Adam Montgomery, who is charged in the murder of his
5-year-old daughter Harmony, had his trial delayed until next year at a court hearing Thursday in New Hampshire.
Now, the next pre-trial hearing in the case is set for 9 a.m. on Jan. 16, 2024, with the trial to begin on Feb. 6, 2024 upon jury selection.
The trial was initially supposed to start on Nov. 21. However,

Montgomery's public defender Caroline L. Smith had filed a motion last week saying the defense team needs a new co-counsel who will need time to prepare. In a court filing
obtained earlier this month by News 9 Investigates, Smith said her co-counsel accepted a non-lawyer job within the state’s public defender system. The job switch prevents her from being able to continue as co-counsel, Smith wrote.
After a lengthy conference with the judge and defense team in chambers, state prosecutors said they understood the reasons for the request and did not object to the motion to delay.
The judge asked Smith to file a waiver of speedy trial signed by Adam Montgomery within 10 days.
