CLEVELAND — Cuyahoga County prosecutors will no longer challenge a defense motion seeking to destroy recordings of calls between an attorney and Gregory Moore, the man accused of killing his former client Aliza Sherman 13 years ago in downtown Cleveland.

In its own motion filed Wednesday, the state of Ohio acknowledged the calls should never have been recorded because the conversations were covered by attorney-client privilege. Members of the county prosecutor's office spoke with an official at the Texas jail where Moore was being held after his May 2, 2025, arrest, and that official claimed the calls were only recorded "due to an inadvertent error."

Prosecutors initially filed a brief in opposition before relenting Wednesday. Moore's trial remains scheduled for Sept. 14, and he faces the following charges in connection with Sherman's death:
  • One count of aggravated murder
  • One count of conspiracy
  • Six counts of murder
  • Two counts of kidnapping

This case gets more strange as it goes along. Words fail. Prosecution has arrested and charged this person, yet they’re now destroying evidence used against him before the trial begins? Jail phone calls by the accused are always recorded, right? They don’t really say why or give much explanation of the nature of the evidence.

Is the alleged killer still out on bail? What information is everyone trying to protect?

Gregory Moore, 52, has a pre-trial scheduled for April 9 and his trial is set for Sept. 14.

Moore’s attorney recently filed paperwork asking for:

  • All search warrants and affidavits related to Sanford Sherman.
  • Is challenging the truthfulness/legitimacy of statements used to obtain search warrant(s) for Moore
  • Requesting disclosure of all prior grand jury testimony given against Moore, any testimony pertaining to other suspects including Sanford Sherman, and any testimony of witnesses not available for trial.
  • Requesting court suppress numerous items of evidence, including cell tower data, Geofence data, allegedly unlawfully obtained statements, and personal items belonging to Moore.
Moore is still out on bond
