Hein says he could have gone higher. Says Angela helped state make its case as well as Jake. Hein says to Angela you were the only person who could have stopped the whole thing. But her cooperation led him to agree to sentence.

If he imposes the sentence as recommended, she won't have the right to appeal. His math came up with 30 yrs.

Giving her the recommended sentence doesn't let the judge off the hook. Sentencing the state witnesses now means they don't have to testify in Billy's trial. That's the damage, that's his intent, JMO.

I just missed the sentence, anyone?

Hein also told #Angelawagner: "You were the only one who could have shut it down." When her husband and sons left the house to commit the crimes, she could have called authorities and turned them in. That was depravity, he told her.

Oh snap. Things are getting spicy in Pike County. Judge Hein is threatening to have special prosecutor Angie Canepa escorted out of the building after she objects again to the sentencing proceeding today. He says there's no debate. And he's telling Ron O'Brien to be ready to step in

Hein said "I'm not interested in old hash." He said she's objected 5 other times. And Canepa didn't file a written objection as he wished.

Getting set for sentencing for Jake and Angela Wagner in Pike County- it’s a go after Supreme Court denied another attempt by prosecutor to remove visiting judge. Angela’s mother Rita also to be sentenced. Streaming starting at 10 on


That will be followed by another hearing for Billy Wagner - on admission of other criminal acts and may find out new site of his trial


Looks as if we're starting with mother Angela, who pleaded guilty to several charges other than actual murder and agreed to sentence of at least 30 years in exchange for testifying.


Strike that - starting with Rita Newcombe, Angela's mother. She also pleaded guilty to several charges including forgery etc. for helping Angela falsify documents related to custody of some of the children involved.


She also agreed to testify and did during George Wagner IV's trial in exchange for the plea deal.


These sentencings are going forward over protests of prosecution, which loses leverage over Jake, Angela and Rita to testify against Billy Wagner in his upcoming trial.

With Billy also due in this building today, this marks first time since arrests in 2018 they've all been in the same place.


Visiting Judge Hein warning about anyone trying to debate what happens in the courtroom - saying he will shut it down if anyone gets out of hand.


There will be four victims statements - two will be read by prosecutor and two will be in person. All agree to be televised. Tony Rhoden, the brother of Chris Rhoden, not expected to speak according to family lawyer.


Hein asks prosecutor's assistant to be ready to step in. Doesn't want to hear objections to sentencing - only wants recommendation. There is serious bad blood between these two. He says possibly disciplinary action.


Canepa says she defers to court on sentencing for Rita Newcombe ... but says Newcombe has been very cooperative. As to Angela Wagner, asking judge to go along with joint agreement of 30 years.


Canepa says regarding Jake Wagner, also asks Hein go along with joint recommendation of life in prison without parole.


Was for maximum consecutive sentences for each of the charges, including aggravated murder.


First up for victim's statement Andrea Shoemaker - Hannah Hazel Gilley's mother. She was shot alongside her fiancee with a baby girl next to them. Says they are "spawns of Satan" "you are evilest mother" to Angela Wagner.


Hannah was engaged to Frankie Rhoden, who was also 20 at the time. Two kids left alive at the trailer on Union Hill Road. "I hate you - you ruined my life" "I hope you die" says Shoemaker


Canepa reading statement from Bonnie Jo Newcombe - the people who first discovered bodies. "You don't deserve to be alive."


Next statement Ruth Rhoden - stepmom of Gary Rhoden. "you killed more than 8 people”


Lisa Wiegel - niece of Chris and Kenneth Rhoden. Speaking for entire Rhoden family. Family does not agree with sentencing just to get it over with. Wagners "are a true danger to society" Says to Jake - we are no longer family. No longer think of you today


Rita Newcombe's lawyer now speaking on her behalf, saying she is willing to testify in Billy Wagner's trial. Says she recently had open heart surgery.

Newcombe stands and says "sorry for all the trouble. I'm sorry”


Newcombe's official charge is obstructing official business, a second degree misdemeanor. Hein sentences her to 5 year supervised probation and 180 days prison - but suspended and given her 7 days already served. $750 fine and costs - depending on her ability to pay.


She acts if she needs to go to jail - answer is no unless she acts out.


Hein corrects himself - 83 days not 173 days suspended sentence given 90 days is max sentence for 2nd degree misdemeanor.


Angela Wagner up next - her lawyer says they understand Judge Hein won't just rubber stamp previous agreement for 30 years.


He says Angela was involved with these actions - but did not go to houses or pull trigger. She takes responsibility for her actions and that she testified against her son.

Lawyer says Angela will continue to live up to her end of deal - but doesn't specifically say she will testify against husband Billy Wagner in his upcoming trial. Says she is mentoring young women in jail.

Judge Jonathan Hein has taken the bench in the #PikeCountymassacre case. He led all in the pledge of allegiance.


"This is a government activity," Judge Hein said in explaining why he led the pledge of allegiance. He also said he understands there will be high emotion in today's sentencing hearings.


"Decorum matters," Judge Hein said. "Everyone has been well behaved and I expect that to continue.”



Hein will take Rita, then Angela, then Jake in that order, for sentencing. Victim statements will be taken together.


Victim statements will be broadcast in full, per their attorney.


Hein said he has allocated 10 minutes for victim statements.


Prosecutor Angela Canepa up first to address sentencing recommendations. Judge Hein just told co-counsel Ron O'Brien to be ready to step in, telling Canepa not to rehash earlier matters. If she doesn't, he will take disciplinary action, he said.


Canepa said the state did not have an agreed-on sentence for #RitaNewcomb -- so leaves her sentence to the discretion of the court.


Canepa recommended the earlier-agreed 30 years for #AngelaWagner.

Andrea Shoemaker: Victim children now see the Wagners on TV and she's had to explain who they are. "I want you to suffer," she said to #JakeWagner. "I hate you. You've ruined my life. YOu've ruined innocent children's lives."

Angela Canepa reading two statements next. Bobby Jo Manley's is first. Manley said: "You've destroyed my life and so many others. .. You are the devil." Manley was first to discover the victims in April 2016.


Canepa also read a letter from Luke Rhoden, son of victim Kenneth Rhoden, asking for justice.


A niece named Liese read a letter on behalf of the Rhoden family called the Wagner family "master manipulators." To Jake, she said: "We are no longer family. You will be an afterthought to our family.”


#RitaNewcomb attorney Frank Gerlach said Rita spent approximately eight days in jail, then wore an ankle monitor for a year. She recently had heart surgery, and is doing well on that. She has limited income of $981 a month in Social Security, Gerlach said, saying she has no funds


Judge Hein said max sentence for #RitaNewcomb is 90 days and up to $750 in fines. He said she has had a clean record since then. He ordered five years probation. No jail time, but is imposing the fine and court costs, subject to her ability to pay.


#RitaNewcomb's response: "Do I have to go to jail?" Response is no. But yes, she's supposed to pay, as able. After five years, the court will forgive whatever she hasn't paid.


Hein clarified: 90 max, seven days served, balance suspended.



#AngelaWagner is moving to the defense table with attorney Robert Krapenc. She is shackled at the ankles.


Krapenc on sentencing for #AngelaWagner: "Ms. Wagner is very cognizant" that the current judge is not obligated to follow the agreement reached with the prior judge in the case. But he recommends it -- 30 years w/o parole.


Krapenc: #AngelaWagner did not kill anyone but admits her role in preparing and covering up the crimes. "Ms. Wagner will continue to live up to her end of the deal." She's also completed 40-50 programs while incarcerated in Delaware County. She's a trusty, mentors other inmates.


#AngelaWagner read a prepared statement. She stood with her attorney taking the classes off the top of her head to place on her nose. She said she spent her life trying to be the perfect person -- daughter, wife, mother.


Speaking in a soft and hard-to-hear voice, #AngelaWagner offered regret and remorse over her role in the #PikeCountymassacre case. "I've committed myself to change," she said. "Each day I work on being a better me."

Kirk McVay, attorney for #JakeWagner, spoke about his earlier agreed-on sentence: max of eight consecutive life sentences without parole, with 160 more years. "Mr. Wagner entered his pleas knowingly.”


McVay continued: Jake knows he cannot appeal his sentence. He has worked with Jake for six years and noted his cooperation with the prosecution. He asked the court to acknowledge days already served.

Jake is now addressing the victims' family.

He knows full well the weight of his crimes is bad enough that there's nothing he can do or say to end the hate and anger they feel. Two or 3 weeks later, he felt the full weight of his guilt over what he did.

He's not sorry he was caught. He's sorry that he committed the murders. Jesus saved him by having him arrested.

He seems to be owning up to all of it. Telling victims families they should read the Bible and it will help them get rid of their hate. He's sort of sermonizing now.

Is he telling the victims families they should repent their sins? Really? Kind of inappropriate.

Judge should be ashamed for allowing the killer to preach to the victims family and friends, telling them to repent their sins. He says they're sinning because they hate him. Made a remark about Hannah Gilley's mom laughing at him.

It sounds like more people are leaving the courtroom during this ridiculous speech.

Jake should be praying for the soul of Judge Hein for putting the victims families and friends through this outrageous hearing, being lectured to by the killers and insulted and threatened by the judge.

#JakeWagner: He said he is glad he got caught. Speaking to the mother of victim Hannah Hazel Galley: "I ask if you are a woman of some kind of faith, I would ask you to read the Bible."


#JakeWagner continued: "Only a relationship with Jesus Christ will save you." Looking around the courtroom, he continued to talk about his faith. "I committed every single sin that the Bible lists." With that, Andrea Shoemaker exited the courtroom.

It appears Rita Newcomb's sentencing will proceed first. She pleaded guilty to a misdemeanor obstruction charge after lying about forging custody documents. She said her daughter, Angela Wagner, asked her to lie about notarizing the documents for the children of Hanna, Jake and George.

Judge finally told Jake to wrap it up. He's still proselytizing. Telling people to confess, etc. <modsnip - namecalling>

If Jake is such a good Christian, he should go ahead and testify against his father in his upcoming trial (if the judge allows Billy to be tried).

Jake now talks about how he's been persecuted. Oh, please.

Judge Hein asked #JakeWagner to wrap up his remarks then gave him two minutes to finish. "Forgiveness is a powerful thing," he said. He ended with this: "Jesus has a cost" but committing to him will transform their lives. "I do pray for you all."
