The defendant originally faced eight gun-related offenses in an April 2022 indictment that stem from the theft of two guns – a rifle and a shotgun – from a home in Manchester, New Hampshire.

Two of those counts were later dropped – one charge each for being a felon in possession of a rifle and in possession of a shotgun.

The six remaining counts include two counts of theft by unauthorized taking and two counts of receiving stolen property for retaining the guns. He is also charged with one count each of being an armed career criminal, for possessing the rifle, and for possessing the shotgun. (An armed career criminal is defined as having been convicted of three or more qualifying felonies.)

Superior Court to unseal murder affidavit in Harmony Montgomery investigation Tuesday

News 9 Investigates is expecting significant new information to be released Tuesday about the homicide of Harmony Montgomery.

A judge granted a motion that was filed by WMUR to unseal the affidavit.

The affidavit is expected to contain details about how Harmony died and what her father, Adam Montgomery, allegedly did with her remains.

On Tuesday, a document is set to be released that could include "graphic details" about the murder investigation, according to the Union Leader. The sealed document was filed by prosecutors in October when they initially charged Adam Montgomery with killing his daughter.

WMUR-TV filed a motion seeking to unseal the document in May, and a judge ultimately ruled that it could be unsealed 10 days after Adam Montgomery stood trial for unrelated weapons charges. That trial ended on June 8 when Montgomery was found guilty on six firearms-related counts.

The 48-page document draws heavily on interviews with Adam Montgomery's estranged wife, Kayla Montgomery. The affidavit says Kayla Montgomery admitted lying in her grand jury testimony, in which she said she last saw Harmony two days before Thanksgiving 2019.

In a later interview with police, Kayla Montgomery said she and Adam Montgomery, along with Harmony and two other children, were living in their car after they were from their home on Gilford Street in Manchester. She said that on Dec. 7, 2019, their car broke down, and it was on that day that Adam Montgomery allegedly struck Harmony and killed her.

After leaving Kayla's mother house, around Dec. 30, 2019, Adam, Kayla and their two boys went to stay at a Families in Transition shelter in Manchester. Kayla said the Under Armour bag with Harmony's body was brought to the shelter as well, and that Adam placed it in the ceiling vent in the bedroom.

"Kayla stated that during this time, there was liquid coming from the bag containing Harmony's dead body, and there was an odor," court documents say. "She said Adam placed a trash bag around the bag to keep it from leaking."

Kayla said the body was then moved to an apartment on Union Street in Manchester when the family moved again. She said that Adam put the Under Armour duffle bag with Harmony's body into a plastic bin storage container, which he pushed from the Families in Transition shelter to their new apartment.

"Kayla said that Adam then at one point took the Under Armour bag out of the plastic bin storage container, and that the Under Armour bag was leaking." He then put another trash bag around the Under Armour bag and put it in the refrigerator of their new apartment.

At some point, Kayla said Adam transferred Harmony's body from the Under Armour duffle bag into a new bag while in the bathroom. She said Adam spent four to six hours inside the bathroom with the shower running and then put Harmony's body into a Catholic Medical Center maternity bag. She said the bag was much smaller than the duffle bag and it wouldn't have fit Harmony's body "unless it was dismembered or grossly distorted." When he was done, Adam placed the bag in the apartment's freezer.

On that same day, she said she brought the maternity bag containing Harmony's body to Adam's workplace, the Portland Pie Company restaurant on Elm Street in Manchester, at his request. She said Adam kept the bag in the walk-in cooler at the restaurant for about a week before bringing it back to their apartment. An employee at the Portland Pie Company told investigators he recalled seeing the bag in the cooler on a couple of occasions but never asked Adam about it.

Kayla said at one point, Adam took Harmony out of the maternity bag in the Union Street apartment so he could add lime to it to help with the decomposition of the body.

She said Adam kept the bag with Harmony's body inside of the freezer at the Union Street apartment until sometime during the spring of 2020, either March or May. She said Adam rented a U-Haul and during the overnight hours made a trip to "an unknown destination" to dispose of Harmony's body. She said Adam returned in the early morning hours but never told her where he went.

The court documents note Adam reportedly put her body in a duffle bag he retrieved from the truck of the car.

A friend of the family then let them stay in his car for two days. Kayla reportedly told police that Adam allegedly kept Harmony's body in the bag in the trunk or put the bag out in the snow to slow decomposition.

According to court documents, Kayla told police Harmony’s body was moved to various locations over the course of the next several months, including a cooler, the ceiling of a shelter, a walk-in cooler at a restaurant Adam worked at, and refrigerators.

Kayla told police that in the spring of 2020 Adam rented a U-Haul and made a trip to an unknown destination to dispose of Harmony’s body.

According to court documents, Kayla stated she did not know the location of where Adam allegedly dumped the body.

Harmony Montgomery's dad hid her body for months before disposing of it, police say

For the next three months, investigators allege, Adam Montgomery moved the body from container to container and place to place. According to his wife, the locations included the trunk of a friend’s car, a cooler in the hallway of his mother-in-law’s apartment building, the ceiling vent of a homeless shelter and an apartment freezer.

At one point, the remains were kept in a tote bag from a hospital maternity ward, and Kayla Montgomery said she placed it in between her own young children in a stroller and brought it to her husband’s workplace.

Finally, MassDOT photos show a U-Haul crossing the Tobin Bridge in Massachusetts in March of 2020. According to Kayla Montgomery, that's when he arranged to have a U-Haul rented, allegedly disposing of the body.

Adam left in the middle of the night at approximately midnight or 1:00 A.M. ... Kayla said Adam then returned at approximately 5:00 or 6:00 A.M. that same morning.
