A state appellate court ruling that Katlin Wolfert was responsible for the “severe abuse” of her son, Mason DeCosmo, will not alter Ulster County District Attorney Holley Carnright’s decision that Wolfert should not be charged in her son’s death, the prosecutor said Monday.

Carnright noted the ruling by the Appellate Court of state Supreme Court stemmed from a case in Ulster County Family Court, which “has a different standard” to be met than a case in criminal court. As a result, he said, the appeals court ruling will have no impact “whatsoever” on his prior decision.

Poughkeepsie is my hometown, and my son's grandparents live in the town where this happened. This is heartbreaking and makes me sick. I just cannot understand why someone would put an innocent child through all that suffering. I look at my beautiful 4 year old, close in age to Mason, and I wish I could have taken him to live with me. The only small consolation is that he is no longer in pain.
