So, what is the incentive for Jake and Angela to testify now? Can the prosecution revoke the plea deal? I have so many questions/concerns.

If the judge does not sentence Jake before Billy's trial then I think Jake would still need to testify to be sure to get his plea deal for himself, but if Jake is sentenced before Billy's trial, I can't think of a reason he would testify, since Billy's DP is already dismissed.

I don't think the please deal could be revoked since they would not be breaking it. The judge could sentence them differently than the plea deal but there's no indication yet he intends to do that.

He could go off script and not sentence Angela and Jake to what was agreed in their plea deal, I think. There has not been an indication tha the would but that does not mean anything. Surely he will at least relent and not sentence Jake beforehand.
It would especially shocking if he did that, considering he’s not that familiar with the cases of Angela and Jake. How is he qualified to suddenly sentence them when he’s presided over no hearings where they were present? JMO it’s more than confusing, it’s bizarre and concerning.

The plea deal requires that Jake testify in trials of the other defendants as the prosecution needs. Only when he has met those requirements can his plea deal be finalized.

Angela said in her court letter - for new counsel - that she didn't want to do anything to hurt her plea deal. Her 30 years no early release deal.

She also has said in court that she wants a chance to hug her grand children. I believe that this is a way for her to "cope."

This is not a realistic expectation. She focuses on getting out one day and go back to what she used to have and I think this is delusional.

Agree and if she appeals it will take even longer to get to trial.
Maybe that is the point to all of this. Truely makes no sense at all and he certainly has to know it doesn't stop with him, does it??

I sure hope you're right .. with judges like him there would be no need for prosecutors or a defense team. moo

This makes me so mad that this judge has stepped in late in the case and is making these decisions without considering the prosecutors’ side, the ones that have been involved with it from the beginning. It seems that he is on some big power trip or something.JMO

On 11/27/2024 when the dismissing death penalty specifications was filed a judgement dismissing various pending motions by defendant was also filed . Anyone know which pending motions were dismissed?

They almost all had to do with the DP that the defense had filed. After the judge dismissed the DP the motions were not relevant any longer. The judge filed a motion in Sept letting the Defense know he would be dismissing unless they responded, which they did not do.

I can't believe this circus is still going on. The Wagners annihilated an entire family and they have dragged this out for almost 9 years. No justice.

The Wagner Crime Family have all been behind bars now for 6 years and will stay there, separately from each other, forever.

This is some form of justice but yes, the total conclusion has been maddenly dragged out for 6 years.

I hope so. However, I agree with Prosecutor Canepa that the judge is trying to sabotage Billy's case.


Prosecutor Canepa also appears to believe Fredericka Wagner is behind the sabotage as she filed a motion containing a transcript of Fredericka Wagner's recorded conversation with Billy in jail.

Now judge Hein wants to hear further arguments on dismissal of the DP for Billy. Maybe he thinks he took a step to early and needs to now remedy it at least by hearing arguments. If he changes his mind and does not dismiss the DP, then Jake would probably need to testify even if already sentenced, to remove Billy's DP.

This should be interesting. I didn’t think it was very professional of the judge to say that Canepa was annoying .

It doesn't look good, very unprofessional and arrogant. What is his problem? AC has done an exemplary job in handling these prosecutions. It's the worst murder case in the history of Ohio. Does he realize how many people are watching him and how he handles this trial?
