New Lawyer appears - Debra Ferwerda

  • #21
So he is on the state list...I guess that's why his new lawyer had to make herself known. I could swear though, I don't know if was speculation on our part, or because Diana Tennis stepped down, that he either wasn't important to the murder case or wasn't going to testify at trial. I think it was because of Tennis saying he no longer needed an attorney, so we speculated that he might be on the state's list as a just in case they need him type of witness, but not actually one integral to the murder case, at least.

Dangit, this is making me really want to see his investigative interview!!!! Darn the defense for not wanting to depose him! And it's making me wonder what caused him to need an attorney again - could it be the tampering investigation? And because he's a listed as a witness in the murder trial, she had to put in that notice?

Bold Mine

I'm wondering if Diana Tennis stepped down because she didn't want to deal with his smarmy self, and just stated that he no longer needed an attorney, to cover herself. She wasn't in a court of law when she made that statement, but was publicly stating that. In the public, attorneys can say what they want, whether true or not as long as it isn't slander or libel, etc.

So will we see DC's depo this time? This is the depo I've been looking forward to.

LOL - I think there will be a stampede of people down to the clerk's office to get a copy - with our MM way out in front!

Maybe we will finally learn if Cindy did indeed "send him out" to Suburban or if he went on his own and told her about it afterwards.

Goodie-Goodie-Gum-Drop!!!! I'm so flippin' excited!! :great:

So DC will be deposed by the State on Monday.

Something tells me that this little bit of news ruined the Anthony's and the defenses (especially Jose's) weekend. We know that Cindy and Dominic are no longer friends... I believe that Cindy used the word "betrayed" in her letter to Casey... which I have learned that anytime someone tells the truth... it means they have betrayed the Anthony's. So I really hope DC will be able to answer a lot of questions I have and tell us what really happened. I think it would be nice to get a real inside look on what was really going on behind the scenes and to know exactly how much the Anthony's were involved in the things that went down (searching the woods).

I think it will also be interesting to see if he really does have some kind of immunity deal in place. I know we have all speculated on this.

Man, I hope they release this deposition fast!! Any chance they will seal it?

I wonder if JB will be present for this depo, and if so, how many times will he tell DC to "zip it"?

It is curious to me that NONE of the local media published this tidbit of juicy news about Dominic being deposed on Monday??!!! Why not?
The Notice was filed last Wednesday!! the 23rd!
If MuzikMan had not gone and obtained a copy of the Notice of Deposition -- we would not know about it.
Where are the Defense media darlings [the media chums who get the docs before they are even filed with the Clerk] when it comes to announcing this news?
WESH??
Cfnews13???
InSession??
not even WFTV????

Sometimes I wonder if the State politely asks that the media doesn't blow these things up. Possibly reminding them that this is about Caylee and to allow them to do their jobs. Some things really are meant for trial and I think DC's deposition being done less than 6 weeks before the trial is one of these things that needed to be held close to the vest until the right time.

Think about it... if DC reveals some incriminating evidence about the Anthony's knowing where Caylee's remains were... everyone is going to be screaming that they be arrested and they don't need that to happen so close to trial.

They need to focus on Casey's trial right now. They don't need to have a bunch of angry people demanding that more arrests need to be made.

That's the best I can come up with? Other than that, I have no idea?

Recently, the State has been taking depositions of people who are NOT officially listed on the Defense witness list ... but people who the Defense has made known to the State, as "possible" Defense witnesses in the future.

Such as with Lisa and Kevin Gallaway, TES searchers.
The Defense initially gave their names to the State as "possible" Defense witnesses who had evidence that would help the Defense, from searching Suburban Drive in 2008.
As potential Defense witnesses, the State took their deposition.
Turns out, the Gallaway's testimony is more helpful to the STATE ... so, the State added them to the STATE Witness List.

The Defense must have turned over the names of Tracey Wolfam/Wollam and Dominic Casey to the State as "possible" Defense witnesses, because the State is now taking their depositions on Monday.

I believe that the State must have done an investigative interview with Dominic, probably back in December 2009, which the Defense was not legally allowed to attend, and no record of that interview is made public. Now that the Defense is planning to add Dominic to the Defense Witness List, the State will do a "regular" deposition of Dominic to see what he plans to say that would supposedly help the Defense.

We will not know if the Defense officially adds Dominic (or the other approximately 20 people the State has deposed, but the Defense has not added to their Witness List) to the DEFENSE witness list until an official Supplemental DEFENSE Witness List is filed with the Clerk.

The State has filed a PUBLIC Notice of Taking Deposition of Dominic ... so they are not attempting to keep anything secret from the public.
I really do not know why the media is not reporting on it? Maybe the media was just swamped with covering the Frye Hearings last week, when this Notice of Depo was filed?

I think you are on to something here. So the defense may want to add DC to their witness list now that it looks like they are going after Cindy and George. I see no other reason for the defense to want anything to do with DC. So the State says "What the hey" we'll just do an official deposition so that all this is out in the open and there will be no surprises.

I think the State sees right through the defense and what they are trying to do and they are about ten steps ahead of the defense. If there was no deposition, the State would not know what kind of questions the defense was going to ask of DC... so now they will get to see what exactly the defense is up to.

Did anyone hear on TruTV another lawyer, a Jennifer Barringer (?) state she was coming on board as well for the ICA defense team?

Isn't it a little late to be doing this? I mean ALyon is the one responsible for this trial being delayed for a year because she had to get up to speed. jmo

So DC is being deposed...well that would definitely be why he needs a lawyer. I just wonder if this depo is going to be released. You know, Mallory was deposed and we've never seen that deposition, so I do wonder if we'll get to see this one. We might, though, this close to trial. I mean, isn't it put up or shut up time?

I really, really, REALLY hope we get to see it. This is the one deposition I have been waiting for since what DC did came out!!!!

I did hear the host of the show Ryan ?? announce there was a new member of the defense team and then turned it over to Jean Cesares (sp?) who said at this point she is a consulting member of the team. She was standing right there with Jennifer Berringer and did interview her. I found the interview confusing.

I haven't read this anywhere else, so I'm not sure I believe it.

This is an article about her.

Well, if that's her than, in the voice of Dana Carvey's beloved Church Lady..."Isn't she speshull". Goodness, where do they find these people?

BBM - Quote respectfully LolaMoon

This adds to the pattern that if the SA is simply doing their job and it hurts the defense - we need MM to snoop it out; further,
if its spin that the defense wants out there, they leak it or call a press conference............
