New Details: Isaak accused of visiting scene of murder a week prior

MANDAN, N.D. (KFYR) - Court documents filed Monday say the man accused of murdering four people visited the scene of the killing a week prior.

A motion filed by the Morton County States Attorney’s office say they intend on using evidence of Chad Isaak’s movements from March 25, 2019.

Documents say Isaak is seen on surveillance camera on March 25 traveling to and from the RJR Maintenance and Management building.

“On March 25, 2019, the defendant travelled to the scene of the crime at approximately the same time and using the same route that he used on April 1, 2019, essentially practicing the route he would take on the day of the murders,” read court documents.

The court must get approval from the judge to use the evidence prior to the committed crime to show intent.

“The purpose of the evidence is to show the defendants plan and preparing for the crime of murder,” read documents.

I hope justice will be swift for the family and friends that have waited so long for this trial.

Then there's the defendant that caused his attorney (Quick) to withdraw -- two years into the case when he filed a bar complaint against him!

The backup law firm to Attorney Quick also attempted to withdraw and it's really unfortunate for them that Judge Reich harshly said "no."

Nobody wants to be near this awful man! I don't want this guy with one valid reason for an appeal. MOO

Vogel Law Firm requests to withdraw as counsel on May 10, 2021

In court documents filed Monday, they say they have no contractual relationship with Isaak, and defending him would result in an “unreasonable financial burden.”

The three lawyers from Vogel Law Firm have considered themselves secondary counsel in the case and say they were just hired to help. They say they have not been involved in significant trial preparation and if they were to defend Isaak they would need extra time to prepare.

Judge Reich said “the Court is unpersuaded and unsympathetic” to Vogel’s arguments. Reich stated that all four attorneys have appeared on behalf of Isaak at some point over the last two years.

Reich said “the Vogel attorneys appear to have created that burden for themselves” when discussing whether or not the lawyers will be paid, and that is an insufficient argument for withdrawal.

Quick said his hands are tied because Isaak filed the disciplinary complaint with the North Dakota Disciplinary Board. The motion to withdraw also would force Judge David Reich to dismiss Vogel Law Firm as Isaak's defense team.

Isaak told Reich he was not aware that Vogel lawyers Luke Heck and Drew Hushka would be taken off the case because he filed the complaint. He added he filed a “nonsense complaint” against Quick to get him off the case, but he would withdraw it if it meant keeping Heck and Hushka.

“Neither attorney Heck nor attorney Hushka have ever given me any reason to file a complaint against their licenses,” Isaak said.

Isaak also said he has not fired Quick.

Reasons behind Isaak filing the complaint were not disclosed in court. The Disciplinary Board could not confirm whether it received Isaak’s complaint, which would be exempt from open record laws.

Quick said even if Isaak withdraws his complaint, the wheels are in motion to investigate it. That means Quick has a conflict of interest that prevents him from continuing as Isaak's attorney.

I think this says it all about Isaak's character. He's a vengeful character that was willing to file a "nonsense" complaint just to get his way. Offered to rescind the complaint (bar complaints taken very seriously) when he learned it might not work.

I saw Court TV's motion for EMC last week.

I'm so anxious to hear any hint of a motive for this horrific event. I'm afraid this is going to be a case of perceived insults existing only in the mind of the accused.

Only recently did I learn that the prosecution recovered surveillance evidence that the accused traveled to the crime scene one week prior -- the same early morning hour. It's believed that CI was making a trial run at his premeditated crime. I think this is all we have. :eek:

Absolutely, I think will find that he is a grievance collector of the highest order, with the majority of those grievances existing only in his mind. If we're looking for a logical understandable motive, I don't think we're going to get one. This has all the earmarks of a completely senseless murder.

Chiropractor on trial in North Dakota quadruple homicide - Court TV

Investigators say Chad Isaak stabbed four people to death at RJR Maintenance and Management on April 1, 2019. Although a motive has not been reported, a probable cause affidavit states the business managed a mobile home park where Isaak lived. 52-year-old Robert Fakler, 42-year-old Adam Fuehrer and married couple William Cobb, 50, and Lois Cobb, 45, were killed in the attack.

Isaak is facing multiple charges, including four counts of murder. His trial will begin Monday, August 2. Court TV will carry the proceedings live.

'Coffee club' loved early fellowship; then attacker hit

April 19, 2021

MANDAN, N.D. (AP) — Camaraderie was so important for the “coffee club” at RJR Maintenance and Management that the four unofficial members often arrived at work early just to enjoy one another’s company, mugs in hand, before other employees arrived and the workday began.

But that friendly calm was shattered around 7:30 a.m. on April 1, when a person armed with a gun and a knife entered the company’s office building in Mandan, North Dakota, through the one unlocked door. Within 13 minutes, those four friends became the victims of a horrific deadly attack.

Jackie Fakler’s memories of arriving at the building that morning are bleak. She had planned to drive to work with her husband, Robert — they co-owned the business — but a last-minute decision sent him on ahead.

Fakler said at first she thought her husband had suffered cardiac arrest.

“But when I saw blood on the floor, I knew it wasn’t a heart attack,” she said.

According to a police affidavit, the intruder attacked the four friends one by one. Robert Fakler was stabbed and cut multiple times. Adam Fuehrer, Bill Cobb and his wife, Lois, were all stabbed and shot. The attacker sliced Lois Cobb’s neck.

Office manager Deanna Finnie tagged the four the coffee club, claiming they could get through an entire pot before anyone else even arrived at work. Fakler said that collective defined the close-knit community at RJR.

“You don’t get that with most companies,” Fakler said. “They came in just to spend time with each other before the work day.”

The Cobbs and Faklers were friends who sometimes vacationed together. Fuehrer would help out at the Faklers’ hobby farm, and in return would get a butchered pig every year. Company holiday parties typically have 100% turnout, and “this is like home to a lot of people,” marketing executive Ben Pace said.

*Trial set to begin (@ 9am CT) – ND – Lois Ann Cobbs (45), employee; William Dee “Bill” Cobbs, Jr. (50), employee; Adam Fuehrer (42), employee; Robert John Fakler (52) co-owner (April 1, 2019, at RJR Maint. & Mgmt business, Mandan) - *Chad Trolon Isaak (44/now 47) arrested (4/4/19), charged (4/5/19) & arraigned (5/9/19) with 4 counts of murder (Felony AA), 1 count of burglary (Felony B), 1 count of concealment within a vehicle (Felony C) & 1 count of unauthorized use of vehicle (misdemeanor A). Plead not guilty. $1M Cash only bond.
Trial set to begin on 8/2/21 with jury selection (to take 2 days) & trial begins on 8/4/21. (8/2/21 to 8/6 & 8/9 to 8/13 & 8/16 to 8/20/21). Will be 12 jurors & 2 alternates.

5/11/21: Order on expedited motion to withdraw as counsel. Notice of scheduling change-amended trial date & remote hearing amended pretrial conference on 5/28/21 rescheduled to 7/16/21 via Zoom @ 8:30am. Trial is set to begin on 8/2/21 (8/2-8/6, 8/9-8/13, 8/16-20).
7/16/21 Update: Isaak told Judge he could represent himself, but the Judge disagreed. Luke Heck, Bruce Quick, Drew Hushka & Mark Friese are Isaak’s new retained attorneys. A previous defense motion to move the trial out of Morton County for publicity reasons was denied in the case. The trial will be in Morton County. Jury selection is expected to take two days for the 12 person jury with 2 alternates. The trial is scheduled to last three weeks, and no final witness list has been released. The expectations are for up to 150 witnesses to be called. Isaak will be allowed to wear civilian clothes during the trial with no visible restraints. The trial starts August 2nd with jury selection & opening statements on 8/4/21.
