ALBUQUERQUE, N.M. - A protester was shot at Tiguex Park Monday evening during a demonstration that was calling for the removal of a Juan de Oñate statue, "La Jornada," outside the Albuquerque Museum.

Police say they arrested former city council candidate Steven Ray Baca, 31, in connection to the shooting. He has been charged with aggravated battery.

Moments before protesters were about to remove the statue with a chain, a struggle broke out among the crowd.

Video footage shows the protesters directing their attention toward a man brandishing a gun.

Mayor Tim Keller sent the following statement after Monday's shooting:

“The shooting tonight was a tragic, outrageous and unacceptable act of violence and it has no place in our city. Our diverse community will not be deterred by acts meant to divide or silence us. Our hearts go out the victim, his family and witnesses whose lives were needlessly threatened tonight. This sculpture has now become an urgent matter of public safety. In order to contain the public safety risk, the City will be removing the statue until the appropriate civic institutions can determine next steps.”

The governor's office also sent a statement about the incident:

“Although we are still learning more about the situation, I am horrified and disgusted beyond words by the reports of violence at a protest Monday night in Albuquerque. The heavily armed individuals who flaunted themselves at the protest, calling themselves a “civil guard,” were there for one reason: To menace protesters, to present an unsanctioned show of unregulated force. To menace the people of New Mexico with weaponry – with an implicit threat of violence – is on its face unacceptable; that violence did indeed occur is unspeakable.

“I am monitoring the situation; my administration is in touch with local officials; the individual who was injured is in my prayers, and I am thinking of their family and friends.

“Let me clear: There is absolutely no space in New Mexico for any violent would-be ‘militia’ seeking to terrorize New Mexicans; and there is no space for violence of any kind on our streets and in our communities, or for any sort of escalation of reckless, violent rhetoric, no matter who strikes first. The instigators this evening will be rooted out, they will be investigated, and they will be held accountable to the fullest extent of the law.”

Mayor says there's no space for violence, as citizens are ripping down public statues? The video I just watched (on another website) showed the man arrested man being chased and beaten up on the ground before you hear shots being fired.
What'd I miss??

This, perhaps:

In one video, the man identified as Baca, clothed in a blue short-sleeved shirt, can be seen grabbing a protester and throwing her to the ground. In another video, he appears to strike a woman. “He had *just* slammed a woman to the ground with no provocation before this video started and protesters obviously responded to that violence from blue shirt,” posted one Twitter user.

It would appear that the police account differs (in parts) from eye witness accounts on SM. There are videos supporting some aspects of the former, and also refuting others aspects. It would appear that the man arrested was witnessed (and filmed) assaulting women in the crowd before they began to chase and confront him in return.

I wondered why the kids were chasing him down. I guess that's why..
..I'm editing my above comment because I can't find any video of the arrested man throwing a woman to the ground. Surely it's out there with the amount of people with cell phones.
If anyone finds video please post it.

I've seen the videos on twitter. They are not hard to find. But I am pretty sure they are not link-able since they are not from news sites.

I saw at least 3 incidents involving the shooter in physical confrontations with women at the protest. It also looks like he had mace in his hands and possibly sprayed people when they chased him. I did see in one video that a woman may have been pushing him back, too. But there's one incident in particular where he throws the woman so forcefully onto a patch of concrete that a medic immediately intervenes. I should think that is the event which may have pushed the crowd's anger into overdrive.

Still, I think the 'what happened/when' part is a bit jumbled. An investigation of all video footage is warranted to make sure a full timeline is established and the involved parties correctly charged. From what I understand, the state police is taking over and APD is deferring to them.

After watching the video it looks to me like Baca has a valid self-defense claim.

I heard the protester screaming I"M GOING TO KILL YOU while he was on top of Baca. Other video's report protestor had a knife but I can't tell in the photo so will just call it "something" in his hand.

Were the women destroying property? They might have been partisan participants in a demonstration that escalated beyond their expectations.

Shooting charges dropped against Baca
Shooting charge dropped against suspected New Mexico shooter
Bernalillo County District Attorney Raúl Torrez said he had serious concerns an initial police investigation into the Monday shooting did not identify who owned multiple weapons collected at the scene, including knives, nor interview key bystanders and police.
Torrez filed four new charges against Baca for unlawful carrying of a firearm and battery for allegedly assaulting three women before the shooting.

Nope, not that I could see in the videos. I think one of them was even tearing down a cardboard protest sign from the statue, when he attacked her.

But still, even if the women attacked were defacing the statue in civil protest (look up the history of Onate, it's beyond vile), even if they were attempting to pull it down, that still doesn't doesn't justify assault and battery, and violence to their person. Especially with weapons (mace and gun) involved.

People's safety, well-being and their very lives should always be more important than property, or a public monument, in my opinion. JMO.

City removes Oñate statue after Monday's violence

“Human life is non-negotiable. Human life cannot be replaced,” said Tripp Stelnicki, a spokesman for the Governor’s Office. “Inanimate ‘property’ is not sacred in that way.

“To be very clear: That is not to say the attempted destruction of property is condoned,” he added in a statement. “But it would be a heinous false equivalence to suggest that any inanimate object — in this case a statue with implicit overtones of a celebration of oppression and genocide, as viewed by many New Mexicans and Native Americans — is as important as any one human life, which was grievously endangered … .”

I think dropping the shooting charge itself makes sense, because it's likely that Baca did genuinely fear for his life and fired in self-defense, there is a screenshot floating around here it does look like someone had a knife in their hand. I think it's going to have to be left up to the investigators to sort it out.
