His defense could certainly say that if they wanted to stick with the abduction scenario.
However in a trial the jury would be greatly effected by the assertions of investigators that they quickly determined through camera evidence and the statements of the suspect that there had been no white van and no abduction.

After some messages and calls going back and forth between the parents, Frattolin went radio-silent on the mom’s text requesting an update — and within a day, 9-year-old Melina Frattolin would be found dead

Troopers on Tuesday would not say if they believe the child drowned in the same body of water where her body was discovered.

A woman says she saw Luciano F. and his car at the site where the body was found. NewYorkPost -Rebecca Kulickowski, a lifelong resident of Ticonderoga in upstate New York, told News10 that she submitted two police reports after seeing a man she now believes was Frattolin running away from his car on Saturday evening, when Melina Frattolin is thought to have been killed. "“It only caught my eye because as I was driving past the car, I seen a skinny tall guy,” she told news10 “And he was running up a hill that he was parked next to and there was a wooded area on the bottom of it,” she said. Article further states the body was found - The alert was called off when Melina’s body was discovered pinned under a log in Eagle Lake, between Ticonderoga and Schroon Lake, close to where Kulickowski saw the suspicious man. There are private islands on the lake and houses along the shore that should have video recording, cars, headlights.

I suspect there is clear evidence of there being no kidnapper. Surveillance cameras, digital tracking.

If the details in this article are accurate, he’s a life-long grifter that was always one step ahead of his impending doom. It’s a tragedy that little Melina had to suffer at the hands of this idiot.

State police released new information Tuesday evening showing pictures of the car Luciano and Melina were in. They’re looking for anyone who may have seen something more specifically in the area of the I-87 Northway between Exits 28 (North Schroon Lake: US 9, NY 74 to Ticonderoga) through exit 20 (Fort Ann, Queensbury, Lake George, NY 149 & US 9). State Police are searching the path Luciano Frattolin may have taken along the Northway before his daughter was found dead this weekend. State Police are seen on the southbound side of the Northway patrolling a section between exit 28 and exit 27 on Wednesday, July 23, 2025, in Schroon Lake, N.Y. Troopers were looking for clues in the killing of Melina Frattolin and were searching the sides of the Northway today between Exit 20 in Queensbury and Exit 28 near Ticonderoga

Frattolin is set to reappear in court Friday.

Not sure, but if you look at the pics the NYSP put out of the Prius, it looks like he's wearing the Tyvek suit in the driver's seat.
He had to have been wet after leaving the water. Wonder if there is evidence on the floor of his car that matches the crime scene?

If there were signs of a struggle and that she was murdered, I think him being the cause would be clear since her time of death has been determined to be prior to when he reported the false abduction. His report is likely that he was the only one with her up until the time he says she was abducted. That could only mean, he was with her at the time of death and the one responsible for her murder. The "kidnapper" according to his report had not had contact yet at the time of her death according to atopsy.
That is aside from the evidence of his car and him being spotted near where she was found and what I expect will be location tracking through devices that do no match his story.

His car & his phone are both going to prove where he was in the time frame of her death. There will probably be camera footage that shows him & possibly her, in and/or with the car. There is at least one witness who saw him in the area. Melina spoke with her mom on the phone, early that evening. All this will prove what the police already know, there was no kidnapping. Unless he drugged her before drowning her, she would’ve put up a fight for her life. I hope she scratched him like caged cat!

Curious about the autopsy results. I wonder how the ME determined it was drowning by homicide instead of drowning by accident.

Pond vs River and log
She was found in a pond. A pond is still water, not moving water like a river.
Her body was found under a log, not floating or sunk.
No evidence of alligators or other prey mentioned.

How does the body of a 9 year old girl, who drowns passively without assistance from a killer, get under a log in a pond where the water is not moving.

It seems he drowned her and put the log on top of her so she would be concealed. Maybe hit her with something?
Canines
They likely used canines and a piece of her clothing to locate her. She was 9, that could be 65 lbs or so- she probably walked to the location of the pond before he attacked her? Was she asleep and he carried her?

What a horrific betrayal of the love of a father, for the purpose of punishing his ex, or having his daughter forever be his alone- like property.

He either planned it- not well, or reacted to a conversation after she talked to her mom at 6PM. It was 10PM when he called 911, was Melina asleep in the car when he got the idea, changed course and attacked her?

My heart goes out to Melina, for the torture she endured, and for her mom and other family

Wearing a Tyvek suit sounds like premeditated murder to me - not second degree.
