"Eric Garner‘s mother was forced to watch the chokehold death of her son in an NYPD courtroom during the killer officer’s administrative trial on Monday. Gwen Carr used a break from the trial to talk to the press about the “tricks” that Daniel Pantaleo‘s lawyers were using.

“The day after Mother’s Day, to have to watch the video that the world saw of my son being killed, to be at this trial after five years, and to see all of the tricks that Pantaleo’s lawyers are trying to pull to avoid accountability, it’s really hard,” Carr said Monday afternoon...."

The testimony came on the first day of Officer Pantaleo’s long-delayed disciplinary trial. Mr. Garner died after officers held him down and handcuffed him on the pavement near the Staten Island Ferry Terminal. ...

On Monday, the supervisor who oversaw the internal review, Deputy Inspector Charles Barton, testified that in 2015 he ordered the lead investigator to recommend disciplinary charges against Officer Pantaleo...."

"NYPD Officer Daniel Pantaleo did use an illegal chokehold on Eric Garner, who died during a confrontation with the officer in 2014, according to a high-ranking NYPD official who testified during the second day of Pantaleo's departmental trial.

"What we see, it meets the definition of a chokehold," Deputy Inspector Richard Dee said Tuesday while answering questions related to the cellphone video that captured Garner's arrest on Staten Island in 2014...

Dee cited cellphone video in which Garner is seen coughing after having Pantaleo's arm wrapped around his neck — an indication that pressure on his windpipe obstructed his breathing.

"I'm not saying he intentionally did that, but that's where his arms are," Dee testified as the video played of Pantaleo grabbing Garner and wrestling him to a Staten Island sidewalk in July 2014...."

"The pathologist who performed an autopsy on Eric Garner testified Wednesday that the banned chokehold performed by Police Officer Daniel Pantaleo sparked a “lethal sequence of events” that led to his death.

Dr. Floriana Persechino said the maneuver sparked an asthma attack, that led to Garner not being able to breathe as he was arrested on Staten Island on July 17, 2014....

“That maneuver is a chokehold,” said Persechino, who has performed upwards of 4,000 autopsies and has been trained on how to check for signs to see if a chokehold played a role in someone’s death.

“It is my opinion that the injury, the chokehold, the chest compression, set in motion a lethal sequence of events... a cascade of events," she explained...."

Doesn't matter that there are not many reading- just posting for a record of the trial. You never know if/when someone might need it one day, IMO.

This is a hard trial, IMO. :(

"...Garner’s mom, Gwen Carr, and several supporters left the courtroom at One Police Plaza rather than see the images on a 6-by-8-foot video screen, following a warning from the bench that “they will be explicit.”

About 15 photos showed the front of Garner’s neck cut open and exposed, with the skin and successive layers of muscle peeled back.

Deep red bruising was visible on the second layer, which Persechino called “a band of hemorrhaging affecting the interior.”

On the fourth layer, there was a two-inch oval bruise that was dark purple and nearly black in color.

During questioning by the prosecution, Persechino said that Garner had a “hypersensitive airway,” and that the trauma inflicted during his July 17, 2014, arrest triggered his asthma and led to his death from a heart attack...."

"The mother of Eric Garner stood outside of the New York Police Department’s headquarters in the rain on Monday to remind supporters that the fight for justice in her son’s death isn't over.

"Eric is crying from heaven 'cause he sees his mother and his family out here still trying to fight for justice for him," Gwen Carr told several people standing in the rain with signs that read #FireNYPD Daniel Pantaleo, the police officer involved in his death.

"It's been five years — five years we've been on the front lines trying to get justice, and they're still trying to sweep it under the rug," she said.

The family has been largely kept in the dark by the NYPD due to a police secrecy law that has clouded transparency in the case.

They were initially denied access to Pantaleo's disciplinary records and were unable to see evidence from the grand jury investigation into the case, due to a state civil rights law — Section 50-a — that bars access to police officers' personnel records...."

Will Officer Daniel Pantaleo be punished for the death of Eric Garner? We may never know.

"Cops testifying Tuesday in Officer Daniel Pantaleo’s departmental trial for using a banned chokehold that led to the death of Eric Garner said they believed the Staten Island man had faked being in distress while he lay on the sidewalk dying.

Officer William Meems, who said he was the one who determined Garner still had a pulse after he was handcuffed, agreed when Suzanne O’Hare, the lead prosecutor for the Civilian Complaint Review Board trying Pantaleo, asked if he thought it was possible Garner was “feigning consciousness” when he collapsed and was struggling to breathe.
“At one point, yes, they tried to stand him up. I never observed his eyes roll in his head," Meems said. "Yes, I believe it was a possibility he was feigning unconsciousness.”

In later testimony, Officer Justin D’Amico answered with a simple “yes” when O’Hare asked if he suspected Garner was “playing possum."...

D’Amico’s testimony capped the fifth day in Pantaleo’s trial, which is now on hold until June 5 because a St. Louis pathologist who will testify the cop did not use a banned chokehold is not available until then...."

"After taking a four-day break, the administrative trial of Officer Daniel Pantaleo on charges that he used a banned chokehold in the death of Eric Garner in 2014 continued on Tuesday, running three hours before taking another hiatus that will last two weeks.

The slow progress appears to be frustrating to all parties involved except Pantaleo and his lawyers, who told an irate Judge Rosemarie Maldonado that the delay was unavoidable, as a witness they would like to call is currently unavailable. The witness, a medical examiner from Missouri, is expected to challenge the New York City Medical Examiner’s determination that Garner’s death was a homicide brought on by a chokehold. But Pantaleo's attorneys said their witness cannot travel now, because he is currently "the only Medical Examiner in St. Louis this week."..."
