It worked ok for me. Drastic measure and certainly unflattering for the judge, but he was heading in the wrong direction, so to speak.

Filed Dec. 13 with Pike County clerk

OH Chief Justice of Supreme Court orders Judge Hein to respond, in detail to each allegation. Upon receipt of Judge Hein's response, the court will review and render a decision.
The actual Affidavit for disqualification that was filed by Canepa will not upload when I try. It had some interesting things in it that had gone on.

Thanks, I thought of that later after I posted. It would be interesting to see what allegations she listed for the disqualification. Did you find it on the Ohio Supreme's site? TIA

If you can post the link to the Court site and the case number, I'll try to compress the doc file to upload. WS site has long been hit and miss for uploading documents and I'm not sure why. Thanks.

No, because it is an Affidavit of disqualification they told me they do not put it on the Supreme Court Site, not sure why.

It is not on the Surpeme Court of Ohio Site. They do not put Affidavit for Disqualification on their site I was told. I can however give you the information to call and get the file if you like and you can try to get it posted. They will email it to you and maybe you can get it to post. Let me know if you want to do that.

Sorry, I'm outside the US and can't phone the clerk so have to rescind my offer. Hopefully a network will post the details from the affidavit soon.

I hope they can get rid of this judge, even if it means a delay. He is totally sabotaging this whole case.

#22 really stood out to me.

He wanted to play "good cop/bad cop" with the VICTIMS families???? To force them to agree to a bad plea deal????? I don't know what to say without cursing.

There are more pages but your attachments are enough to give a good idea of things that went on. The judge's response that I posted seemed like an incompete response but that is what the Supreme Court personnel said they have as his response.

Yes, his response was so brief, I almost skimmed over it while reading.

Looking at #22, if Billy got a deal for a 50 yr sentence, he could be out in 22 years, possibly less.

According to this federal DOJ fact sheet, parolees spend an average of 44% of their sentence before being paroled.


IANAL, but the way I read the parole guideline info for Ohio, there are no minimum sentence requirements. Judges decide that at their own discretion. A friendly judge could agree to parole Billy at any point in time after he's sentenced.

I wish I could comment but all I want to do is cuss.

Billy needs a LWOP sentence period.

This is Judge Hein's amended or resubmitted response to Affidavit of Disqualification. As I had said yesterday the one that was submitted did seem to be incomplete.
