Found Deceased NY - Avonte Oquendo, 14, Long Island City, 4 Oct 2013

Serious question:

Would school officials be in more trouble for a missing child, or a dead child? Reason I'm wondering, if they could be charged with something like manslaughter (don't know that they can!), and one of the school personnel found him, would they report it? Or let it go on as a missing child?

I am seriously afraid that bringing up the lawsuit issue NOW will only hinder communications between the parents and the school. Again, jmo, but wrong timing!!!

And yes I read the post about the statue of limitations, however, I'm almost positive you have more than a week to file! Come on!! That makes no sense to me at all, and the focus should be on finding Avonte!

I have to agree with you here!
It makes money the main focus not the child!

Was he attending a reg Public school or a special school?

Having a special needs child myself who is in a self-contained classroom, I can see the parent's wish to pursue a lawsuit at this time. Public sympathy is with her now, the length of time he is missing is obvious.

I seriously doubt this is about money at all but more about fixing the system. This child should not have had the ability to run. Unfortunately, school systems can be stubborn when it comes to spending money and there is nothing like a big lawsuit to get them to strengthen their policies on safety.

I am riding Metro North from CT to NYC right now, and 2 MTA cops were waiting at my stop. This isn't confirmed, but people are saying they are searching for Avonte. I will ask the conductor when he comes by.

Thanks for being "feet on the ground" for those of us too far away to look/search, Masterj...

There is a difference between physical ad chemical restraints, and a locked, secured facility. Mental health facilities/units and dementia/alzheimer's units are locked in VA. Just fyi

Morning Cat!

Im not saying she shouldn't But they made it sound like going after big bucks
was important. Which to me just didn't sound right when we have a child missing. Stress child not lawsuit!

How about monitoring bracelets for these at risk kids?

How do they keep him from running away when he is at home?

Did this school have their kids wear ID's?

  • #271
They have cameras on trains Id think if he was riding them they would know!

Have there been any updates on Avonte? Have they found him? I pray they find him today.

Suing is also a way to get legal access to much needed video surveillance. There's a case in GA of a young man that died in the school gym. (Kendrick Johnson) The only way the parents can get access to the surveillance video from the gym is by suing. The school says they can't just hand it over because of privacy of the other students. SMH, I'm just sick over this. I can't sleep, thinking about this helpless child out on the street alone. :please:

How do they keep him from running away when he is at home?

My grandson is autistic and his Mom keeps him from sneaking out by using an extra lock, high up on the door, that he can't reach. Not even by pushing a chair up against the door. Eventually he will get tall enough and she will have to use a special key lock. Like the keypad on the newer cars.

I'm not sure if this was already posted, but all MTA track work has been suspended and employees are searching instead of fixing. Media interest is still very high. I see his face on posters all over Queens and on subway stops. IMO and that of my DH who used to teach autistic children, it is unlikely he hasn't been seen by someone. Typically non verbal means he doesn't use his words, but can tell, scream, and uses physical aggression. Not being able to feed himself most likely means his motor skills are poor and cannot use a fork, knife, etc.

Regarding locking of doors... Schools are neither prisons nor psych wards. Locked doors are not the answer as people have stated previously.

About a year ago a five year old escaped the caf and ran home. His parents sued immediately. It was later reported his parents told him to run in order to sue and get money.

CLEARLY no one told Avonte to run. But his parents knew he had inclinations to. The lawsuit should focus on special education staffing for students with disabilities who run. Blaming people right now helps no one because investigations have not been completed.

I find this very odd also! Cameras on trains, security cameras in the area, etc. we have heard nothing about cameras. Is LE going to area businesses and asking to view their footage? With Mickey shunick, they had surveillance footage from various businesses. Has LE held a press conference lately?
I am impressed by the subway/train workers looking, and the brother's persistence in organizing searches. From media, it seems like the city is mobilized and keeping their eyes open, which is wonderful. If there is any video of him they need to release it because I am sure hundreds of people would head to that area to scour it.

Maybe he'll show up at the parade or his new or old school again.Somewhere he is familiar with.
