The jury that will decide whether Shawn M. Doyle murdered his estranged girlfriend will be allowed to hear evidence that he abused and stalked her, as well as evidence that Doyle abused two previous girlfriends, a judge ruled Monday.

Washington County Judge Philip Berke told Washington County prosecutors they can present evidence that Doyle was violent toward victim Lori Leonard during their relationship and that he stalked her as well.

Berke also ruled that the district attorney's office can present testimony of two prior attacks on ex-girlfriends that led to criminal convictions for Doyle, one in Kingsbury and the other in Fort Edward.

In the most recent case, he duct-taped an ex-girlfriend's mouth closed, duct-taped her hands, and was trying to bind her feet when a relative of hers interrupted the attack. Doyle pleaded guilty to a misdemeanor count of unlawful imprisonment in the July 2000 case.

Police said Leonard was found with her mouth, hands and feet covered with duct tape. Evidence that he attacked another woman in the same manner Leonard was killed is an important part of the prosecution's case.

Berke also ruled that prosecutors can allow the jury to hear about a 1996 incident with another girlfriend, in which he threatened her with scissors, cut her hair and tried to restrain her. He pleaded guilty to misdemeanor menacing in that case.

"There's no question in my mind this does show modus operandi (method of operation)," Berke said of that case.

Washington County First Assistant District Attorney Kevin Kortright also presented the court with sworn affidavits from Leonard's sister, Jennifer, and her friend, Dawn Popluhar, that accused Doyle of roughing up, stalking and threatening Lori Leonard.

In one instance, Jennifer Leonard wrote of being on the phone with her sister when Doyle showed up at Lori Leonard's apartment and began arguing with her. She wrote she heard her sister tell him to get his hands off her. "You have no idea what I'm going to do to you," Jennifer Leonard wrote she heard Doyle tell her sister. Popluhar wrote that Lori Leonard had bruises on her arms and legs after that February 2004 encounter. Berke ruled those allegations could be presented at trial as well, saying the relationship between a victim and the person accused of killing her is clearly admissible. He barred from trial, though, testimony of problems between Doyle and Leonard's friends*******************snip****************************

Does anyone know how many years this creep got in prison? I really wish people of all ages would stop meeting on the internet. A person just has no ideal what they might meet. Everytime I hear that so and so is missing and she met a guy on the internet I can guess the outcome. So many teenage girls have gone missing from meeting creeps on the internet. Maybe those romances work every once in awhile but I just don't think it is worth the risk.
 
He was convicted of second-degree murder earlier this year and sentenced to 25 years to life.

Thanks....I wonder how they determine 1st degree or second degree? I would have thought he would have gotten 1st degree. He stalked her...planned to murder her as he duct taped her up. He received 25 yrs which means he will be out after doing about 15 yrs...just not enough time when you consider that she lost her life and there are two little boys without a mother now :banghead:
