Defendant’s alibi takes a beating at Novack murder trial

WHITE PLAINS, N.Y. -- It was one of those “gotcha” moments that prosecutors savor: the moment that they catch a witness in a lie.

After spending three days insisting that he had nothing to do with the plot to kill Ben and Bernice Novack, Cristobal Veliz got caught — in vivid color, on video.

There he was, withdrawing $200 at 6:18 a.m. from an ATM machine in Jessup, Maryland. It was on July 9, 2009, three days before Ben Novack was found bludgeoned to death in a Westchester County, N.Y. hotel. ...........

The video seemed to blow up Veliz’s alibi, and his claims, that he wasn’t involved in the trip from Miami to New York to kill Ben Novack.

Confronted with the video, Veliz promptly told Dember: “That’s not my car.”

Narcy Novack threatens her own lawyer

.........During her nine-week murder trial, she was admonished by the judge for her outbursts and placed under a gag order for giving telephone interviews from jail.

And now, according to the U.S. Marshals, Novack has even threatened the person who has stuck by her through three years of unpredictable and often volatile behavior. Her own lawyer.........

At the end of the court day Thursday, as Novack was within earshot of the marshals, she allegedly made a threatening remark about Tanner. It’s not clear what she said or whether the judge was informed of the threat.

Tanner, who grew up in Miami Beach, continued his defense Friday, after announcing that his client had decided not to take the witness stand.

His case concluded, and closing arguments could come as early as Monday. The case could go to the jury by Wednesday.

And now the verdict is in: Narcy Novack and her brother Cristobal Veliz were found guilty of at least two counts of murder and racketeering in connection with the grisly 2009 murders of her husband, Ben Novack Jr., and his mother, Bernice Novack, heirs to the Fontainebleau hotel fortune.
