Synthia Varela-Casaus is in jail, awaiting trial on charges that she killed her 9-year-old son in December 2013.

She and another inmate have filed a lawsuit against the county. They claim they were put in a prisoner transport van without being belted in, and said that they were thrown into a metal partition when the van hit something.

The pair claim they didn’t get the medical care they needed and now they want the county to pay up.

Varela-Casaus is due to stand trial in Omaree’s death in October.

"There's more than enough proof to know that this woman abused and killed her son Omaree Varela and is using everything she can to get her case dismissed along with the 1,000 other cases District Court plans to dismiss. Omaree deserves true justice! True justice would mean his mother would be convicted by jury with no plea deal for her or the stepdad and both be sent to prison for the maximum sentence or death penalty. If new mexico is really all about protecting children then lets do it.Omaree was a human being and deserved to be treated as such. LETS PROTECT OUR CHILDREN, THEY ARE OUR FUTURE!"

Signed the Petition and shared on facebook. This little boy reached out for help, and 'we' did nothing. What did those officers think Omaree would say with his abusers standing right there? How can people be so stupid? I hope his death haunts everyone who let him down. :maddening:

ALBUQUERQUE (KRQE) – The case against the Albuquerque mom who is accused of killing Omaree Varela has been put on hold.

KRQE News 13 has learned there are serious questions about whether Synthia Varela-Casaus is mentally competent to stand trial.

Varela-Casaus is facing charges for kicking to death 9-year-old Omaree Varela in 2013.

The case is now on hold while the court determines whether she’s mentally competent.

KRQE News 13 will provide updates as they become available.

Prosecutors say they now have evidence the stepfather of Omaree Varela actually participated in the 9-year-old’s death. Omaree is the Albuquerque boy allegedly kicked to death by his mother. Now her husband Stephen Casaus is facing new charges.

Court papers reveal that new evidence recently found during discovery and pre-trial interviews conducted in may implicate Casaus in the actual beating. He was previously charged for knowing about the abuse, but failing to protect the boy.

Casaus was back in court Friday to be arraigned on that new child abuse charge. He plead not guilty.

Until now, Casaus was accused of knowing about the child abuse, but failing to stop it or get help for the badly-injured little boy. Casaus is now facing a second charge of child abuse resulting in death, but this one includes the term "intentionally caused." Prosecutors say new evidence has emerged that will show Casaus participated in the acts of violence that led to the death of Omaree Varela. The judge ordered a $100,000 cash-only bond that will apply to the new charge as well as the older one.

Causaus was there the night of December 27th when the boy’s mother Synthia Varela-Casaus admits to kicking Omaree to death. She too is facing a charge of child abuse resulting in death and according to the new indictment Casaus participated saying, “intentionally placed the child in a situation that endangered his life or health” through physical abuse or striking the child.”

This case still kills me. That child did what he was supposed to do. He told. He called 911. And he was left there. To die a horrible death. Very disappointing that these two have not been been tried and convicted yet.
