GUILTY NV - Sayah Deal, 1, dies in hot car, dad refuses to break window, Las Vegas, Oct 2020

  • #41
At this point, I do sympathise with the cops in this tragic situation. Right now, they are so stifled when trying to engage with people who are adamant about something----if the cops busted the window and the baby was fine, there would be anger and perhaps lawsuits against the officers, for being disrespectful, etc, when the child was fine and her father told them so, and the cops didn't listen and respect his decision. If the child appeared OK then they may have tried to comply with the man's wishes, to avoid another angry situation?

How long was the car sitting parked, in the heat, before the argument? How hot was it in there when this sweet little one was put in there? A few minutes after leaving he goes back to mom’s for his phone, argues with mom, realizes Sayah is locked in car. Then mom spends 20+ minutes on phone with insurance company.
I’m guessing the car was hot as hades when Sayah was put in it. Maybe mom and dad argued longer than they are saying.
IF mom is actually saying she last saw her daughter hours before she died then someone is lying about the timeline.
In the article I just posted there are people saying it was 2 hours ? As I mentioned I’m not sure the AC was really running cold -otherwise she would be alive - I’ve driven 3 hours in FL with the AC running and no one died....

Police: Las Vegas man refused to let anyone break window to rescue daughter from hot car
Neighbors who witnessed the failed rescue criticized the officers for not acting more quickly. Shellie Ratliff, 64, told the Review-Journal that she watched Deal and the police try for close to two hours to get the little girl out.

The officers at one point asked her if she had a wire clothes hanger to pop the lock.

I’ve had to replace windshields multiple times over the years with several insurance agencies- the deductible was always $100.

Where was the little one before the argument? Was she with the father? If you’re arguing, just take the child back into the safety of the home? Not leave her outside in a hot car?

I haven’t seen any statements that the car was running.

The way our insurance works- if something breaks your windshield by accident, its covered 100%. If you break a window on purpose, for example to get your keys out, it pays nothing.

however, if my child was locked in the car, i wouldn’t hesitate to Break a window out. I wonder if she was already dead when placed in the car.

She pulled the mask down from her face to emphasize that her son believed his daughter was in air-conditioning.

The car was running and she was in the car,” Wilson said through tears.

The Sun reported that Deal told detectives Sayah, who he’d not yet fastened into her car seat, had initially been up and walking around the seats of the car. She eventually lay down on the floor of the car.

He thought she had fallen asleep, Deal said.

His brother was on scene too - I wonder if the house has a ring doorbell or cameras?

Nevada has a law, NRS 202.575, stating it's unlawful to leave a child in a car with the motor running but it's only a misdemeanor. It also allows for LE or any person to "use any reasonable means necessary to protect the child and to remove the child from the motor vehicle."
https://www.kidsandcars.org/wp-content/uploads/2014/08/nevada-state-law.pdf

I'm still not clear on the circumstances. Deal hadn't fastened Sayah into her car seat and she was roaming around the car - while the motor was running - and eventually lying down on the car floor.

So does that mean he intended to let Sayah move about alone in a car with the motor running? IMO that overshadows the whole accidentally locking himself out. Who the hell does that with a 1-year-old under any circumstance??

Also, is the girlfriend he argued with also Sayah's mother? Why did he need to ask police officers for their cellphone? Argh!!

3 online fundraisers have already been set up, including two by paternal relatives. The totals (25k) buy an awful lot of car windows...

In Tennessee there's a Good Samaritan law that allows anyone to break a car window in order to rescue a child inside with no legal repercussions. Does Nevada have such a law? And if not why not?

Any father whose priority is a stupid car window and who lets his child roast inside is NOT a loving father. MOO.

ETA: According to a report from CCDFS, Child Protective Services received five reports of abuse regarding the family of the toddler dating back to 2018. CPS received three allegations of neglect in July and September 2018, one allegation in Jan. 2019 and a final allegation of abuse in June 2020.

CPS said all allegations were found to be unsubstantiated, according to the report. The report does not detail the allegations.
Family of toddler found dead in hot car investigated for abuse allegations multiple times

Something stinks...
Well, there you go. Child services. What can I say without being banned for life?

Well, there you go. Child services. What can I say without being banned for life?
  • Clark County Department of Family Services was called several times in the last 2 years to investigate allegations of possible abuse at the toddler's family homes
  • A newly released Department of Family Services report reveals the CPS received five reports of abuse between July 17 2018 and June 16 2020
  • It also reveals the mom of Deal's two sons filed a suit asking for sole custody of their children and to deny him visiting rights citing domestic violence
  • Deal posted $20,000 bail Thursday before his first court hearing
Deal shared custody of Sayah with the toddler's mom Mariah Coleman and it is not clear in the report which parent's home was investigated in each of the five instances, reported the Las Vegas Review Journal.

Social services received FIVE complaints of child abuse for family of girl, 1, who died in a hot car | Daily Mail Online

The article has a picture of the car - a Nissan. In October 2018 a woman who has two sons with Deal filed a lawsuit asking for sole custody of them and that Deal be denied visitation. The suit was filed a month after abuse complaints. The woman refers to domestic violence, ' harassment' and the involvement of child protection services.

Deal was at his girlfriend's and not Sayah's mother's house. Beyond the alleged "30 minutes" before police showed up Sayah was in the car for about an hour, so 1.5 hours at least.

What moron leaves a toddler alone in a car, unrestrained, with the engine running?? And in the Nevada sun no less. SMDH.

And this is the result of Police taking a step back because of all the backlash they get for stepping in. Had they broken the window, they'd be sued for damages when nothing was wrong and child lived. There are no winners now.. oh wait, yes the 🤬🤬🤬's for thousands for the 'family'. THAT should be illegal.

When my son was a toddler He was locked in my car accidentally when I closed the door to run back into the house. It locked with the keys in the ignition. Running. He was strapped into his car seat. I freaked. I called a locksmith who was there within 5 minutes. He wouldn’t accept pay. There are many locksmiths that have that policy when a child is locked in a car.

The whole scenario is hinky. The reports say rigor mortis had set in. Hmm. I see it can set in faster in heat. But still. In this link an example is used of a child (Cooper Harris) left in a car seat and rigor mortis timeline was used to calculate time of death.

Father charged in child’s death posts bail, will remain on house arrest

27-year-old Sidney Deal posted a bail of 20,000 dollars and will remain on house arrest.

The judge warned him about the consequences of breaking his house arrest agreement. ”Sir, you need to stay out of trouble during this time when you’re out of custody. I promise you any reports from house arrest or anything is going to wind you back in custody.”
He should not be out of jail. Why was bail set so low?

Everything about this story is so wrong that I can’t even wrap my brain around it.

That is the value that little girl has to society. That is the only reason I can see.

And, I agree, none of this makes sense. The timeline is off. The story has a lot of holes.

IF mom is actually saying she last saw her daughter hours before she died then someone is lying about the timeline.

IMHO, he was at his "girlfriend's house", had an argument with his "girlfriend". I don't believe the girlfriend and Sayah's mom are the same person. I think mom saw the baby earlier in the day.

I would like to know more about the argument with the girlfriend. I wonder if Sayah got in the middle of the argument somehow and was harmed. They cooked up this story about the car, and they set in to motion a situation where they had "witnesses" to her death. I too am questioning the timeline. I really want to know if there were other injuries found during the autopsy. I want to know what the girlfriend has to say about that day. There is MORE to this story. IMVHO

Don't even get me started on his d@mn mother! Race has nothing to do with this baby's death. Her son WAS/IS irresponsible and directly responsible for the death of her grandbaby. NOTHING would have stopped me from getting my child out of a running car. NOTHING! His mother kept saying he honestly "believed" that the A/C was on. I think by the wording, once they gained access, the A/C probably wasn't on. I don't care how she raised him, he IS an adult and he IS solely responsible for his actions that day.

Also, even though the car wasn't in a garage, would there be any carbon-monoxide that would get in if the car ran for that long?? Just a question...

If the car was outside and I believe it was - and there was no issue with the exhaust system, I believe it would not cause a problem - upthread I mentioned I have taken many 3-4 hour trips with the AC running and no one died. I think she was in the car a good bit before the call to the insurance company by the girlfriend - my guess is this may have taken place over 2-3 hours. I would like to know if the car was running when LE arrived. and did the windows feel cool to the touch?

When my son was 2 1/2, I somehow managed to lock him inside. In our carport. In the spring. We were living with my parents at the time. I ran into the house, telling my dad to unlock the shop, hurry, I need a hammer!!! He comes tearing out of the house and says, "Wait ... slow down ... he's in the shade and it's like 60 degrees."

He then proceeds to ask my kiddo if he can reach the door lock. Sure enough, kiddo giggles and reaches over and pops the lock.

While his idiot mother is holding a sledge hammer, lol.

My point ... when you WANT to get your child out, you'll get your child out no matter what it takes. And if that sweet little girl was "walking around inside the car,' she could have easily popped the lock. Kids are smart.

This dad doesn't pass the smell test.

What I don't like about these "hot car deaths" is the appearance of a "racial bias" or "double standard".

Because, if this man is charged, and given a sentence, some day, someone will bring this up, completely out of context, and make an "issue" out of it. In comparison to this case,
NY - Phoenix & Luna Rodriguez, 1, twins, die in hot car, Bronx, 26 July 2019 *Arrest*

This father did not receive any jail time.

The reason I bring this up, is to illustrate that this type of situation should not be left up to discretion of District Attorney. There should be minimum sentence requirements. You kill your child in a hot car, go directly to jail.

That way, there is no appearance of "bias".

Granted, there are many of these "Hot Car" deaths to discuss, and the sentences are all over the map. There is no consistency. Which is why, it can be perceived as a "bias" issue, either race, gender, or socio economic status.

Driving down the highway with the AC on is no problem. There can be a problem however, if the car is idling and the AC is on. With Covid19 restrictions, I had to wait outside in the parking lot of my physician until I received a call to come in for my appointment. It was 90 degrees outside so I had the car running with the AC on. At exactly an hour, my car engine turned off along with the AC. Found out it is programmed to do this. Don't know if his car is the same.
