Nejame Files Motion to Strike for TES/Baez 7/16/09 Motion

The day Caylee's remains were found (IIRC) Tim signed himself out of a hospital down south, to hotfoot it back to Orlando. I thought he stated they were searching the area very close to where Caylee's remains were eventually found. He called off the search after they lost a brand new 4 Wheeler, that had been loaned to them by a local. He said he hated calling off the search and he knew a lot of people were upset by his decision, but that finding Caylee's remains in the condition they were in supported his original call. If a horse had been able to wade through the water there, chances are very good the remains would have been pushed down into the soft mud. It was possible they could have been lost forever or, at the very least further damaged and evidence would have been destroyed.

The fact that a vehicle the size of a 4 Wheeler could be lost, completely submerged just a few yards from where Caylee's remains were found weeks later further supports the grounds that Caylee could in fact be there, but be completely hidden to searchers.




The loss of the 4 Wheeler added another 10G to the cost of searching for this sweet angel who's mother knew where she was all along.

I'm so glad that Tim didn't let the fact that KC knew where sweet Caylee was stop him from conducting searches. He later said in all his years searching, this one was literally one in a thousand and he hopes he has a thousand more before going through anything like this again!

Tim is truly an angel on earth to anyone who has lost a loved one.

I don't know why, but I thought the ATV- 4 Wheeler was damaged when they were searching near the airport and TM has said they would come back when the water went down. The area near Suburban had 6inches of water, which is not much. Soooo, confused. Thank you for clarifying that.

I just got through the appendices Baez and Lyon submitted with the motion. Apparantly, according to Appendix B, Joy Way's interview with LE gives support to the motion. They used pp. 2, 3 and 33 of her interview.

It's too bad they didn't include pp. 29-30, where she describes the scene as being under water!

I hear you, I have been doing the same all week!!

I will never forget the look on TM's face that day, standing out there in miserable weather. Not that he wanted our angel to be found dead, but if she was deceased he wanted her found and returned to her GParent's. I think he thought it would give them some measure of comfort.

He was so glad he followed his instinct, to stop the search so she wouldn't be lost forever if she was lying there under all that water, waiting to be found.

You know it's very possible another ATV was damaged out by the airport...(just not the brand new one loaned by a resident that it cost 10G to replace!! ; )

This brings back a memory of CA stating that Hoover didn't work for them---was that in the Morgan depo? Where ever it was she seemed to be making a loud point of stating it.

I wondered when I was listening to or reading this statement if it would have been more accurate to say he doesn't work for us any longer... or we never fulfilled our contract (payment for services rendered) with him after he failed to complete his assignment. (finding Caylee, tampering with a crime scene and removing evidence). Cindy knew all along Caylee's blanket was missing and possibly the laundry bag. I'd be willing to bet she knew what tee-shirt and shorts were missing too. She has said she knew all of Caylee's shoes were accounted for IIRC. All things that would tie Caylee to their house and possibly to KC.

Seriously how much water did he and his "partner" (DC) try to muddy by yapping on about the possible inappropriate relationship between DC and Cindy. The very night Caylee was found. Instead of revealing what the topic of conversation was that night.

DC stating he never saw the camera that at times could have been no more than 6 inches from his face as he prodded the dirt, looking for what? He never revealed. He was too busy carrying on about not seeing any camera.

Not to mention the whole debacle of JH offering to sell the tapes that no one in the A camp wanted to admit to having, ordering, filming or seeing.... :liar: :liar: :liar: :liar:

IMO, I just don’t see what earthly difference it makes whether TES, JW, DC, JH, or anyone else previously searched the area along Suburban!

This "area” ranges the length of Suburban drive from the intersection of Hope Spring all the way down to the area behind the school. For purposes of this post, I'll estimate the distance along Suburban drive from the school to Hope Spring as only 1/4 mile, or 1300 feet. (I think its more like 1/2 mile or better. Anyone know for certain?) Next, let’s continue to be really, really conservative and assume that no one looking for Caylee, including TES, ever ventured further than 40 feet off the road into that that overgrown, snake-infested jungle. Now, let’s convert that search area to square feet: 1/4 mile long by 40 feet wide, the search area becomes 52,000 square feet. .

Caylee's remains were in a plastic bag which if spread out flat when it was brand new would only be about 12 square feet. These relatively few searchers were scattered over 52,000 square feet of dense jungle undergrowth (some of which was flooded) where you can't normally see further than your own shoes until you shove some sort of vegetation aside!

Am I the only one who has ever searched two or three times through a messy drawer for an important item, couldn’t find it there, yet it was there all along and finally found on the next try?

I was at Suburban Drive in October with Tim Miller, and for a moment that day, I was less than 40 feet away in a straight line from the real "spot" where the remains were found. Actually, I was in a slow moving car, but I assure you that my "view" of the actual spot where Caylee's remains were found was about as good as DC's, JW's, etc. or anyone else's who stood inside that "jungle" a mere 10 or 15 feet away from that laundry bag.

And as to the defense proving anything from JW's photographs or JH's video, all the prosecution has to do to negate that evidence is suggest to the jury something to this effect: Go into a thick, dense, unfamiliar jungle of indistinguishable trees and tropical vegetation and take some photographs (add a couple of rocks, too if you want). Next, wait a few months for the seasons and growth to change, and maybe a flood too, then get out your snapshots, wade back into that jungle and correctly identify each of your snapshots.

I worry about how the prosecution will deal with a lot of things, but I have complete faith the prosecution will successfully lampoon any attempt of the defense's to prove the remains weren't there all along just because they weren't found earlier by TES, DC, JH, etc.

So NeJame and Miller will hand over documents to the defense on Friday morning then hold a press conference Friday afternoon..should be very interesting

While I am happy to hear what NeJame has to say at his press conference .... at the same time I have to wonder WHY he is holding a press conference on this matter? What is the underlying motivation for speaking out publicly regarding this case and particularly his client, Tim Miller of TES? NeJame does not need publicity. Miller does not need vindication on anything in the public eye. What is the purpose of the public announcement? Why doesn't Nejame just say his piece in Court on Friday?
Maybe Nejame just wants to let the public (future TES volunteers) know that he has their back and won't let any attorney invade their privacy if they volunteer to help search for missing persons?

MN seems to have a dapper persona behind his silver tounge. What ever he says makes one want to listen even when we found him disgusting at defending the A's. Can't he say anything he wants since he is defending TM. I'v never forgotten JB's statement that as a defense attorney he is allowed the privaliged of saying anything in a publice forum he wants in order to defend KC. This should be a good fencing moment in the case. It would be kool if we were privy to MN thoughts on AL & LKB! I don't see MN as a man who would be intimadated by these two Renouned women, even if they are bigger than him. The dynamics between all these attorneys is going to keep us on our toes! Show time yet?

Remains Site WAS UNDER WATER

Orlando, FL-Mark Nejame, counsel for Texas Equusearch, released this statement this afternoon:


Mark NeJame, counsel for Texas Equusearch (TES), is holding a press conference today at 2:00pm EST in our office, 189 S. Orange Avenue, Suite 1800, Orlando, FL 32801.

To further explain the attached letter sent to the Office of the State Attorney and to Counsel for Casey Anthony.

This establishes that the area where Caylee’s remains were found was indeed submerged in water a month prior to the discovery of her remains.

The actual photographs will be displayed and explained at the press conference.


Mr. NeJame represents Tim Miller and TES, who have provided the aerial photographs to him which were recently located.

This seems to clearly contradict any claims that the area was dry previous to Caylee’s discovery and the likelihood that Caylee was later brought to that location.
In Addition, Mr. NeJame has attached Mr. Miller’s and TES’s response to the defendant’s, Casey Anthony, request for discovery of the searcher’s and Mr. Miller being designated as a material witness in this case.

ORLANDO -- New information will be revealed today in the Casey Anthony case, but it's not coming from prosecutors or the defense.

The founder and director of EquuSearch, Tim Miller, and his lawyer, Mark NeJame say they will release documents, computer disks of information, and photos about EquuSearch's search for Caylee Anthony last year. They will also release a letter to Casey Anthony's lawyers and a copy of a legal motion.

NeJame says aerial photos show that the area where Caylee's remains were found was submerged in water a month prior to the discovery of her remains.

The photos were made Nov. 7 from an Orange County Sheriff's Office helicopter.

NeJame says if you look at the foliage, someone could be within inches of an item and not see it.

Jose Baez, Casey Anthony's attorney, filed a number of motions. One motion tried to get EquuSearch to turn over maps, communications records and information on searchers and their involvement with investigators.

That motion was denied in January.

Now the defense has filed a motion to make Tim Miller a material witness. Judge Stan Strickland is expected to hear it tomorrow in court.

Miller and NeJame were together in Orlando Monday when they announced they will help in Search for Haleigh Cummings.

They will be in court together for the Casey Anthony Case Friday.

NeJame says he doesn't object to Miller as a material witness. But continues to say that EquuSearch was acting as a private company- and not hired by the sheriff's office.

And... tomorrow's hearing the case against Casey is set to get underway at 9-30 a-m.

The hearing will address motions filed by Casey's defense team.

The defense wants to delay Casey's criminal check fraud trial.

They also want a gag order preventing bounty hunter Leonard Padilla and his associates from talking about their conversations with Casey Anthony.

News 13 will broadcast Friday's hearing live.
