Today was the first day I was able to attend......and SO glad I did! As some of you know, I've experienced the MSBP, now called what it should ALWAYS have been, medical child abuse, up close & personal. Professionally, IMHO there is NO reason for this child's death within the realm of clinical medicine & personally, this child experienced the utmost torture all while he was trying so hard to keep his "Mommy" pleased with him. The video was heart-wrenching and so told those last minutes.

Now the egg donor/incubator spent the court day with the "weepies" & sniffles, dramatic & clinging to ANYBODY available (funny tho, the female guards weren't accommodating!). She did try to engage the jury but......they were having none of that!

I believe that the jury WILL convict her & I also believe that she is sorry............................................that she got caught! Unfortunately, I can't attend tomorrow but in my heart of hearts there is NO way the defense managed to convey that Nyack Hospital staff are at fault!

Thanks and thanks again, KZ, for all you have done during this sad, sad case. The lohud articles and other links were very valuable to me since I could not be in that courtroom. And thanks for your thanks to the reporters, too -- they were very helpful with almost minute-to-minute coverage.

Another subject:
I have seen a couple of other trials where the defense did not put on a CIC. They were both in NC, and they were 1st Degree Murder cases. The defense decided not to put on a case for various reasons.

NC Statutes say that in all Superior Court trials, the defense will present its closing argument first, and the People (the prosecution, of course) will have the benefit of giving the closing statements last unless the defense does not put on a CIC -- in that case, the defense will have the benefit of giving the final closing statement. Then comes the jury instructions from the judge, then the jury retires to decide the verdict.

That arrangement does not appear the case here, however. Maybe we'll find out the why's after this is all over.

Hard to keep up today, but did pretty well, thanks to mobile internet, and my trusty all-knowing smartphone.

I'm relieved this is in the hands of the jury. I spoke to my sister, an experienced trial attorney, about the lack of case in chief by the defense. She says this is a good strategy from time to time, and she used it herself a few times. She says the strategy is to poke holes in the prosecution case in chief, and just let "reasonable doubt" drift around in the courtroom. And reiterated several times that it is the job of the prosecution to prove their charges beyond a reasonable doubt-- NOT the defense's job to disprove the charges. But she also shared that she thinks this defendant is guilty, and will be easily convicted. She strongly approved of the judge's decision not to livestream the trial testimony, and not to make it into a big circus, which could negatively affect the jury's perception. FWIW.

Here is the lohud article from this eve, with several snippets of closing arguments. Sadly, the "entire" closing arguments aren't available here, and I haven't had time to scour the internet to see if any other news outlet has posted them.

I'll also share that I just about lost it when I saw Garnett interacting with the nurse, who was changing the IV bag. He was so adorable, eager, interactive, up on his knees, and looking so vigorous and healthy. I just want to scoop him up out of that video and take him far away. Prosecutor Murphy is so right-- he just shouldn't be dead. I am just very, very sad about that, and mad.

We are officially in "verdict watch". The case went to the jury yesterday for a bit, and deliberations have resumed today.

Maybe Harmony2 would be willing to put "verdict watch" on our thread heading? Since the case received some national publicity yesterday, I'm thinking the verdict may be announced and covered by national media as well.

Jurors in the Lacey Spears murder case deliberated for roughly a half-hour Thursday and resumed deliberations Friday morning.

Jurors have resumed deliberating Friday in the trial of Lacey Spears, the Chestnut Ridge woman accused of poisoning her 5-year-old son Garnett to death with salt through his feeding tube and chronicling his final days over Facebook.

Shortly after they started deliberating, jurors gave two notes to Judge Robert Neary, asking to review records. They asked to see lab results at Nyack Hospital, where Garnett's sodium level spiked, a chart by a toxicologist showing salinity levels in feeding bags seized by investigators and videos from an EEG showing Lacey Spears before she took Garnett into a bathroom at Nyack Hospital. Prosecutors alleged that Spears poisoned the boy during those bathroom trips.

Jurors also asked for an explainer of the elements of the crimes with which Spears is charged: second-degree murder and first-degree manslaughter.

I have been following Garnett's story for awhile now and I'm just so sad for him. I'm worried that the jury is taking too long, and that Lacey will be acquitted. I really hope Garnett gets justice on Monday. I worry that if Lacey is allowed to go free, or is released from prison while still able to have children, that she will do this exact same thing again to her next kid.

Okay, without me, DH went BACK to court (ran into some "buds" yesterday & believe me, LE is all over supporting Garnett!) & said that Lacey was all "confused" that the Judge would cover this information AGAIN for the jury (like, "this is so piddlingly unimportant!"), she even got ANGRYISH & tried to engage her dreamy lawyer (yeah, DH claimed she was "simpering" & probably would have pulled "the vapors") 'cept he was intent on the Judge & jury reactions. Jury reactions: the "gang of LEOs (retired mostly!)" claimed to see a few nods of agreement over the definition of "DEPRAVED INDIFFERENCE".

Depending on the weather....................HE & possibly me WILL return!


PS: from "insider sources".......good ole "mother of the year" had many demands regarding the organ donations.....issues that are NEVER permitted like meeting the patients BEFORE donation, providing "guidance" to the new "owners". Heck, one HCP thought she was going to demand to choose the candidates! :scared:

I didn't think it was possible to be more disgusted with this :censored: defendant.

I was wrong. She literally makes me :sick: : sicker than I ever thought was possible!

Darling Garnett was nothing more than an avenue for her to control situations for her benefit, and realign the universe so she's the center of it all ( in her own twisted mind, and in her online world). :cow:

I can NOT understand how one so-called human being and poor excuse for a mother could have actually given birth to such a precious, beautiful and loving child. The irony, the dichotomy is so striking, so heartbreaking, it makes the loss of Garnett hurt even more to me.

She played her games so well, he wasn't able to be saved. This was criminal. This was more than murder. There are no words for what was done to Garnett. The betrayal will stay with me forever. :tears:

I've said this before: LS will pay for her crimes, and pay dearly, regardless of what this jury decides. My faith allows me to believe that her fate is sealed, and I do not have one shred of sympathy for her.

She had none for Garnett. Her actions have proven, time and again, she cares only for herself.

Today is the 20th anniversary of my Father's passing. My heart has been heavy all day, filled with so many thoughts and worries. I will keep a candle lit for Garnett all weekend., and hope the jury will return a guilty verdict on Monday. :please:

I am so glad to hear about the LE presence in the courtroom, and have some comfort from hearing that-- I had been thinking only about family and close friends who might attend. Lacey's sister and father have been sitting on "her" side of the courtroom.

I had imagined that spectators and reporters only sat on Garnett's side once Lacey's side was filled up, so I'm especially glad there are people there "just" for Garnett (regardless of where the open seats are). I admit that I overlooked that LEOs might also have some strong feelings about what was done to this little boy, and would come out for him in a show of support. I'm just so glad there is a presence for him in that courtroom. I have been imagining he was all alone in that courtroom, with just the prosecutors to represent him, and I was very sad about that.

I don't doubt your insider info about the donation process is true. Gives me a very sick feeling, like putting organs up on eBay or something. Parting out and haggling over this sweet little boy like he was a collection of used car parts. :mad:

I think the jury is haggling over manslaughter vs 2nd degree. Asking about that definition (depraved indifference) doesn't make me think they are thinking about acquitting. I hope we get a verdict Monday, after they have had a chance to decompress and think things over more thoroughly.
