Why are we doing all of the Debating (trying to be nice) in front of the witness?

These motions are allowed in front of witnesses just not the jury.

I am not sure! But this witness must be Mr. Chavez's civil case lawyer if he is looking for his bill and how he was paid......I thought that one case was seperate from the other. So how come this is even being brought into this case? And by the defense no less, who wants stipulations on what prosecution can ask after they bring this witness to the stand?

He he, witness put Serna in his place about testifying and referring to his papers.

If you have headphones you can hear Serna better.

CJ thanks I do have earphone and they help tremendously. I was just curious as to why the witness was already on the stand? I had to refresh and missed him coming in.

Did this witness get paid 36,000.00 for his part in the civil case or is that someone else? He has an impressive CV but geez that is a lot of money if the state was paying for Mr. Chavez's defense in that case too.

This witness is full of himself but in a humble way. Excellent credentials, but I am certain Serna gave him strict orders to include everything he could come up with.

This is not his testimony...it is still his CV so I think reading it off his writen CV is ok....

Yes I am feeling the same way. He talks and then looks down and looks like he is reading. I don't feel like this from his memory.

He has said twice he doesn't want to leave anything out....and this is per Serna's instructions, he said in some way. Serna obviously gave him a detailed dictate on what to include and Mr. McCann doesn't want to omit anything. Again, self aggrandizing, but for Serna's sake and LC's advantage.
Is the jury out?

I'm not going to mention that I have another bad headache today. If all of these storms would go away I would feel good, and act like I have some sense, sooner or later.

In other trials I have watched usually the defense or prosecution reads off the CV in their hands and asks questions to the expert about it! So in this case I would say this way is better! I would hate to have the jury listen to defense mumbling the entire CV off......LOL
