OH Columbus LEO Fatally Shoots 13 y/o after armed robbery, teen w 'gun' 14 Sept 2016

Agreeing w ^ but re-ordering a few words: If anyone decided that teenager's life didn't matter, it was he himself first, his culture, his peers.
It's all good, it was in order of flourish's brain train, not to emphasize any kind of importance, so it's all the same to me in that sense.

In search of answers the family retained Francisco J. Diaz, MD, FCAP, who serves as a practicing medical examiner in the County of Wayne, Michigan, as a Consultant Forensic Pathologist. Dr. Diaz examined Tyre's body in Columbus, Ohio on September 18, 2016 . Dr. Diaz was asked to evaluate the number, the physical characteristics and the location of any gunshot wounds Tyre suffered in his death.

Dr. Diaz notes: “Based on the location and the direction of the wound paths it is more likely than not that Tyre King was in the process of running away from the shooter or shooters when he suffered all three gunshot wounds." Dr. Diaz describes Tyre as a "small-framed adolescent boy, standing 5’0” and weighing less than 100 lbs."

^^^ The link above is from an attorney hired by the family, and an examination of the body by a privately hired examiner AFTER the official autopsy was completed by the county medical examiner.

As such, the HIRED medical examiner can only describe the wounds that are evident AFTER the official autopsy is completed. So it is fair to say he observed three wounds, and where they are (left side-- all three), but he CANNOT come to the conclusion that TK was "running away" from the officer.

That comment by the hired examiner VASTLY oversteps his bounds as a medical examiner, which the examiner and the attorney know quite well. The medical examiner's job is to describe and determine the CAUSE of death (GSW to head and torso), and MANNER of death (accident, suicide, homicide, undetermined).

The teen could just as easily have been turning TOWARD the officer who shot him, AND he was a "fleeing felon" with a KNOWN gun, so the officer is still obligated to pursue and apprehend him.

It is "convenient" that the examiner hired by the family would say TK was "running away", because he KNOWS the official autopsy report will not be released for weeks. They want to control and re-frame the public narrative, since TK's own behavior, committing witnessed felony armed robbery, was so damning.

I believe his height and weight are probably correct, and that he was shot 3 times with wounds probably as described, but this is FAR from any kind of "bombshell" that will change what TK did that night to cause his own death, into some kind of "bad shoot" on the part of officers responding to THREE citizens reporting armed robbery in progress by a pack of youths with guns.

Per the above link, the entrance wounds were on the left, exit wounds were on the right. How does left to right indicate he was running *away* from? I thought the press release would be more clear. Entrance wounds into the back and exit wounds out the front tell me something, left to right doesn't.

A defense attorney has raised concerns about the "prejudicial" effect of releasing the juvenile record of a 19-year-old robbery suspect linked to Tyre King, who was shot fatally by Columbus police last week.

Judge Eileen Paley delayed the hearing Monday after defense attorney Marcus Ross raised the issue of the release of Braxton's record.

http://www.10tv.com/article/one-suspect-arrested-robbery-leading-police-involved-shooting-tyre-king

Well, it doesn't take a genius to know that if the record is "prejudicial", then it's an EXTENSIVE criminal record. Duh! And he was best buddies with TK, out committing armed robbery together. Such a good example by the older boy, "mentoring" the younger boy into a life of crime, right?

But even better, DB probably "just" turned 19, so his defense attorneys can say he doesn't have an extensive ADULT criminal/ violent criminal history, if they get the juvenile record suppressed, and he can argue for a lower bond, or no bond at all, so he can be let back out on the streets again. Then at trial they can argue he deserves a lighter sentence, since he does not have an extensive "adult" violent criminal history. Or better yet, plead it down to littering or jaywalking. I know how the game is played.

Correct, Cubby. As I said above, if the info on the GSWs is correct, he could just as easily have been turning TOWARD the officer. And none of that proves or disproves what he was doing with the gun at the time he was shot.

(That is, unless TK had a very peculiar habit of running away sideways?)

A man works to cover up "Justice 4 Tyre King" graffiti that appeared Monday morning.

Ohio University students woke this morning to find messages about Tyre King painted on several university structures around campus.

The Ohio University Police Department received a report of “Justice 4 Tyre King” painted in black at the top of the steps near Baker Center at about 7 a.m. Monday morning.

Another officer found graffiti on two sides of the Civil War monument on College Green and the side of Lindley Hall, according to the report.

The incident is under investigation.

A 19-year-old accused in a robbery that preceded the fatal shooting of a 13-year-old by police will remain in the Franklin County jail after his attorney waived bail this morning.

Ross said they will not request bail until Braxton’s felony arraignment later this month in Common Pleas Court.

According to the police report, a man said he was walking north on South 18th Street when one member of a group of four asked him for the time. The man said he did not respond and kept walking, but turned and saw one of the males pointing a handgun at him and demanding that he empty his pockets. After taking his cash, the group fled and the man and a witness called 911 at 7:42 p.m.

Responding officers saw a group that matched the description provided in the 911 call. Two of them ran and officers chased them, leading to the confrontation in which King was shot at the rear of 27 Hoffman Avenue.

Police have said that Mason fired after King pulled the realistic-looking BB gun, which was equipped with a laser sight, from his waistband. Officers found the gun at the scene.

Braxton was released after police questioned him that night, but a warrant was issued for him after the victim identified him as the gunman. He declined to make a statement after being arrested, police said.

Also on Monday, the attorney for King's family said an independent pathologist hired by them examined King's body at the funeral home in Columbus on Sunday.

The Franklin County Coroner's Office completed an autopsy last week. The Dispatch filed a records request for the preliminary autopsy report, which by law the media have a right to view. The report, which normally would contain details such as the location of the wounds or number of gunshots, only said the report was pending. The coroner's office refused to say where or how many times King was shot. Spokeswoman Tia Moretti said her office's determination of the cause and manner of King's death remain pending. Results are expected in six to eight weeks after toxicology reports are returned.

Columbus police wouldn't discuss Diaz's report.

Braxton also told The Dispatch last week that he handled the gun that King had on him when he was shot. He said he saw King shot in the front of his body “four or five times.”

Those with the person who commits armed robbery can be charged with armed robbery just by being with that person — even if they all didn't have guns, Ric Simmons, Ohio State University law professor, said.

BBM. New details.

The Associated Press on Monday obtained Officer Bryan Mason's performance ratings from May through a public records request.
The evaluation notes that Mason maintains composure under stress and demonstrates "exceptional verbal skills" in defusing "potentially hostile situations."

A defense attorney has raised concerns about the "prejudicial" effect of releasing the juvenile records of a 19-year-old robbery suspect linked to the Ohio boy who was shot fatally by Columbus police last week.

Judge Eileen Paley granted defense attorney Marcus Ross' request to waive Braxton's initial court appearance Monday after he raised the records issue. She set a Sept. 27 hearing.

Braxton remains held without bond.

Police alleged Braxton was armed with "what appeared to be a black semi-automatic handgun," and he robbed a man of $10, according to court documents.

The victim told police a group of individuals approached him, and officers later saw several people matching suspect descriptions, police said.

Officer Bryan Mason shot King after the teenager pulled out a BB gun, which resembled a real firearm, police said.

Sgt. Weiner confirmed Braxton was taken into custody at the scene of the police-involved shooting, questioned, and released.

In a police report, investigators said Braxton was initially admitted to being part of the group behind the robbery, but he blamed the robbery on someone else.

An arrest warrant was issued for him after the victim identified him as the gunman, according to police.

No wonder DB isn't very anxious to get bail set. He's quite content to sit in jail, where he's safer, IMO.

State senator asks parents to destroy toy guns after Tyre King shooting
State Sen. Cecil Thomas, a retired police officer, today urged all parents and guardians to destroy toy guns that resemble actual guns in the wake of a fatal police shooting of a 13-year-old Columbus boy.

Thomas, D-Cincinnati, noted that this is the most recent incident involving a fatal police shooting of a juvenile carrying a realistic imitation firearm. An officer shot Tyre King after being called to the East Side on a report of an armed robbery.

'Our kids can’t play with toy guns': Tyre King police shooting a painful reminder

https://www.theguardian.com/us-news/2016/sep/20/tyre-king-columbus-ohio-police-shooting

I do think it's important to make the distinction that Tyre King was not "a child", and was not "playing" with a "toy" gun. The correct and accurate description of TK would be "youth", "teen", or "adolescent" CRIMINAL SUSPECT. He was committing felony armed robbery, and resisting arrest, not playing at shooting pop cans in the backyard.

That said, it's my opinion that there is no place in society for highly realistic, look-alike guns. Nothing "good" comes from that. Firearms should "look like" firearms, too, IMO-- and not painted candy colors like toys.

I worked with a lady one time who had a son that went to prison for riding around and pointing a paint gun at people. The fear of those people was real. So was his sentence. He got several years.

Personnel records released of officer who shot, killed Tyre King

Personnel files released for Columbus Police officer Bryan Mason showed that the nine-year veteran officer had either met or exceeded in all job review categories since joining the ranks in 2007.

[snip]

Records show Mason was cleared in a September 2009 shooting along North 4th Street. Investigators say a suspect in that case shot and injured two officers before taking his life. For his part, Mason was a Silver Cross Award for shooting at the suspect to protect people and fellow officers.

In 2009. Officer Mason also received recognition after shooting a dog that attacked and bit a fellow officer during the course of an investigation.

Mason was also cleared in the 2012 shooting death of a suspect holding another man at gunpoint along Howey Road.

Consider this opinion piece, based on analysis of other cases: http://www.nydailynews.com/news/national/king-don-police-kill-article-1.2793583

I believe that the Mayor's point about our obsession with guns has to do with how many of them we have, frankly, floating around in ways that make them too easily accessible to 13 year olds who have immature judgement and do stupid things. We also buy in, societally, to the notion that not only does widespread gun possession make us safer, but that it is somehow manly and responsible to "carry." I have seen too much of how this translates to young males, and possibly in particular to young males who are also widely viewed as ****s--regardless of how they dress or act. I am hesitant to pick out any single piece of what must be an enormous bundle of influences in this young man's life, as in the lives of all our young people, as being THE cause of his behaviors. I am certain the causes are many. But we do need to be about repair of those things we can fix.

Too many young people gone.

This. It is a societal problem on many levels, from gun worshipping to racism.

Ohio police officer who fatally shot black teen Tyre King helped save life of another boy who tried to hang himself

The Ohio police officer who fatally shot a 13-year-old black boy armed with a BB gun once helped save the life of another African-American child the same age who had tried to hang himself, records show.

The 10-year veteran was honored by the department for "quick actions" that saved a 13-year-old boy who tried to hang himself in 2012. Mason and another officer performed CPR until more help came.

In 2009, Mason was among officers who returned fire on a white man armed with an AK-47 who later killed himself. The suspect fired out of a window at officers after he fled from a traffic stop. Mason earned an award for containing "the violent situation."

There are "some very bad people in this world doing very bad things, and Bryan is not afraid to go out and address those issues to make our community safer," said Jason Pappas, the president of the police union representing Mason.

Mason was immediately placed on administrative leave, but is now back to full duty as the probe into the shooting continues, an official with the Columbus Police Department told the Daily News on Friday.

Police records show that Mason has been involved in other shootings, including another fatality, in which he was cleared of wrongdoing. His other shootings include the 2012 death of a white man holding another white man at gunpoint, and two non-fatal incidents.

Columbus resident Jason Blackburn said Officer Mason shot and killed the man who held him at gunpoint nearly four years ago.

"I have five children," the 45-year-old Blackburn said. "And if it wasn't for him, they wouldn't have a father."

Just out of curiosity, why does the title of this thread use quotation marks when mentioning the gun?

By all accounts this was a realistic looking gun. It definitely wasn't a Super Soaker, or a toy with a bright orange tip, or some Nerf contraption.

I know people's opinion will differ on the circumstances here but I don't think there's any question about it - this looked as real as any real gun could be.

Hundreds gather to attend 13-year-old Tyre King’s funeral in Columbus

Hundreds of family members, friends and loved ones turned out for Tyre King’s visitation and funeral Saturday morning.

It was held at the First Church of God on Refugee Road.

Tyre King’s cousin Mikayla Swan said she was happy to see such a large number of people come to the service. Swan said she holds on to the memories she has of King.

“One thing I remember about him is his smile,” she said. “And he always used to tell me to stay out of trouble.

Agreeing w you: it looked like a 'real gun.' Using quote marks around the word 'gun' was my choice - a compromise between gun w no quote marks, since ultimately the item was not what is commonly thought of as a deadly weapon, but was not a 'firearm' per statutory definition, as in fed background check law. Saying 'toy gun' would suggest that the LEO (or anyone) could easily identify it as a toy gun and the LEO had no basis in fearing for his life and should not have fired. JMO.

Maybe someone has a better way to word it. Anyone? Thx in adv.

No problem with the quotes.

However, there is some reason to believe that the item in question was not used to threaten the police officer, and that the child was running away. This theory is supported by the report of an independent autopsy performed by the family, as well as the testimony of the friend who was there. The friend (Braxton) has said that both got down on the ground when ordered, but then Tyre got up and ran.

I think the child was running, then turned around, with the replica gun in hand...and that when he was shot. The bullet went into his temple and just above the ear. So he could not have had his back turned at the time.

Besides, if a dangerous armed robber is running towards other people, with the gun in their hand, it is legal to shoot a fleeing felon to protect others. They had no idea he was 13 with a fake gun.

So it is not just about being a that to the officer but it is about allowing a dangerous person to flee into the public and harm others in an effort to get away. He could have taken a hostage or carjacked someone.

ETA:Tyre suffered a gunshot wound of entrance on the left temple that passed left to right and slightly downward and exited through the right temple. The entrance wound was above the left ear and the exit wound was in front of the right ear. Tyre also suffered a gunshot wound to the left collarbone area. Lastly, he suffered a gunshot wound to the left flank. There is an exit wound on the right flank.
