulting with the state Attorney General's Office, prosecutors determined that a U.S. Supreme Court decision in 1982, Enmund v. Florida, would preclude the death penalty because Davis did not intend for her daughter to die.

That case established that the Constitution's Eighth Amendment prohibits death sentences for defendants in felony murder cases who did not themselves kill, try to kill or intend to kill anyone.

I get the law, but its a damned shame in this case because I dont believe she gave a CRAP whether Shaniya lived or died, except maybe for the future 'earning" potential. Ugh, it just makes me sick.

I've just finished reading all the previous threads (it took me a month and a half, off and on) about what happened to this beautiful, innocent little girl. She was one of those who almost glow with purity and good... I wonder if MAM saw that and wanted to destroy it, to possess it. And AD saw it and was jealous of it.

I try but truly I can't understand what would cause someone, anyone, to harm another living soul like this, let alone a child. So I reach for thoughts about true good and true evil, and how evil wishes to twist and eradicate the good in some cosmic war that we see only through dim and imperfect mortal eyes.

But even so, I still have to ask... WHY?

I hope MAM gets the DP, and gets to sit in a miserable cold and damp cell until his date with the needle.
I hope AD never sees the light of day again, except through the bars of a prison cell.

But most of all I hope Shaniya is living in joy in that perfect place from which we all come; and will, one day, return.

When will our sweet Shaniya get her justice? I have been looking for updates on this case every week since October and have found NOTHING.

Fly with the angels baby girl... We will never forget you.

This case is the one that hooked me into following and eventually joining WS.

Davis and Mcneill both have hearings tomorrow. Let's all hope that Shaniya gets gets justice soon. Over 2 long years have already passed..

and ask for updated reporting on Shaniya's case. Maybe if they get emails from around the country (and world) wral will investigate and actually TALK about!

The NC online court system is not user friendly at all. :(

We need borndem to navigate that system for us, I can never find what I'm looking for in NC but borndem has found the complete docs.

Nothing new on the Cumberland County lists -- their names are not on there at all. Some of the cases listed went out to 02/27/12, but that would not include all cases, IINM,

Maybe next week.... or the week after. It could be re-scheduled for some time after February. We'll have to keep checking...

Zahra Baker, Shaniya Davis Among Backlog Of Child Death Reviews By State


Charlotte, NC -- Faced with a backlog of child death cases, North Carolina officials are changing the way they review such tragedies in an effort to learn lessons more quickly.

Kevin Kelly, section chief for child welfare in the state Department of Social Services, says particularly urgent or high-profile cases will now be reviewed first.

Previously, the state had reviewed the deaths of children involved in the social services system in chronological order.
