GUILTY NY - Garnett Spears, 5, dies of salt poisoning, Chestnut Ridge, 23 Jan 2014

I always suspected that the internet searches for "dangers of high sodium" by Lacey on her phone and computer occurred DURING Garnett's hospitalization. I figured they could be "explained away" by defense attorneys as a frightened mother who was looking up more information about her child's condition.

But no-- this article today makes it clear that the searches about the dangers of high sodium and hypernatremia occurred the week BEFORE Garnett's crisis and seizures, which lead to his last admission.

The records show Spears also researched "dangers of high sodium" and hypernatremia (high levels of sodium in the blood) several days before Garnett was admitted to Nyack Hospital with seizures Jan. 17. Prosecutors said in court papers earlier this month the search results "clearly indicated that permanent brain damage or death could result from hypernatremia."

And the "Blake" Lacey fabricated as her soul mate and father of Garnett does indeed exist:

A few days earlier, that same iPhone had been used to search for "Blake Robinson," the man Spears had told people was her fiance and her son's father who died in a car crash a few years earlier. But reached Friday, Robinson — who is very much alive — told The Journal News he "has nothing to do with her."

"My mind was blown away when I heard about it," Robinson said. "I wouldn't even consider us friends."

Blake Robinson, who lives in Alabama — where Spears is originally from — said he only recently heard of Spears' claim that he was Garnett's father when he was contacted by a police investigator on the case. Spears, through her blog and social media posts, had identified Blake to friends, acquaintances and even total strangers as a police officer who was her soul mate and had always been there for her.

Robinson, who works in law enforcement but did not want to publicly disclose his job title, said he never suspected Spears' interest in him and can only guess why she was fixated on him.

"I'm not a doctor; I can only assume she had a fetish for authority," he said.

Robinson, who would only say he is in his late 20s, said he met Spears through mutual friends years earlier, shortly after high school. They hung out together twice, he said, declining to go into detail about the nature of their interaction except to say the relationship did not develop further.

What time will the trial start tomorrow morning? I want to "be there" with the rest of you! TIA

Lacey Spears is a selfish and cruel woman. Oh, how could she? Well, she will be getting all the attention she could want for the next two weeks or so. I feel sorry for the jury -- the day-by-day STS things that little boy endured will cause them to lose sleep, I feel sure. Does anyone know any stats on the jury?

(I'm not asking much, eh?!)

I'm assuming 9am Eastern. These posts address the jurors' and alternates' stats (but not completely, as selection occurred over separate days :blushing: )

Hopefully another WSer will chime in with confirmation on when Court will start (weather permitting, that is)

8 jurors have been selected thus far. Opening statements are set for Monday.

No mention of alternates selected, but they must have some. I can't imagine they wouldn't.

If I did the math right, there will be 7 men and 5 women on the jury.

Opening arguments begin Monday.

Here's a run down of the tweets via Lee Higgins (in reverse chronological order). Based on their context, it sounds like they have a fully seated jury with alternates.

Twitter adjusted the timestamps to the viewer (me, in California):

Also from this article: "She lied and I have nothing to do with it," Robinson said. "I have nothing to do with her. I have nothing to do with the case." Paternity tests have been done that show another man, Chris Hill, who lives in Georgia, is Garnett's father.

Lacey Spears a 'calculated child killer,' prosecutor says

Minutes before the jury filed into a White Plains courtroom for opening statements in her much-anticipated trial on charges of killing her 5-year-old son, Lacey Spears broke down.

Tears streamed down so fast from the 27-year-old Chestnut Ridge woman's face that she had to remove her glasses to wipe them. Sounds of quiet sobs filled the courtroom while a defense lawyer stood to fetch two packets of tissues that Spears would use just a few minutes later as prosecutors opened their case by describing her as a "calculated child killer."

"She is no longer the mother of Garnett Spears because she murdered him," she said Westchester County Assistant District Attorney Doreen Lloyd..

More than 35 people were in the courtroom for opening statements, including Spears' father and sister.

Lloyd told jurors they would see hospital video showing mother and son twice going into the bathroom and then see Garnett become ill soon afterward both times. He died of high sodium levels that caused swelling of the brain.

But the bathroom is out of the range of the camera, and Riebling noted that no one saw Spears feed her son salt.

He said, in context, Spears' actions show a caring mother.

He implored the jurors to "set aside emotion."

Riebling also appeared to blame the hospital, near the Spearses' Chestnut Ridge home, noting it was only there that a high sodium level was detected.

He said the prosecution case was "riddled with reasonable doubt."

Defense opening statement. 32:36

KZ notes: (I took a few notes, and hopefully got dates and times right, but apologies for any errors)

Stephen Riebling did the opening for the defense. I think he did a pretty good job. He talked to the jury a lot about their emotional reactions, and personified Garnett for the jury. Painted a picture of Lacey as a doting and attentive mother. Poked holes in the "direct evidence" but didn't mention circumstantial evidence. (So he's trying to confuse jury with no direct evidence, even as there was a video camera-- which I'll get to.) Over and over he distinguishes between the events at the hospital Jan 17-21 as being the "crime days", and basically tells the jury to just forget all about that pesky feeding tube bag with the massive salt content that was in Lacey's living room, that she tells the neighbor to dispose of. Attorney is trying to minimize that feeding tube bag as irrelevant to whatever happened in the hospitalization. Spends a lot of time emphasizing that the hospitalization is the source of the charges for which Lacey is being tried, not the feeding bag at home.

ADA Doreen Lloyd is attentive to Reibling's opening, and goes "wide eyed/ eyebrows raised" at some of Riebling's statements, frowns some, and writes notes occasionally. ADA's Murphy and Hatfield barely look up during Riebling's opening. Murphy writes a lot.

We learn Garnett's Na+ was 138 in ER on admission. (KZ note-normal venous blood Na+ is 135-145 mEq/l)

At 7 min or so into the video, he "goes there" by suggesting that the Nyack hospital is responsible for either causing, or not discovering why, GS's symptoms worsen. (Yup, I called that-- he blames the hospital & staff, not Lacey.) Emphasizes over and over that "they" were responsible for him, 24/7.

At about 19 min into the opening, we find out the reason the prosecution has Lacey on videocamera is because Garnett was receiving a VIDEO + EEG test as a result of his admission for R/O seizures. He's wearing an EEG cap, and the video camera is set up in the room to record everything. So, the video camera was not concealed, and she and GS were not in a "child abuse" videocamera room. Atty Riebling reveals that there is more than 30 hours of video. And KZ note about that-- we all wondered why no one was alarmed that they had her TWICE on the video camera going into the bathroom, then he had symptoms shortly after. My working theory is that the camera was just recording and recording for those 30 hours-- and not until AFTER his death did anyone review it. So that now maybe makes sense why no staff intervened.

Jan 19, GS awakens very early with diarrhea, soils bedding and clothing. Lacey changes him & cleans up without calling for help. Takes him to bathroom many times that day. Defense says Garnett asks to be taken to bathroom, as seen on tape. Much diarrhea. Late morning lab draw- Na+ is WNL. (within normal limits)

At some point on the 20th, he is unresponsive. Pedes hospital called in, and he's moved to PICU. Tubed and vented.

Less than 24 hours later, he is extubated (breathing tube removed) and he is alert and oriented. Talking appropriately. Neuro intact.

On 21 Jan, blood drawn just before 7 a.m. Na+ WNL.

By 7:15 he has coded, pupils blown.

Discharge/ death summary lists diagnosis/ cause of death as "undetermined."

Key points from the prosecutor:

•Only explanation for Garnett Spears' death is deliberate salt poisoning by his mother
•Lacey Spears researched dangers of high sodium and tried covering her tracks by asking a friend to discard feeding bag that tested positive for elevated levels of salt.

Key points from the defense:

•No one saw Lacey Spears poison her son
•No evidence "that legitimately answers why" Spears would have killed Garnett

Kevin McSherry, the doctor, said Spears told him that Garnett was hospitalized at 10 weeks of age with a sodium level of 200. McSherry testified, "I did not believe that," noting that such a high level is incompatible with life. Garnett, he recalls, was quiet, alert and awake. McSherry will continue testifying when the trial resumes at 2 p.m. Wednesday. The trial is expected to last three weeks.

More likely, she didn't vaccinate because she wanted to leave him vulnerable to disease.

Or it was just too much trouble.....or something. She moved around so much, yet she must have at least had a few "new patient" appointments for Garnett as she moved around. Or maybe she bought his tube feed bags and supplies off the internet, or a support group on the web that trades medical equipment. Would be interesting to see what is documented in Garnett's medical records from all over-- AL to FL to NY.

But yeah-- the "I'm a Mormon and don't vaccinate" is a whole new lie for us to hear about.

Off topic-- do Mormons shun vaccinations? Anyone know? IDK-- never heard that before. Is it a Lacey Lie, or is there a kernel of truth there? (Though I never read anywhere that she was or claimed to be Mormon till she told this to the ER nurse.)

Two of the Mormon families I know vaccinate, so this is a lie.

Well, I don't know if you have to have a subscription to LoHud, or what, but there is only 2-3 min of the prosecution opening on each of the 3 parts.

But I did glean another few bits of info from those clips.

During or right after the code, the doc in the room saw a water bottle (store type brand, not a re-usable) 3/4 of the way empty near the cot Lacey had been sleeping on. He ordered the water bottle to be seized at that point. ADA Lloyd didn't say any more about the water bottle on the video clip, but I'm guessing it's pretty significant for her to be focusing on it in opening statements. My guess is it was full of highly concentrated salt water. Garnett coded just about an hour after the family doc came in and told Lacey that Garnett was doing very well and would be discharged home in the morning, and that the tests had shown no seizure activity.

The other detail from ADA Lloyd's comments is that in the last bathroom visit an hour before he coded, Garnett was well enough that he skipped to the bathroom and grabbed a cookie on the way in. (Ok, that was very difficult to hear. Break my heart.) Lacey comes out of the bathroom without Garnett, goes to her belongings/ suitcase, and is on video returning into the bathroom with a cup, and the connector apparatus for Garnett's g-tube. He was unresponsive, and coded shortly after that bathroom visit.

Right after he coded, and was stabilized with a breathing tube, they took him right to radiology to do a CT of his brain. He had indeed herniated from acute brain swelling, which was suspected from his fully dilated "blown" pupils noted when the code began. (KZ note: "herniated" means the brain was so swollen, brain tissue pushes down and bulges through the only opening available, the foramen magnum-- the large hole in the base of the skull where the cervical neck bones join. This is not compatible with life, even though Garnett's heart was still beating at that point. Circulation to the brain is cut off, and the brain dies.) The doc takes Lacey into a conference room, and tells her the only way Garnett's sodium could get so high so fast is if someone put a massive amount of salt into his g-tube. He tells Lacey he's calling the police and child protective services. Right around that time is when Lacey called her friend to dispose of the feeding tube bag hanging in the living room. (It must have been hanging there a few days, since Garnett had been admitted in the hospital about 4-5 days at that point.)

****
I really would love to listen to the whole 90 min prosecution opening statement. If anyone finds out how or where to watch it, please post link or details. (I haven't found it on youtube.) It appears that the whole defense OS is posted.
