"ALBANY N.Y. — New York's highest court, the Court of Appeals, heard arguments Thursday on whether former Dr. Robert Neulander deserves a new murder trial for the 2012 death of his wife in DeWitt.

The Justices heard arguments from Neulander attorney Alexandra Shapiro and Prosecutor Jim Maxwell, who retired from Onondaga County District Attorney's Office but argued the case on the request of District Attorney Bill Fitzpatrick...

The Justices on the Court of Appeals will eventually decide if Neulander should receive a new murder trial or if he should go back to state prison to finish the sentence imposed after his trial in 2015....

During the hearing Thursday, the discussion and questions from the Justices almost solely focused on Juror 12's conduct. Maxwell appeared to take the brunt of tough questions from several of the Justices..."

"Albany, NY -- A juror’s misconduct in Robert Neulander’s 2015 murder trial could force a do-over without any actual proof of bias in her guilty verdict, the state’s high court suggested Thursday.

Instead, juror Johnna Lorraine’s “fraud, lies and deceit," as Neulander’s lawyer put it, could be so bad that allowing Neulander’s guilty verdict to stand would undermine public confidence in the judicial system.

In other words, it wasn’t Lorraine’s hidden, in-trial texts with friends and family (“Make sure he’s guilty!” her father memorably texted), but the lengths she went to cover it up, that were at the center of Thursday’s debate before the Court of Appeals in Albany.

“It makes very hard for someone on the street to say that you get a fair shake when a juror does this and the courts don’t do anything about it,” Justice Jenny Rivera noted.

On the other hand, none of Lorraine’s texts -- some of which were recovered after she deleted them -- showed any bias that alone would require the verdict to be overturned, the judges agreed. In fact, some of those deleted texts showed that she remained undecided on his guilt during trial and declined to discuss the case when pressed...

Had Lorraine simply told the truth, it’s a very different case. “If it were only the texts, then maybe the verdict (should) stand,” Shapiro said.

The Court of Appeals typically issues decisions within six weeks."

Looks like his hearing was reset for last Friday, 11/22.

Robert Neulander's new trial set for June 2020

Syracuse, N.Y. — Former Dewitt doctor, Robert Neulander, made his first court appearance Friday since his murder conviction was overturned.

Judge Thomas Miller has set a new trial date of June 1, 2020.

They [defense] asked Judge Miller to reduce bail because Neulander needs that money to pay for his retrial.
[.....]
Prosecutors strongly opposed reducing bail and told the judge he is a potential flight risk.
[.....]
Judge Miller said he would not lower bail since higher courts said in their decisions on a new trial that the evidence against Neulander was strong.

Neulander's defense team also asked the judge to allow him to travel out of state for Thanksgiving. Judge Miller said he will consider the request.

6/1/20 Update: A defense witness are more is unavailable, re trial has been moved to 10/13/20.
 
The trial for former Dr. Robert Neulander has been pushed back again, with a new trial date set for October 2021.

The trial was supposed to begin in June 2020 but was initially delayed to February 2021 due to the pandemic. On Wednesday, lawyers met with the judge and a new trial date was set for October 18, 2021.

Neulander has remained free on bail since June 2018.

Six years after first Robert Neulander trial, murder retrial hits yet another snag

Neulander’s lawyers have already signaled that they plan on challenging whether he can get a fair retrial in Syracuse after the highly publicized first trial. The courts have said that lawyers have to attempt to pick a local jury before making an application to have the case moved out of the county. That would delay the retrial far past its planned October start.

If convicted after a retrial, Neulander faces up to 25 years to life in prison on a murder charge.
 
In the article posted above - it said he has a hearing in April.

Prosecutors strongly opposed reducing bail and told the judge he is a potential flight risk. Judge Miller said he would not lower bail since higher courts said in their decisions on a new trial that the evidence against Neulander was strong. 10/13/20 Update: The retrial was originally scheduled to start June 1 of this year. But Neulander’s lawyers won a delay to September to line up new experts. Now, with the entire court system backlogged due to a three-month coronavirus shutdown, the trial has been delayed until Feb. 22, 2021.
10/28/20 Update: The trial was supposed to begin in June 2020 but was initially delayed to February 22, 2021 due to the pandemic. On Wednesday, lawyers met with the judge & a new trial date was set for October 18, 2021.
2/18/21 Update: On Thursday, trial Judge Thomas J. Miller spoke by phone with lawyers over the latest snag: the death of a key prosecution witness from the first trial in March 2015. The witness, Dr. Jan Leestma, of Chicago, died recently said Onondaga County District Attorney William Fitzpatrick. Leestma was key to the DA’s theory that Leslie died a slow death over many hours, not a relatively sudden death after a slip-and-fall in the shower, as her husband has maintained. The judge was asked to consider whether Leestma’s testimony from the first trial could be read to the jury at the retrial. That’s a decision left up to Miller’s discretion, Fitzpatrick said. If not, the DA’s office will likely have to scramble to find another witness who can examine the brain-cell evidence in time for Neulander’s retrial. Neulander’s case will next be due in court in April. If convicted after a retrial, Neulander faces up to 25 years to life in prison on a murder charge.
