Eichwald, picking up on a concern raised by Serna, said he didn’t want the jury to see the video, in part, because Chavez was dressed casually during the deposition and he didn’t appear pleased to be speaking with civil attorneys hired by the family of his dead wife, Tera Chavez.

The above is from the article from the ABQJournal above that CJ posted. I am tired of this judge taking his cues from Serna.
There may be a couple of people on this thread that were on the Brad Cooper trial who can attest to the fact that during Cooper's civil deposition, the opposing attorney didn't hold anything back. Cooper didn't appear to be pleased either, it was a child custody deposition, but my gosh, who acts happy at any of these things.

I know sometimes a defendant in both civil and criminal cases can file on 'inneffective advice of counsel'. Can the family of TC file against this prosecution team?

Excellent question. I should think Tera's family has just cause against the prosecution 'team' and that judge that looks like he suffered some hard impact injuries to his brain. :banghead:

In his testimony NW stated that he told SW about his affair on October 24, 2007 in the p.m. In that testimony NW stated that he did not know that his wife already knew about the affair but she did already know about it. SW must have NOT disclosed to NW that she knew about the affair when Tera disclosed it to SW. SW gave her husband a lot of rope if you ask me.

During that testimony we never learned how SW learned of the affair. Today we learned how, Tera told her. amazing.

Thanks so much CJ, I was so lost there. She sure did give him rope, guess that's why the defense is trying to plant the seed in the jurors' minds that possibly someone else had a reason to hurt Tera. How could SW look at him everyday knowing he was fooling around, and with whom, and just go on? That would make me so crazy.

The judge really has a look at times that makes me wonder. I remember a Law and Order show in which the judge in a trial had dementia and his law clerk was sending him decisions, etc. via email on his computer right there on his desk. So everything he did from the bench appeared fine, until the Law and Order guy figured it all out. I'm wondering if some of the same isn't going on here.
I am not putting Tera's family down in what I'm about to say. They may all have been born and raised right here in the US and majored in civics and political science in college. But I'm afraid they may not be aware that they appear to be getting a bum deal. I am not satisfied with this prosc. team, at all, and if it were my daughter's murderer on trial I'm afraid I'd be in McKay's face during every break. I don't want them to just sit back and take what they are handed when it's all said and done. It's looking bad, in my opinion, and they have already experienced so much pain. I wish a more experienced prosecutor had been given first chair--somebody who isn't intimidated by Serna and his antics.

WildAboutTrial on Twitter just annouced they are live streaming and I complained. He wrote back saying they had not heard of any complaints, asked what exactly is happening. Wish you all would go over there and complain #LeviChavez and it's WildAboutTrial who is talking to me.

Lord have mercy. I can understand why a juror had a medical situation. I'm having a few myself. This trial is going to end up killing me.

One of the juror's is sick (can I blame him? nooooo) court out for the day. I guess that means NM doesn't believe in having alternative jurors for just such an emergency?

That is exactly what I was thinking... what are the alternatives for then? I think this would be one of the reasons? Plus it just breaks up the flow of the trial and IMO it gives Serna more time too work on his strategy. Does the PT get to focus on just this case while it is taking place. I am sure Serna has other clients yes but I bet they take a back seat to this current trial because of the high stakes... I hope the PT gets that same luxury but somehow I doubt it. Does anyone know how that works?
