Late Tuesday, David E. Patton, executive director of the Federal Defenders of New York, filed a response to the complaints asking for a hearing Wednesday so that Rahami could be informed of the charges and gain access to legal representation.

Rahami was “held on extremely state charge in New Jersey for over 36 hours without the benefit of counsel,” Patton wrote in the filing. In that time, Patton said federal law enforcement agents have questioned Rahami, who was shot multiple times during his gun battle with police Monday morning.

Patton asked a magistrate judge in New York to schedule a hearing as soon as possible on Wednesday, noting that if Rahami is unable to head into Manhattan due to his injuries, attorneys from his non-profit legal group could head to his hospital room and represent him in a video conference.

The gun that was found on Rahami after his shootout was a 9mm Glock he bought in July while in Virginia.

It was not immediately clear why Rahami traveled to Virginia or his ties to the state. Police stopped a car Sunday night in New Jersey they said had been at a location associated with Rahami; that two of the five people in the car were from Virginia.

A Superior Court judge has granted temporary sole legal custody of Rahami's daughter to the girl's mother.

The judge also suspended Rahami's parenting time with the girl and ordered that he not contact the child, pending an emergent hearing Sept. 27 in Family Court in Middlesex County, where the mother resides.

Barnes denied the request to change the girl's name, saying the claims about the harm to the child are not emergent or irreparable. Barnes said the mother could make a further application for a name change.

Barnes also rejected the mother's request to get a court order for counseling for the girl, saying "the court does not have the power to provide this service." The judge recommended that the mother act on her own to get the service for the girl.

Barnes refused the mother's request for a court order prohibiting members of the press from contacting her or her daughter. Barnes said he did not have the authority to issue such an order.

This conversation comes up after every one! IMO, it is a unrealsitc expectation that we have the resources to do this. My guess would be if we were not spending 9.6 trillion a day to build bombs and stuff , we might have some money to staff intlegence stuff.

It. is. not . gonna. happen.

And if we wanted Americans to not be killed our buck would be better spent on "tracking: mass shooters than a couple of terrosits . That just numbers.
