@TheCarolErskine

I look forward to being on Opening Statements with @JulieCourtTV to talk about the SJC decision to allow a limited release of the audio from the one day trial that put Harmony in the hands of her killer. I plan to renew my call for a federal probe into violations of Harmony's constitutional rights. So grateful for Julie's advocacy for Harmony and other child victims.

A Massachusetts agency aimed at keeping children safe from abuse and neglect has asked for a “minor amendment” in the decision by that state’s highest court to allow a documentary filmmaker access to audio recordings of a hearing after which Harmony Montgomery ended up in the custody of her father.

The requested amendment is to require the redaction of all names, including those of lawyers, social workers and court personnel, “due to safety concerns,” according to court documents obtained by the Union Leader. Several documents have been impounded.

It looks like Crystal Sorey will receive 50% of the settlement amount, and that the other 50% will be split evenly among four individuals identified only with initials in this document. I think that JWM is Jamison Miller, Harmony's brother. JMO

According to the linked article:

News 9 has learned that under the terms of the agreement, 50% of the settlement goes directly to Sorey, while the other 50% will be placed in third-party trusts for Harmony's four siblings.

From the linked Settlement Agreement:

after payment of attorneys’ fees and costs shall be distributed whereby 50% is distributed to Crystal Sorey, Individually, and 50% is divided in equal shares and distributed to an estate guardian for the benefit of J.W.M. ( ), J.S. ( ), S.M. (),and D.M. ( ), with the purpose t o create and establish an irrevocable trust for the benefit of each of them

JWM would be Jamison Miller. J.S. must be Crystal Sorey's younger child, and S.M and D.M must be the two children of Adam and Kayla Montgomery.

I hope there is no way that Kayla can ever get her hands on her children's shares. I'm sure it has been set up to protect them.

Retired judge Carol A. Erskine is requesting that the FBI open a criminal civil rights investigation into the New Hampshire Division of Children, Youth and Families, claiming that the agency deprived Harmony "of her constitutional rights, contributing to the abuse, neglect, and homicide she suffered in 2019."

Erskine authored a book, "A Cruel Injustice," which examined what she determined were failures in Harmony's Massachusetts case.

I thought they did that already, definitely should have. But I guess now is better than never

yes, that is law of intestacy. When a decedent dies without a will their estate is determined by probate law which states half to a persons spouse half to their children in equal shares. if unmarried and childless then half to their parents and half to their siblings in equal shares.

Later this morning, Wednesday, October 15th, there is a New Hampshire Supreme Court appeal hearing for Harmony Montgomery's horrid father, Adam. Scroll to the top of this thread, and you can watch the hearing as soon as it starts without having to leave Websleuths. I can't find the time it starts, but I would guess 9 AM Eastern. If anyone knows, please post it.
Thank you

That was fast.

Not what I expected, though I don't know what I expected.

Regardless, I don't see how he's ever getting a new trial.

A new trial would be a complete waste of time, resources and money. He had his chance. He was found guilty, they could try him 25 times he will still be guilty. The state that handed Harmony to him without making sure she would be safe FIRST, then didn’t follow up to insure she was safe and properly cared for is complicit in her abuse. Kayla, who sat there and did nothing over and over while Adam tortured her, is complicit in her abuse. Anyone who saw him mistreating her & did nothing is complicit in her abuse. The case worker/s who took the reports of abuse (from those who tried to help) and didn’t follow through are complicit in her abuse, but IMO Adam Montgomery alone murdered that adorable little girl and he is right where he belongs. He should never be released. After death, when he’s cremated and his ashes are discarded like garbage without fanfare, his name should never be spoken again, make it like he never existed. Like he tried to do to Harmony.
