Authorities in New York say a man raped his own infant daughter and killed her, disposing of her body at a cemetery in Tioga County over the weekend.

According to the New York Post, 25-year-old Cody Franciscovich was arrested Sunday on suspicion of the horrific violent crime.

Police reports indicate he was spotted walking unclothed near a motel as officers conducted a welfare check on his infant daughter at the request of her mother.

Upon approaching him, investigators say the naked suspect led them to the body of Ruby Franciscovich, who was reportedly floating on her stomach in a pond near St. Patrick’s Cemetery. By the time police found her, they say she had floated about 25 feet from the land.

The girl was reportedly transported to an area hospital where she was pronounced dead. Locals organized a vigil on Monday evening at the cemetery near the spot where her body was found.

A criminal complaint determined that Cody Franciscovich “did knowingly and intentionally commit the crime of murder in the first-degree when in the immediate flight thereafter of committing the crimes of rape in the first degree and criminal sex act in the first degree he killed his eight month old daughter.”

He could spend the rest of his life behind bars if convicted and remained jailed without bail as of the latest updates available.

Around 7:14 a.m. Sunday, the Tioga County 911 Center took a "check the welfare" call from Ruby's mother — the child and her father were missing from the Deep Well Motel on Route 17C.

New York State Police Capt. Scott Heggelke said it's believed Cody Franciscovich and Ruby had left the motel about an hour earlier.

While troopers searched the area for signs of Ruby, another 911 call steered troopers to a nearby location just west of the Route 17C motel: a naked Franciscovich was found along the road.

After questioning, Franciscovich directed troopers to the pond behind the cemetery.

Ruby was found face down about 25 feet from the edge of the pond and a trooper waded in to retrieve her, Heggelke said at a news conference Monday. She was pronounced dead at UHS Wilson Medical Center in Johnson City.

What happens next
On Friday, Franciscovich is scheduled to appear in court for a felony hearing, in which the Tioga County District Attorney's Office presents limited evidence of the crime.

Franciscovich's defense team, Tioga County Public Defenders George Awad and Tom Cline, also would be able to question prosecution witnesses.

After hearing the testimony, Town Justice Patrick Hogan would determine whether there's probable cause to believe a felony was committed — it's not the same as deciding whether Franciscovich is proven guilty beyond a reasonable doubt or not guilty — and likely send the case to Tioga County Court for further action.

The grand jury could consider an indictment with more charges, and the case could go to trial.

You know, other than the trauma and drama of being intentionally homeless because you choose not to provide a quality life for your kids. These little ones deserve so much better.

Responding troopers began their search to locate 8-month-old Ruby L. Franciscovich who was reportedly last seen at the motel with her father, Cody Franciscovich. Cody Franciscovich, Ruby Franciscovich, her mother and two other children ages 2 and 4 had been residing at the motel for several weeks.

Shortly before 8 a.m., Tioga County 911 received another 911 call of a naked male on Route 17C in the town of Tioga. Troopers soon located Cody Franciscovich on Route 17C, just west of the motel. They interviewed him about Ruby Franciscovich’s whereabouts and he directed the troopers to a pond behind St. Patrick’s Cemetery on Route 17C. Troopers observed Ruby face down about 25-feet from shore. A trooper quickly waded out into the water and retrieved Ruby, and initiated CPR. Owego Ambulance transported Ruby to Wilson Hospital in Johnson City where she was pronounced deceased.

Cody Franciscovich was arraigned and remanded to the Tioga County Jail on no bail. He is set to appear in the town of Tioga court on Wednesday, June 12, 2019.

The investigation is on-going. The two other children are with other family members and Child Protective Services is actively involved in the case.
