NY - Toddler with dairy allergy dies after school gave him grilled cheese

A school in Harlem has closed until further notice while officials investigate the tragic death of a 3-year-old boy who died after he was allegedly given a grilled cheese sandwich despite the school knowing the child had a severe dairy allergy.

Elijah Silvera was in his pre-K class at Seventh Avenue Center for Family Services in Harlem on Nov. 3 when he went into anaphylactic shock after eating the sandwich. The child was rushed to the hospital where he was pronounced deceased.

The New York City Department of Health and Mental Hygiene is “aggressively” investigating the situation and the school has since been shut down for “failing to follow its written safety plan and failing to adequately supervise a child,” the department said in a statement to PEOPLE.

There is no criminality expected in the case, a spokesperson for the New York City Police Department tells PEOPLE.
