He's going to reduce Jake's sentence.

He's making Angela Wagner the bad guy in the whole thing.

He's giving him parole after 20 years. #$@!!!!

He murdered 6 innocent people and assisted in the murders of 2 others.

He's blaming it on the prosecution saying they should have sentenced him when Judge Deering was still on the bench.


Contrary to Jake's preaching, there is no God in this court room today, JMO

JMO, all he did was give Jake a death sentence that will be carried out in prison, by other inmates.

Now on to Jake. His lawyer says Jake understands his 8 consecutive life sentences for aggravated murder and knows he can't appeal. In George's trial, he admitted to killing to at least 5 of the eight victims.


Lawyer says his cooperation was key to making the case against the rest of the Wagner family. He also led them to where the destroyed guns were submerged in a pond.

Lawyer says Jake is a man of his word - alluding to possibly testifying against father Billy.


Jake now addresses victims family. Says he’s glad got caught. Also says converted to Jesus. Some Rhodens walking out. Says he cares about each of their pain.

Ready to pay his consequence but has joy and love in his heart.

Hein asks him to wrap it up. Family points out they only had 10 minutes


Closes with saying forgiveness opens your heart. Hein says he doesn’t factor in religious values.


Lawyer for Jake points out he made statement without hoping to sway his judgement on sentence.


Hein issues sentence 8 life terms for aggravated murder. Max sentences for other charges including conspiracy for murder, aggravated burglary, corrupt acts.


Hein says he had issues with same sentences for George IV who went to trial and Jake, now drops a bombshell - gives Jake chance for parole after 32 year because Jake cooperated.

BREAKING: Judge Jonathan Hein gives Jake Wagner parole eligibility in 32 years for the murders of eight members of the Rhoden and Gilley families citing what he believed was an inequity in the plea agreement given to his mother and the LWOP given to his brother, George, who didn't cooperate

I can hearing crying in the courtroom. Judge Hein pondered whether there was some sort of gender bias in Angela Wagner's plea agreement since she only got 30 years

In her affidavit to disqualify Judge Hein, special prosecutor Angie Canepa had written that Hein doesn't like sentences of Life Without Parole - LWOP

He seemed to think AW was worse than JW, and that GW deserves LWOP even though he killed nobody,
JW shot 5 of the eight victims, AW shot none but they get similar sentences,
BW will be looking for a plea deal after today

#JakeWagner now moved to the defense table with two attorneys.


Kirk McVay, attorney for #JakeWagner, spoke about his earlier agreed-on sentence: max of eight consecutive life sentences without parole, with 160 more years. "Mr. Wagner entered his pleas knowingly.”


McVay continued: Jake knows he cannot appeal his sentence. He has worked with Jake for six years and noted his cooperation with the prosecution. He asked the court to acknowledge days already served.


#JakeWagner:" I have I want to say." Asked to face the victim families. Stood.


#JakeWagner speaking to victim families: "I used to be a manipulator." Two or three weeks after the crimes, he was filled with guilt, he said. "I asked God, put me and my family back on the straight and narrow path in whatever way you can."


#JakeWagner: He said he is glad he got caught. Speaking to the mother of victim Hannah Hazel Galley: "I ask if you are a woman of some kind of faith, I would ask you to read the Bible."


#JakeWagner continued: "Only a relationship with Jesus Christ will save you." Looking around the courtroom, he continued to talk about his faith. "I committed every single sin that the Bible lists." With that, Andrea Shoemaker exited the courtroom.

#JakeWagner continued: He said he cares for the victims and their sorrow. "I don't forget what I've done." He said he was "completely willing and ready" to pay the price for his crimes. He spoke without notes saying he'd been thinking about what to say for years.


Judge Hein asked #JakeWagner to wrap up his remarks then gave him two minutes to finish. "Forgiveness is a powerful thing," he said. He ended with this: "Jesus has a cost" but committing to him will transform their lives. "I do pray for you all.”


Hein told #JakeWagner he doesn't consider religious beliefs in sentencing.


Hein surprise: He is NOT signing the deal that was agreed on earlier. Instead, he is giving #jakewagner 32 years, with chance for parole after that. He now called a break.

More detail: 12 years on the gun charges for #JakeWagner, 20 years (concurrent) for the eight aggravated murders. Chance of parole after 32 years. Tears from the Rhoden side of the courtroom.

GW will be so pissed, he would have co operated for that deal, and the judge never once addressed with JW how easy it was for him to murder all those victims

I guess the judge will next hold a bench trial for Billy and declare him innocent.

I heard the Judge say Jake would be eligible to ask for parole at 20 years.
32 years once the extended firearms charges per the new case law that came in in December, 20 years plus 2x6 for firearms

Clearly, judge... does not consider the young lives lost, these people lives mattered. Children are growing up not knowing their parents' love. Generation of families gone, yet the Wagners' are more important... I think not. What is wrong with this so called judge? Something is not right. moo



The victims of the April 2016 massacre were Christopher Rhoden Sr., 40; his older brother, Kenneth Rhoden, 44; his cousin, Gary Rhoden, 38; Chris Rhoden Sr.’s former wife, Dana Lynn Rhoden, 37, and their children: Clarence “Frankie” Rhoden, 20, Hanna May Rhoden, 19, Christopher Rhoden Jr., 16, and Frankie’s fiancé, Hannah “Hazel” Gilley, 20.

From his remarks it seems there were issues with the plea agreements, and this judge was bought in to fix the problems, it may have been that not giving JW and AW more for there cooperation needed addressing as LE always wants people to cooperate,
But the system is completely unfair if a person uses there constitutional rights to go to trial and gets LWOP but hasn't murdered anybody but a 5 time admitted murderer gets 32 years minus the approximate 6 years pre trial taken off, GW gets no relief for those 6 years, JW will not even be 60 when he becomes parole eligible
