Looks like Mr Gooch isn't having a great time in jail going by this photo of his appearance yesterday.

The court isn't in session today - Opening statements scheduled for Friday

Wow, that is quite the shiner. I would imagine he's in general population with that kinda black eye. I've heard of inmates being physically assaulted based on the crimes they've committed (usually against children), but perhaps someone in his unit draws a hard line at sexual assault and murder of Mennonite women. MOO.

Judge giving very clear instructions on what a jury can or cannot do, and how the trial will proceed, I think every judge should do this at start of trial, many I have seen just give the do not speak to anybody about case or amongst fellow jurors, or look at TV social media etc. This judge is explaining everything.

I think this case is going to be over explained - a lot. The prosecution has mostly circumstantial evidence. Take a look at the states voir dire. State of Arizona vs Mark Gooch | Coconino

from openings the state has the 22 rifle matched to the bullet from Sasha that the defendant gave to a friend to look after, they have lots of cell phone data showing defendants movements, no DNA, no fingerprints, so far I think they have evidence showing he could have committed the murder, but as to whether he did I will need much more from that state proving it,

defence is he went to the area where Sasha was kidnapped from to check out the mennonite church, he told this to LE when interviewed, defence atty focused on no eyewitness to any of the events from her kidnapping to her murder, focused on no DNA fingerprints etc, no connection between victim and defendant, no motive defence atty states that he had to kill her, (state saying defendant has animus towards mennonites and Sasha was killed due to his animus towards them).

the defence is going to focus much on the character of the defendant, kept saying he was peaceful and non violent, defence has its own ballistic expert who will say gun and bullet not conclusively linked, I think the defence has a case to argue, but the cell data may be problematic for the defence, as it just seems a huge coincidence that the only time he is anywhere near the mennonite community where Sasha lived was the day she was kidnapped, and on that day (according to states cell data evidence) she was kidnapped and dumped his cell phone was in that area where her body was found.

I think the defence may lose the jury if they continue to go after sasha ever going outside without her head covering, she was found without her head covering and defence want to argue she went out that night without her head covering as the state will argue the defendant took her head covering because of his issues with the church,

and am unsure how going after her fellow mennonite Lucinda who Sasha had issues with, but he has to point the finger at others if he is to get a NG

Actually -- the defendant allegedly gave the gun to his brother who pled guilty in 2020 and was sentenced to 3 years probation. From the YT link:

Gooch also grew up in a Mennonite family but never formally joined the church. Brother Sam Gooch allegedly told authorities Mark Gooch held a grudge against the community. This same brother pleaded guilty and was sentenced in 2020 to three years of probation, according to The Associated Press. The Wisconsin resident admitted traveling to Arizona to get the rifle he believed was used to kill Krause.

this defence attorney is very good, he is making the argument that LE did not do the best job of looking for evidence, the cell phone data needs to be very very good or the case is on very weak footing, they do have the gun but the defence has its own ballistic expert and I am of the opinion that many so called forensic ballistic experts often are often very certain of their findings when I don't think the findings are based in science, I don't think the science of ballistics is as sound as it is often claimed to be,

and the state atty leaves himself wide open when he asks questions so that the defence can make very good points after the state atty has left the door wide open

and I am still confused as to why the state agreed to the stipulation that she was not sexually assaulted, they do not know if he touched her breasts or if he put his hand up her skirt or where he may have touched her, so why would you state she was not sexually assaulted just because their was no semen or sperm or evidence of vaginal penetration doesn't exclude any or all types of sexual assault, he did take her underwear so to me that would appear to be sexual in nature,

I think so far for me the defence is doing a better job

MOO I think it's likely the family has asked this to be clarified and highlighted. As it's not part of the accusations against him - prosecution and defense may have agreed to make sure it was made publicly clear for the family. It's something that would be extremely important to them with their strict religious beliefs.

I don't think the prosecution is doing a good job of proving MG did this at all. I knew the trial would be very circumstantial but I didn't realize it would also have a bunch of holes all over.

- Testimony yesterday said SK's phone stopped pinging in Towaoc, CO not at all the same route that MG's phone was pinging according to the opening statement images shown. I can't wait to see more on cell pings because imo it's about all the prosecutor has left to hang his hat on.

- Yesterday's testimony included the fact that SK's room mate also owned a .22 and they did not do any testing on it.

- Autopsy photos do not show a woman that has been out in the open in the elements for over a month in my opinion. ME stated time of death could be anywhere from days to weeks to a month. Looks more like days or a week or so to me which ruins the prosecutors time line. Shown here briefly at 1:04:43
