NJ - Sean Goldman: Abducted and living in Brazil UPDATE: Coming Home

As unlikely as this is to happen, I wish the goofy grandma was court ordered to take some parenting classes. Something similiar to what courts order two parents who can't coparent. At least if David makes visitation contingent upon that, grandma can put up or shut up!

I'd bet all the money that family has she would not go for it, because she can't see her actions are wrong and not in Seans best interests.

Their allegation doesn't make any sense. David Goldman became almost peniless in his five and a half year fight to regain his son. They are rich Brazilians and were fighting on their own soil. Thus, they didn't lose much in the litigation down there. If all David cared about was money, he could have saved himself the expense of lost wages, repeated trips to Brazil, hiring attorneys to fly down there to fight for him, etc, and just left his kid there.
He's simply trying to reclaim what those people stole from him with their criminal antics in illegally keeping his son from him for all that time. They were in the wrong, and went against interntational law. He ultimately prevailed but it cost him an arm and a leg. Now, they should pay so that Sean is not further vicitmized by the loss of his father's resources.

They keep using this to keep their faces in the media in Brazil. David has not requested any money from the Brazilian family. Article 26 of the Hague Convention discusses reimbursement of the LBP. Judge Pinto ordered the reimbursement in his June 1, 2009, ruling that was later upheld by the TRF-2 in December. This family is barking up the wrong tree....they really need to get a life and worry about raising Chiara, Sean's half-sister.

I was thinking more about it.. I know there is a donation button on his site. I'm not sure what he'll need in the way of donations and how people that have donated to him would feel if he took what would be left to make some sort of foundation for other parents to use to get help. He has a great opportunity to help many other parents/children. He's been so fortunate; it's my hope he will pass that on.

I understand Sean (and possibly David) will need years of therapy; so maybe there won't be anything left donation wise.. but it's nice to "dream" lol

My husband has raised my daughter since she was 5; she is now 16. My son was 7 when I married daughters father; never called him dad. He was a teen when my hubby came into the picture; so even though my hubby has been the man in both of their lives for the last 10 years, they both have fathers; even though they don't see them often.

About my comment with Sean being shown in pictures.. I was wrong, there is video of him opening a gift & some video of him on the plane; nothing with him speaking & IIRC he was wearing sunglasses.

As the day has gone on; I've become more & more upset over the Brazilian family.
Dad told his ex-mother in law to tell Sean that his dad loves him and that he's a good dad.. not sure if she ever did.

Reading her comments about how the grandmother raises the kids after the loss of the bio-mother; followed by how David is taking "her" child; well that just makes me hot. Does she forget how she took Sean from David?

FWIW, everything I'm reading, David has had attorneys on the case since day one. Bruna was allowed to get away with the law for so long that now they are whiny little babies because they "lost". They forget that David was the main caregiver to Sean when he was little; they took away some of the most important years of his life.

I'm glad David left Sean's room the way it was when he left. While I know he's too old for Scooby Doo; I'm sure it will help him remember the good times & how much his dad has never stopped loving him or fighting for him.

The most moving video was David talking about the "Christmas miracle" and how there are so many days a year but it was this day that Sean came home. I assumed he did not celebrate Christmas; but I guess I'm wrong.

I'm very happy David got Sean back but it bothers me that now this is hanging over his head :( Why couldn't he have a week alone with his child before the cr@p hit the fan????

David did ask Silvana to tell Sean that he is a good Dad and that he loves him and she did. As for her telling everyone that she has raised the children after Bruna's death....I think that is laughable. The entire case since Bruna's death has been with Joao Paulo Lins e Silva not Silvana Bianchi. She stated that JPLeS and Chiara shared a room with Sean...well, we know that isn't true now that she showed Sean's room on Brazilian tv.

The most moving thing for me has been the fact that the Brazilian family has done everything in their power to have people believe that Sean doesn't remember David. Well, we all know that isn't true. Sean ran upstairs to the banister because he remembered biting on the railing as a child. He asked his Dad if those were his teeth marks. It fills me with joy to know that he is finally home with his Dad who loves him more than life itself.


The mother's family in Brazil makes me want to scream!!! The mother took Sean away from David and they act like they are the ones suffering this huge injustice. It just burns my azz to no end.

And now after all that David has gone through to get his son home, this selfish disgusting grandmother won't leave well enough alone.

It always amazes me how these people play it off like they want to do what's best for the child but all they really want is to make themselves happy. She disgusts me. Absolutely positively disgusts me.

You have just stated my exact feelings. They want to play the poor pitiful me scenario but they never had an ounce of compassion for David and what they did to him. The original abduction was planned out to a tee. That didn't just happen upon her arrival in Brazil. If she didn't think it out beforehand, then why did she take all of her things and none of Sean's? Oh, those people drive me insane! :banghead:

Oh boy, these people really seem to be trying their damnedest to totally alienate David Goldman, until he finally has enough and tells them to go fly a kite! (And, to forget about any future visitation!) I think they are just plain toxic!

I'm not going to post any of the article, because I think it's a bunch of *BS*. I bet it's safe to say that the lawyer representing the Brazilian families probably only cares about money! I bet he's made a bundle on "Sean", too!

They are unreal! :furious: At the top of this post, and I will state again, David hasn't requested to be reimbursed for these expenses -- nearly $500K. It is in Article 26 of the Hague and a part of the original court order by Judge Pinto.

As for visitation....the only way I would agree to it is if it was supervised. IMO, she needs to have a mental evaluation.

Oh, and for anyone interested about the media circus in Brazil when they took Sean to his Dad....the Brazilian family has repeatedly stated that they were never offered the chance to park in the garage to make it private and less traumatizing for Sean. Well, that's not true! Tostes (the attorney) has gone on record stating that was part of his plan to park a block away and parade Sean through the streets because they were upset about the return order. :furious: And they have Sean's best interest at heart?

Regarding the flight back to the US....it was a NBC chartered flight for their crew that was in Rio. There were additional seats on the flight and they offered David and Sean the seats so that there would be no delays in leaving Rio. Otherwise, it could have been as late as 11pm that night before they could have left Rio. By taking up NBC's offer, they were back in the US before 11pm.

We are working on Francois Larivee's case. He is a French Canadian who is awaiting the results of an appeal hearing; he's been waiting for 2 years to have this appeal heard by TRF-2 (that his ex had filed after she hid their son when she received a return order). It was the TRF-2 that ordered Sean Goldman home.

Ohhh...one interesting thing...Joao Paulo Lins e Silva and Paulo Lins e Silva were Francois' Brazilian attorney's until they were fired in January 2009.

ITA. This is absolutely disgraceful. This poor father has been through so much. If the shoe were on the other foot and a child was being kept here in the US you can believe there would be protests and outcries about how unfair this is. Something must be done now to unite Sean and his son.

and the fbi breaking down doors in the middle of the night with sub machine guns (see elian gonzoles, florida 2000)
 
I think it's incredibly sad that this can't be resolved with dual custody and frequent visits.

im just curious, since when do kidnappers and there accomplices after the fact get shared custody and frequent visits?? even parentel kidnappers go to prison in the united states and get no custody what so ever

David is lucky, he had the support of LE and the US government. Not all left behind parents have any support, even for parental abductions within the US. There are sadly, many many cases within the US were LE just dismisses the case entirely because they believe the child is safe because they are with a parent, and to heck with what the law says. The above link is just one example. I can think of a few more cases that have been posted here at WS as well... and LE could care less.

i did oer speak. in fact, as a follower of the jaycee dugard case, im waiting for the moment her bio-dad sues for visitation rights to his grandaughters of a daughter he's refused to see all her life. or even worse, that 🤬🤬🤬🤬🤬🤬🤬 garrido might get some bonehead judge to grant visitation to her daughters.

I fail to see your point, can you explain? I'm talking about parents who are not a danger to their minor children and have had their child stolen by the non custodial parent or another family member without primary custodial rights. Your example lists a felon who is also a child molester, and grandparent rights to a person I don't know ever established or claimed legal rights as a parent.

my point was pretty much i dont have much faith in our courts, no matter what the situation is.
if brazil makes a big stink about the goldman case, like cuba did over elian, will david have to barricade his house from an fbi raid in the middle of the night?
because our goverment will put politics over doing whats right, easily.

We, the volunteers at BSH, worked to get more media attention for David's case -- CNN, Fox, etc. NBC was the FIRST group that stepped-up and told David's story, in it's entirety...not to mention, honestly. If it takes David going on NBC, CNN, Fox, etc., to bring attention to this problem -- INTERNATIONAL CHILD ABDUCTION -- then I'm all for it.

There are more than 2,800 AMERICAN children that have been abducted abroad. More than 300 in Mexico, 65 in Brazil, and 125 in Japan where there is no Treaty in effect. Child Abduction is not illegal in Japan. :waitasec: We have a lot of work to do to help resolve this problem.

I am SO flipping happy that NBC is shining the media spotlight on this story. For those that went through this 20 or more years ago when not illegal...for those whose children are still being held hostage....I thank NBC and Mr. Goldman for getting the word out there.

20 some odd years ago, it was not illegal for a non-custodial parent to take a child out of state. Barring concrete proof of child abuse...even if the parent threatened to never return the child after visitation...judges would not do anything. It was horrible.

Thanks, after I posted I did some googling of my own ran across a 4 part series by MSNBC that was really good. Wish I would have brought the video links over here. There were interviews with David's friends & family; 3 women that also knew Bruna; plus phone conversations between David & Bruna where she was screaming at David; told him she left the way she did because she was unhappy living in New Jersey. It also explained about the web site. While I've been following Davids story for probably 2 years, I had too much going on in my own life to do what you do.

What I've always wanted to do was something on custodial parent rights when the non-custodial parent holds the health insurance.

I also found a video on CBS of the grandmother & Sean's step father. Must have been hard for the interviewer to ask questions. lol Looked like he was biting his lip/tongue at one point.

I taped last nights show, can't wait to watch it.
