Investigators traveled to Florida to speak to Harmony Montgomery’s relatives.

The trip south comes after investigators searched the wetlands in Revere, Massachusetts, last Friday.

While authorities didn’t disclose if they found anything in the marshy area, NewsNation law and justice contributor Jennifer Coffindaffer said it would’ve been difficult to find anything there now.

“This would be extremely difficult to find anything here after this long period of time. And because of the marshland — just the environment being wet and salty, and all the issues that they would face in a body surviving that condition,” she explained.

After the disappearance and presumed murder of 5-year-old Harmony Montgomery in 2019, Massachusetts’ Office of the Child Advocate (OCA) urged the state to make changes to its custody system, which failed to protect the young girl from her father, now charged with her murder. But according to a new OCA report out this month, the state continues to fail its most vulnerable children. Retired Judge Carol Erskine, who criticizes the “defective system” in her forthcoming book, “A Cruel Injustice” joined Sue O’Connell, along with Blair and Johnathon Miller, the adopted fathers of Montgomery’s half-brother.

"It is very difficult to answer his questions. He looks at us and says, 'Why did my sister have to die? Why did someone have to hurt my sister?'" Bobbitt-Miller said. "That was the only stable person in his life until he was adopted."

Blair Miller said state agencies and lawmakers should implement improvements to make sure such a case doesn't happen again, but they haven't.

"Why hasn't enough changed to make sure this doesn't happen again?" Miller asked.

Harmony is presumed dead and her father, Adam Montgomery, has been charged with her murder. Harmony had stayed in the care of her father despite signs of abuse. A new report from the Office of the Child Advocate says the state is not adequately protecting kids in custody cases.

Retired Judge Carol Erskine, who aided in Jamison's adoption and is writing a book about Harmony's case, said one change could come from a Massachusetts law that lets children decide where they want to stay.

But two issues arise out of that. Adam Montgomery’s lawyer wants any conversations between the two deemed inadmissible, citing a marital privilege that prevents the introduction of such statements.

Meanwhile, prosecutors want to introduce evidence of physical abuse of Kayla Montgomery to explain why she initially denied seeing the guns when she spoke to police.

Abuse took place “like pretty much every day,” Kayla Montgomery told police, according to court records. Adam Montgomery assaulted his wife, threatened her and restricted her movements, all while accusing her of telling on him.

“A lot of times. I like can’t even count,” she told police about the frequency of being hit or punched. Prosecutors say the threats and abuse explain the initial lies.

Harmony's stepmother and Adam Montgomery's estranged wife, Kayla Montgomery, is a star witness in the weapons trial. She lied to the grand jury and, as part of a plea deal on perjury charges, is serving time in state prison. Kayla will take the stand next week.
