NY - Rita Tangredi, 31, and Colleen McNamee, 20, murdered, 1993-94, John Biltroff *GUILTY* - #2

A Manorville man convicted in two early 1990s slayings is seeking a review of his case after alleged Gilgo Beach serial killer Rex A. Heuermann was charged in a third homicide from the same time frame with an "eerily similar" crime scene, court records show.

 
Looking through RH's bail application right now. I just noticed there were two oubound calls placed by Maureen Brainard-Barnes' cell phone to her voicemail made three days after her disappearance (made after a period of inactivity, presumably calls made by the murderer). The calls were placed from a cell site location on the Long Island Expressway near Islandia. Colleen McNamee was last seen entering a small blue vehicle outside a diner in Islandia. Her body was found about 17 miles east off the Long Island Expressway in North Shirley.
 
Retested DNA evidence is creating fresh doubt that twice-convicted killer John Bittrolff is guilty of the 1994 killing of Colleen McNamee, upending one of the most vexing Long Island homicide cases in decades.

The evidence now shows that another man's genetic material was found on a pair of men’s jeans discovered at the Shirley crime scene and McNamee's body, court papers show. Authorities had been previously unable to create a profile from the DNA on the jeans and McNamee's body and therefore could not rule out they belonged to Bittrolff.

The dramatic new finding is contained in a 145-page filing from attorneys seeking to overturn Bittrolff's conviction by alleging someone else is more likely responsible for the crime…

Bittrolff’s attorneys are now trying to shift blame to other men previously questioned in the case and alleged Gilgo Beach serial killer Rex A. Heuermann, who was charged last summer in a November 1993 killing in which Bittrolff was previously named as a suspect. They are also seeking to have sophisticated new DNA testing done on hairs found at the crime scene that have never been tested…

The latest motion also notes in relation to the name "Michael M." that Suffolk prosecutors previously disclosed that two men named Michael Murphy were named as suspects or questioned in the case before Bittrolff’s arrest, one a Suffolk County police officer and the other a man whose brother worked as a bouncer at a bar where McNamee danced. The file containing the investigation into Officer Murphy was destroyed, according to testimony at trial.

Basically, a pale of male jeans was found near Colleen McNamees body
The jeans had her blood, and an unknown males dna on them.
Dna tech at the time couldn't develop a sample, so they could never rule JB out.

According to the defense, that dna evidence has finally been able to be processed, and the sample doesnt belong to JB.

From my understanding, they are saying the male dna in the jeans was a match for the dna found on Colleens pants and a dna sample from her vaginal swab.

Here's a great chance for DA Ray Tierney to become a hero. Having the state test the hair samples that have never been tested and either right a 20-year wrong -- major HERO move -- or remove doubts regarding JB's guilt. Making his theme justice, couldn't this be a huge political boost for Tierney no matter what the tests show?

While I recognize what a nightmare it would be for Suffolk County's legal system to be forced to publicly acknowledge that all the convictions by Thomas Spota are tainted, aren't they already?

"If this DNA evidence had been presented at trial, it is not unreasonable to conclude that the jury may have acquitted Mr. Bittrolff, especially since they came back deadlocked on three occasions even without this powerful DNA evidence," Marcoccia wrote in the motion, adding that she believes the DNA evidence presented at trial showed only that her client may have had sex with both women.

Look, if a jury goes back to a judge and says it is deadlocked THREE times, and the judge won't accept that -- I personally don't think the defendant has received a fair trial.

Did you read the appeal docs??? I have no doubt in my mind after reading them that you are 100%%%%%% on point!

I'm still not fully convinced that the pants are the smoking gun that prove Bittrolff's innocence. Colleen was found in an area where she likely brought other clients. We know that she had two clients named Michael Murphy. She worked out of a motel, but likely used this spot on a number of occasions, especially clients who didn't want to be seen around such a motel. From what I can make out, it was an abandoned commercial area that you could drive into. Her body was reported by an anonymous caller. The caller may have been someone who didn't want to explain why they were hanging around an area where girls brought their johns.

As for the pants, there are probably a number of reasons why a john would have dumped a stained pair of pants. Especially if they had a significant other and the post-sex clarity hit. The blood may have been transferred if the pants were close enough, or if the killer used them to wipe his hands, etc.

Bittrolff's work colleague said that he saw blood, teeth, and Colleen's ID in his truck. When he asked him had happened, Bittrolff claimed that she had tried to rob him.

Then, there's also the fact that Bittrolff's DNA was found underneath the nails of the other victim, Rita Tangredi. That's an indication that she may have tried to fend him off.
 
The fact that RH has been charged with Sandra Costilla and LE stated for the longest that Sandra was killed in a similar way to Rita and Colleen is just one reason why I think Bittrolff needs his case looked at again. The way the DNA was collected, the missing wood chip evidence from an SCPD car, SCPD officers Hart and Murphy being entangled in the stuff they were, it's all too much for me to point at Bittrolff and say guilty. I sent an email to his attorney Lisa Marcoccia and haven't heard back.

In my opinion, there are several good reasons JB's convictions need to be publicly examined before RH's trial. I'm wondering about a jury convicting RH for Costilla after so much discussion about the similarities of the three cases - IF Bittrolff's convictions stand. Jury selection on a case of this prominence must be really tough to be able to ensure a fair trial. Since JB was convicted years ago, I suppose it is possible in as populous an area as Suffolk there are plenty of people who know nothing about either case. Still . . . After learning of the three times the jury went back to the judge deadlocked, I wonder if the jury just gave up and gave the verdict they thought they were going to be required to. Would JB have ever been convicted by another jury?
