8/30/24 Update: On Friday, a grand jury handed down a superseding indictment that added seven charges of child abuse with a deadly weapon involving a second child. Jurors were shown surveillance video of Smith placing two of her children in a stroller, with her youngest strapped to her chest & walking to a nearby dumpster. While the dumpster was out of frame, court transcripts stated an audible “thud” could be heard. Smith & Robinson previously pleaded not guilty but will have a chance to enter new pleas for the additional charges on Wednesday, 9/4/24. Both Jacoby Robinson Sr. and Diaja Smith have pleaded not guilty. Smith has a court hearing scheduled next week to choose an attorney. A trial for both remains scheduled for June.

As the 8 News Now Investigators first reported, Diaja Smith, 23, regained custody of 2-year-old Jacoby Robinson Jr. and his two younger siblings just weeks before the boy’s death on June 6.

Weeks. It was only a matter of weeks before she killed Jacoby. She never should have gotten those kids back. Period. At least his two younger siblings will never ever ever be subjected to their "mother" again.

*Status Check: Trial Setting Hearing for both (@ 9am PT) - NV - Jacoby Robinson, Jr. (2) missing June 6, 2024 @ 8:25pm & found dead in dumpster @ 1am on June 7, 2024 a few blocks from home in Las Vegas - *Diaja Misha Khaeema Smith (23) arrested & charged (6/7/24) with open murder [with the use of a deadly weapon or tear gas] & child abuse/neglect. No bond.
Indicted (7/12/24), re-charged & arraigned (8/8/24) with murder (with use of a deadly weapon) & child abuse/neglect.
Indicted & re-charged (8/30/24) & arraigned (9/4/24) with 7 counts of child abuse with a deadly weapon involving a second child. Clark County
*Jacoby Michaial Robinson (24) arrested & charged (6/7/24 & 6/11/24) with open murder [with the use of a deadly weapon or tear gas], child abuse/neglect w/SBMH & allowing child abuse/neglect (endanger), w/SBMH. No bond.
Indicted (7/12/24), re-charged & arraigned (8/8/24) with murder (with the use of a deadly weapon & child abuse/neglect. Plead not guilty.
Indicted & re-charged (8/30/24) & arraigned (9/4/24) with 7 counts of child abuse with a deadly weapon involving a second child. DA will not seek DP. Clark County
The slain boy’s twin also suffered serious injuries, including a brain bleed. He was listed in critical condition at the time of his parents’ arrests. Their injured son’s condition remains undisclosed as of Thursday 6/13/24. Discovery of his body in a dumpster.
Trial was set to begin for both on 6/23/25 was vacated [3/4/25] by Judge Kierny.
