Yes, they can use his statements in trial. I would bet his defense attorney is having fits over the interview. But I also wonder if the attorney may not have a plan for this. I am expecting a mental defense on this one.
He probably told the guy not to give the interview, but didn't say it too strongly. So he is unable to cooperate in his own defense. Now he just has to get a psych to go along with it.
But what I think is so odd, this guy actually thinks people are going to buy that it was Nixmary's fault.
Everything that LE has said happened, he announced in the interview- except for the molestation and how the murder actually occured. But the torture, the previous abuse, the locking her up, the tying her up, the beatings, he just announced to the world.
But the poor wittle coward is getting beat up at the jail, LOL. Don't you feel so sorry for him? Hahahahaha! And those mean old guards are encouraging the others to do it, and taunting him. He's not going to well when he gets to prison.

OK, so now lawmakers are doing something - but instituting harsher penalties for KILLING a child isn't going to help much. Harsher penalties for HURTING a child will, more money for children's programs will, more programs to prevent domestic abuse will, more options and homes for battered women will.

Oh, and I want a law allowing for complete immunity for any woman who kills the man who has beaten her child. Most laws (at least in WI) have it so that a woman can't kill the man and claim self-defense unless he's in the act of trying to kill her or her child. And even then, we may still imprison her if she didn't have to use deadly force to stop the beating. Kinda complicated. But my solution is simple - he ever hits your kid, you can shoot him in his sleep. Let's scare the crap out of these men and make them think twice about it.

I had to see her. I looked.
Her precious little face and her eyes close while she lay there, peacefully in that casket. Never to breathe one more breath of fear, or smell rotten feces in a litter box. Never having to worry about when the next blow will come to her if she does something "wrong" like any child her age might do.
Eating some yogurt is suddenly a capital offense in her home, but no more.
For she is somewhere peaceful now, where she can do and have whatever she wants and be away from the cruel monsters who deprived her of life, love and happiness, of a childhood ... of making "mistakes" - if any at all -and being able to be properly dealt with for them.

I can't help but think she is in a better place now.
But she shouldn't have to be. She should be in a better place
ALIVE somewhere.
In a home where someone could've shown her that a family isn't like that.
That it's ok to have a yogurt. That it's ok to do something a child would do and not get beaten to death for it, or be made to live in deplorable conditions.

Damn her "so-called" parents.

That's a beautiful post. I looked too. I have never seen anyone younger than 15 in a coffin. She looks like an angel . . . so beautiful despite her injuries.

I almost wish that the punishment for the parents would be to cut off any parts of them that abused this little one . . . off with their hands, off with his penis, and I guess you can't chop their brains out but maybe they should get frontal labotomies too. Sorry to be so graphic, but they really need to be punished in the worst possible way. They should have litter boxes instead of toilets in their jail cells. They should be starved for weeks at a time. They should eat cat food. There should be machines that can simulate sexual abuse too and they should be abused the same way that this angel was. I don't like her name . . . it seems to have a meaning . . . like she would be nixed in life. Yes little Mary, enjoy Heaven and we will all be praying for you and your brothers and sisters and all children who are abused.

Trust me, I haven't forgotten him. The sickening thing to me is these "mothers" always end up pulling less time than the monster. I feel they BOTH deserve EQUAL sentences. Which in this case would be the DP. Too bad that can't happen.

Hi Linda . . . good post. This is such a depressing story. I can't understand how so many people came in contact with this little girl and no one helped. I one stopped on the road as I saw a cat that had been hit and I wasn't sure if it was dead. It wasn't. It died in my hands. I put it on the side of the road. I hope the parents never have another good minute in the rest of the lives for they deserve to have the worst of the worst from now on.

I totally agree! Let them sh*t in a litter box, eat cat food, be tied to a chair to sleep in with a pillow on the window sill and a blanket around the shoulders. And yet, it won't happen because that is "cruel and unusual punishment". Something is very wrong with this picture. :banghead:

Bubba will help him feel so much better, comforting him in all, hopefully on a daily basis for the rest of his rotten life. She made me kill her, what a coward, what an evil coward and the mother, I don't you think you can call her that. She's a piece of white trash, just like the stepdad. I would fight to my own death to save my two little boys from anyone trying to hurt them. How she could turn her back on her, you know this little girl was tortured on a daily basis and the mother knew and so did anyone living near her, they surely heard her screams and saw her physical appearance. The mother of the accused was at the gravesite, but the mother of the victim was sitting her sorry azz in jail. Exactly where she needs to be for the rest of her life, as far as I'm concerned.

I do so love the idea that this monstor will never( HOPEFULLY !) walk as a free man on this earth again, that every day for the rest of his greasy life he'll live in fear of bubba making him his "bubbette", that he'll have to eat prison slop- and that he will so crave freedom, good food, a cold beer.. etc.

I agree the mom deserves same treatment , i cant imagine letting my own child be mistreated in such a way, i wouldnt stand by and let a stranger be mistreated let alone my own child- and to ratt that baby out , knowing that he would beat her-- uggg it just makes me feel so ill... I havent been able to eat well this week thinking how much anything i stuck in my mouth this child was so deprived of.

He's so eerily like Joel Steinberg. Steinberg went around blaming Lisa for what happened. Strange he didn't get Bubba in jail, I don't think that this scum will get off as easily.
