NE - Omaha Double Murder #3 - *Arrest Made*

I am here. And I will be here until justice is served for young Tom, Shirley, & the Brubacks and their families.

OK, by popular demand- I will try to post updates as they occur. I do not expect the trial to last more than a week and I expect Garcia will be convicted. I also expect appeals from his attorneys to go on into the future forever. There won't be any streaming of the proceedings. Look for some disturbing details to come out. At least the families will finally get this behind them.

Thank you Snick for updating us! And thanks for keeping this thread current - I haven't been following it for a while but I know that you've been here since the beginning and always appreciate your thoughtful input.

Local attorneys are bailing on the defense team. Alison Motta is alleged to have been loudly discussing confidential details of the case while flying back to Chicago. She has divulged information on DNA testing to the media. This all seems an attempt to poison the jury pool to heighten the possibility of a hung jury, IMO.

Mrs Motta seems to me to be the loose cannon in this case, I think it could proceed with just her husband as attorney. I seriously think this may not be going to trial next week I was wondering where AG got these people. I think perhaps they contacted him. This has been marvelous free publicity for their firm. Sadly it may further delay justice in this case.

Link to an earlier story on Charles Simmer, the accused killer who is being linked by AG's defense team to the Dundee case:

I'm not seeing it. The Simmer case appears to have been a matter of a family dispute turned violent. I just cannot see how he could have been in Dundee doing those murders, let alone why. Unless they could establish that he had been committing violent invasion robberies; and no money was taken by the perp that killed Shirlee and Tom.

I am open to persuasion but unless they can come up with better, this is rubbish IMO.

Garcia's brother was interviewed by local news media and as you could guess, is sure his brother is getting railroaded.

I do not fault him for sticking by his brother but the tone he is taking sounds as if he is channeling the Mottas.

The prosecution has video of Dr Garcia in Omaha the day the Brumbacks were killed, also credit card receipts. Fernando had no real explanation for that, he just knows this is all some conspiracy.

Nebraska can well be reinstating the death penalty this November. This bunch best stop all the games, get to trial and at least get a verdict they can appeal. I wonder if that has occurred to any of them?

This is going to be a circus- but I feel like the prosecutor has all the ammunition he needs to but this savage away forever.

Garcia is now telling the judge he doesn't want Allison Motta on his defense team any longer.

I have a pretty low opinion of AG but have never felt him to be stupid. Even he can see this wild woman is not helping his case. With the death penalty reinstatement looming, he is better off getting through the trial and if found guilty he will at least be appealing a life sentence rather than the DP.

Garcia is dragging this ordeal out in order to get the attention he so desperately craves. I loved the comment following this article totally dissing him. Someone from Creighton. Ha!
