GUILTY NY - Garnett Spears, 5, dies of salt poisoning, Chestnut Ridge, 23 Jan 2014

I'm so relieved. So glad the jury got it right.

Every one of these medical abuse cases that is successfully convicted, builds the "best strategies" for prosecution. Hopefully we will start successfully prosecuting more of these cases BEFORE the child dies.

Candy Fluty (West Virginia- child in hospital in Ohio) and Kate Parker (Oregon) are on my radar to watch. Laurie Williamson (Texas) was convicted. Their kids are all still alive, thankfully, and are doing well now that they are away from their abusers.

Lee Higgins' tweets say Riebling (Lacey's attorney) say she's shocked. And planning on appealing.

Shocked? Really? Her attorney didn't even call any witnesses, and she's "shocked" she was convicted? You'd think she would have seen that coming, and her attorneys would have prepared her for that. (But maybe those comments are just the standard comments delivered to the media by attorneys of the convicted.)

My guess is there will be an inadequate counsel appeal.
You know this morning I was going on youtube to find channels to watch the JA verdict and I came across some horrible videos on the deaths of children who were abused.
It was horrible and heart breaking. When I think of this case, I don't see it any different than if she had beat him and then he died. She planned and plotted the abuse. She thought about how it would benefit herself while hurting the child.
Im glad they got her.

Shocked because don't ya know- she's mother of the year! She flavored his tube feedings with only the best- Himalayan salt so he could taste it, NOT!!! This monster has been torturing him since he was a baby with his tube feedings, she's just lucky he didn't die when he was 10 weeks old when she tried it then!!!:banghead::banghead::banghead::jail::jail::jail:

A M E N ! Yes, she was SHOCKED @ the verdict! DH stated that her family (Dad & sister) turned NASTY to EVERYBODY after collapsing into each others arms & sobbing. (or as he stated, another case of "special people" looking for "special attention"). The state is going to request/demand/emphasize that the convict needs to spend LIFE in prison as this was a protracted, premeditated crime against a child. General courtroom attitude: well deserved verdict and those 3 (THREE!) readings of the depraved indifference demonstrated that it was a well thought out, well discussed verdict.

And.....many LE will be "pulling strings" to be there for Garnett on April 8th!

K_Z, thanks for the links. The list one, written by a Texas prosecutor, is riveting. He details the work that went into developing medical child abuse charges because there was no direct evidence against the mother.

Because she knows. She knows she's guilty.

I teared up this morning reading the verdict. I wish I could've been with you all as it happened. Too much work for me.

Thank God this monster is experiencing justice for taking her precious child out of this world in such a diabolical manner. I hate her.

joypath- you were in White Plains? I wish I had known. I could have been there with you.

Maybe you two can meet up for sentencing!

In any event, to clarify what she's facing:
The charge was the most serious available to the jury. They also had the option of first-degree manslaughter. Second degree murder carries a minimum penalty of 15 years to life in prison, and a maximum of 25 years to life.A judge set her sentencing for April 8. http://www.lohud.com/story/news/crime/2015/03/02/lacey-spears-trial-deliberations-continue/24251795/

RBBM---

This is amazing! Other posts upthread differed on whether or not Life in Prison might be "on the table" for the sentencing hearing.

I hope the State is able to make this come to fruition. Yes, we have have Justice in Garnett's precious name. I believe absolute justice would be making sure LS remains behind bars beyond childbearing years. 15-25 would not guarantee that. Life in Prison would.

I cannot hide my disgust and hate for her either. I hope with all my heart that she never sees the light of day outside of prison walls again. :please:

ETA: I just saw gitana1's post and 15-life vs 25-life certainly makes me feel somewhat better. I just want her to stay behind bars forever and not procreate and do this again!

We :loveyou: Garnett! :rose:

Minimum 15 to 25 max. Hopefully she will be beyond childbearing age when she gets out!

Actually the minimum is 15 year to life and the maximum is 25 years to life! Remember the word "life" and pray she gets it!!

That is great news! I so very happily stand corrected :)

I was starting to worry when the jury was taking (what seemed to me) so long. I am glad they were just being thorough and thoughtful.

I'm not 'happy' happy about this: But thankful for the jury- who had to hear some horrendous things which will likely haunt them forever.

Rest in PEACE little one.

In retrospect, I think what it means is that if she gets 15 to life, she would be eligible for parole after 15 years but if she gets the max, he wouldn't be eligible until 25 years. So she would continuously apply to the parole board and hope for the best.

Yeah. Looking at that totally beautiful, totally healthy child hours before the final stage of his mother's destruction of him, it's incomprehensible. And there's just this feeling of anguish and desperation to be able to go back in time and fix this. I cant explain. It's too hard to accept really.

Lohud has a new article up, with abut 3-4 short embedded videos: the verdict, district attorney press conference, defense press conference, etc.

http://www.lohud.com/story/news/crime/2015/03/02/lacey-spears-trial-deliberations-continue/24251795/

(Michael Brown is a juror-- not sure if he was the foreman.)

"Nothing was done right away — we had that woman's life in our hands," said Michael Brown of Mount Vernon. "There was a lot of discussion. Nobody came in saying she's guilty... She was innocent to me until the end.

But Brown said he was convinced salt poisoning killed Garnett after hearing the medical examiner testify that was the cause of death.

"The defense was trying to cast innuendo," he said. "It was easy to see through where they were coming from."

Asked if the defense was believable when it implied hospital error or health condition might have killed the boy, Brown replied, "If you're naive, you can believe that."

When jurors were first given the case, they outlined what pieces of evidence they wanted to see again and review before deliberating on a decision, Brown said.

They reviewed a hospital-room-video that showed Garnett appearing healthy before he was taken into the bathroom by his mother, where prosecutors said she poisoned him with salt through his feeding tube. Shortly after emerging, the video showed him retching and sick.

"It's not like there were six people in the room," Brown said. "There were two people in the room."

Jurors talked about how unlikely it would have been for Garnett to voluntarily consume large amounts of salt water.

"The kid couldn't force it himself," Brown said. "Have you ever tried swallowing salt water? You can't swallow it. You spit it out."

"All the evidence was there," Brown said. "She proved it to me. For the whole five weeks, she kept proving it."

Brown said it might have helped Spears if she had testified, considering the amount of evidence pointing to her guilt.

"It helps when somebody stands up and says, 'I didn't do that,'" he said. "I wouldn't leave it to someone else."
