You can come and watch the Young trial with me. It has a good team of prosecutors and one good defense lawyer.

The trial is in recess for the rest of the day. The Young trial is on eastern time and I believe they start at 9 am and end at 4 pm.

I still want to know what happens with this trial, I am just frustrated with the feed.

That is exactly what I was thinking... what are the alternatives for then? I think this would be one of the reasons? Plus it just breaks up the flow of the trial and IMO it gives Serna more time too work on his strategy. Does the PT get to focus on just this case while it is taking place. I am sure Serna has other clients yes but I bet they take a back seat to this current trial because of the high stakes... I hope the PT gets that same luxury but somehow I doubt it. Does anyone know how that works?

It wouldn't be commonplace for them to seat an alternate for just one afternoon of a juror being sick. If the sickness turns into what appears to be several days then an alternate would take his/her place.
I totally agree that all of these interruptions mess up the flow. It's been difficult enough to follow, the jury has been in and out, in and out, for 2 weeks. I don't think any of the attorneys or the judge are as prepared as I would like to see. I don't think the attorneys work on other cases during their down time on this case. I would hope that the prosecution is brushing up on everything as it seems their case is in a downward spiral.

Thank you NCEast, that makes sense and I feel reassured.

The prosecution MUST connect all of the dots in this case when he's giving his closing argument. The trial has been so disjointed, I don't know if the jurors are taking notes?? I hope so, at the very least. McKay will have to make it all make sense in his closing so that the jury enters deliberations with the same knowledge and gut feelings we all have now. We have been on here talking about this case for 2 weeks and they haven't been able to utter a single word to another soul, and can't until they begin their deliberations. If they have questions, the only hope lies in McKays answering them during his closing. I hope he has the forethought and wisdom to tie everything together in a neat, easy to understand package, so they will see, beyond a reasonable doub,t that nobody else in this entire universe had reason to kill Tera but Levi Chavez.

Argh, too busy all day. Thanks everyone for the updates.

I missed you--was going to ask where you were, but I spent all day fussing and cussing at the live stream and then at the stupid courtroom disruptions.
Hope you can join us tomorrow!

Jewels, I read the Young thread late this afternoon. It's a very interesting, yet so very sad, case.

So today the SW testimony was not long but had some very interesting pearls in it. The biggest one for me was when she said Tera did not like guns and basically if she were to kill herself it would not be with a gun and being that SW was close to Tera and knew her well this information is powerful. Also that Tera of course struggled because of her problems with Levi but that she was not suicidal. This was also strong testimony for the State IMO because it shows SW as being a very honest witness... Tera was a normal woman and with a husband who was so badly behaved everyday was not always peaches but it did not mean Tera wanted to kill herself either. SW also said Tera was truly "ready to move on".

Longtime friend says Tera Chavez didn’t like guns

By Jeff Proctor / Journal Staff Writer on Mon, Jun 24, 2013
12:48 p.m.

Tera Chavez “didn’t like guns,” according to testimony this morning from a longtime friend with whom she had a complicated relationship.

Samantha Wheeler testified today — as the third week of the murder trial against Chavez’s husband, Levi Chavez, began — that she had been the maid of honor at the couple’s wedding.

Later on, in August 2007, Tera Chavez told Wheeler that she had been having an affair with Wheeler’s husband, Nick Wheeler.

Three days after Levi Chavez allegedly killed Tera in the couples home in Los Lunas, Nick Wheeler confessed the affair to his wife. That was October 24, 2007, a date Samantha Wheeler remembered well because it was her birthday, she testified this morning.

Samantha Wheeler testified that her friendship with Tera Chavez began in high school and carried on into adulthood. She said knew Tera to have emotional ups and downs because of Levi’s infidelities, but never knew her to broadly depressed.

In the last months of Tera’s life, according to Wheeler’s testimony, “she was ready to move on.”

In an interview with detectives after Tera’s death, Samantha Wheeler said she believed the 26-year-old might be capable of suicide by drug overdose or by cutting her wrists. But Tera never would have shot herself, Samantha, told detectives.

Earlier this morning, during a hearing to decide whether an alibi witness for Levi Chavez had a Fifth Amendment right to avoid testifying, his attorney asked for immunity from prosecution. Bryan McKay, the lead prosecutor on the Chavez case, said he would not be able to grant immunity to Russell Perea, the former APD officer who was sharing a police vehicle on the weekend Tera died. “If there was any kind of perjury, it would have been in Bernalillo County,” McKay said.

The question now is whether State District Judge George P. Eichwald, who is presiding over the Chavez murder, could grant Perea immunity. After conducting a brief interview with Perea and his attorney in chambers, Eichwald said in open court that he would research that question. The judge expects to announce his findings some time in the next week.

Prosecutors expect to rest their case on either Friday or next Monday.

I was impressed with her and her testimony. I noticed early on when Serna was throwing his remarks to her that she was smart and didn't let him put words in her mouth. She corrected him a few times, or restated in her own words something that he twisted up. Coming from the standpoint of the spouse whose husband was having an affair with Tera, her testimony was even more relevant in my opinion, truthful and honest .... and she was still friends with Tera even after Tera told her about the affair. I am happy she didn't' give up on her marriage because of the affair and I hope her husband appreciates what a good person she is.
I am trying to watch tv and this case keeps popping into my head. I will start praying tonight that the jury gets to hear a full day of hard testimony and that our live feed and audio will be working just fine tomorrow.

Thanks all of you for updates.
I started watching the "Z" trial this morning before LC started, then when I tried to boot up stream for LC it was just TOO much.
I wish whomever is running the stream would get it together, I so want to watch this trial without losing my mind refreshing constantly!

But I will try to keep up with both trials in the meantime, probably watch the Z stream and check all your updates, which I greatly appreciate :tyou:

Are any of you going to follow the Andrea Schneiderman?
I am looking forward to that one, she is another one who is so wacked you just can not look away (ala JA)!

PS- If it is a "white shoe" day please alert me, I will risk the stream problems for that! LOL

Okay I will give you a shoe alert. I definitely want to follow the Andrea Schneiderman. That woman drives me batty. No way do I want her to just walk away free, that for me is a must see.

If I knew anything about the Zimmerman case I'd jump ship because KOAT and Mr Tony Sabato (Mr. 'the live stream is up'!) should get the raspberry award for $hittiest broadcast in the world.

Oh good morning brave souls!

Oh good morning brave souls!

Makes you wonder who got the contract to install this rinky-dink set-up and what happened to most of the money, it certainly doesn't seem to have been spent on the equipment.

The Z trial should be easy to catch up on, testimony only started yesterday and there are gobs of articles about it. They have a wonderful broadcast, I wish I had more interest in the case.

P.S. Good morning! :)

Good morning peoples. Hope the live stream is better today.

I am watching the GZ trial but will NOT participate NOR read the threads. I do not need the aggravation.

Sorry to admit, I find DNA testimony as boring as my first husband. Nuff said.

Good Morning all!

I am watching today, and have found out today that if I only watch the feed I have no problem. If I go and do anything else on my lap top while listening I lose the feed. Just thought I would let you know.
