OH - Pike Co - 8 in Rhoden Family Murdered - 4 Wagner Family Members Arrested #89

They seem to be allowing the judge to re-write all the rules these days. Actually, in Ohio if you grease the right palms you can do whatever you want, laws don’t apply. Assume that’s the case here.
Betty P., you speak truth here. The court allowed the man that killed my daddy 30 years ago to keep it under wraps - all for a business expansion into the state (which did not happen). Between that and the Rhoden (distant relatives) situation, I’ve just about had it with “judge’s discretion” and call BS on it. It angers me so much that I often have to take weeks or months away from the board to keep myself sane.

Andrea Shoemaker: Victim children now see the Wagners on TV and she's had to explain who they are. "I want you to suffer," she said to #JakeWagner. "I hate you. You've ruined my life. YOu've ruined innocent children's lives."
SBM.

The pain and suffering came off Andrea in waves. It was so heavy I can’t believe she is still standing. I have given a statement like that and felt the advocates gentle touch on my back as I trembled. My heart aches for her. May she find some kind of peace.

Andrea was amazing. I was speechless at her passion and strength. May they all find some kind of peace.

What is going on in this case?
My mama would call it...."bad juju". Then she would tell me about how a good house cleaning would set it all right again. Imagine, when I was a child, I thought she was just crazy.

In this age of being canceled it's infuriating the rhodens deaths are not national issue. This may be one of the sickest killings in human history outside of war crimes. 8 people who had done nothing wrong to any of murderers killed cold blood while sleeping with infants

No last words no goodbyes just ping ping of the cowards silencers. To allow Jake a chance at parole has taken away the only sliver of comfort the survivors had -knowing hed die in jail. Now they'll have to fight even more in the future.
. Imo only 2 explanation for this judge
1. Freddy paid him off
2. Hein is a psychopath himself and admires Jake's murders

There's 0 legal precedent to this

Is also like to point out keeping Jake off camera and mike limited spread of public outrage. And allowed this to happen. If there was video of him describing these killings more people would know. Visual society transcripts don't hit the same

Can the feds charge him with gun crimes? Silencers def illegal under fed law

I thought he was charged with ordinance violations which is silencer violations. Dangerous ordances. Sorry maybe I am spelling it wrong. Feel free to correct me. I am too upset about Jake's chance at parole to care enough to double check.....2 Cents

Here is from my note:

charged (11/15/18) & arraigned (11/27/18) with 8 counts aggravated murder, 1 count of 1st degree conspiracy, 4 counts of 1st degree aggravated burglary, 1 count of 5th degree unlawful possession of dangerous ordnance, 3 counts of 3rd degree evidence tampering, 1 count of 5th degree forgery, 1 count of 5th degree unauthorized use of computer or telecommunications, 1 count of 4th degree interception of wire, oral or electronic communication, 1 count of 5th degree obstructing justice, 1 count of 1st degree engaging in a pattern of corrupt activity & 1 count of 4th degree unlawful sexual conduct with a minor.

and his sentencing
Hein issues sentence 8 life terms for aggravated murder. Max sentences for other charges including conspiracy for murder, aggravated burglary, corrupt acts. Instead, he is giving Wagner 32 years, with chance for parole after that. More detail: 12 years on the gun charges for Wagner, 20 years (concurrent) for the eight aggravated murders.

Does that answer your question?

Does that answer your question?

Yes, it was the 5th degree unlawful possession of dangerous ordinance that covered the silencers.

Also important to note is the 1st degree engaging in a pattern of corrupt activity, referring to the coordination of the family in planning, executing and covering up the murders. That's part of the reason, IIRC, that the Other Acts Evidence is necessary. It shows the clannish, enmeshed lifestyle this family lived where they influenced each other's lives and personal decisions to such an extreme degree, even to the degree of pooling all of their incomes to share expenses. The meetings where, periodically, one member of the family was able to make decisions for all the other members. Sort of like a cell of terrorists.

Planning
Executing
Covering Up

All separate and equally important parts of the crimes.

JMO, IANAL

I think they mean federal charges, versus the charges he was charged with or at least that is how I took it.

IOW, if the judge wipes out the charges against Billy, the Feds might be able to still bring some charges. Hope it doesn't come to that.

It would be interesting to know what kind of deal he came up with to get a plea deal out of Billy.

My device is messed up so not getting the Motions to post in my documents so it is harder for me to follow the case.

So Billy might take a plea deal?

Sorry for being repetitive - I have been expecting a trial in a different county.

I recall the judge mentioning something along those lines when he gave his recent courtroom speech. He said something about the prosecution refusing to negotiate and that the victims' families shouldn't have so much power over what was agreed to. I'd have to go back and find his exact words again, but his words gave me the impression he was upset because some compromise he wanted to take place was refused by the state. His motivation seemed to be to get the trial over with quickly. It was during that time he was ranting about some people(?) calling the murders the Pike County Massacre, doing a great disservice to the people of Pike County, etc., etc.. He also complained about how long the trials took, etc.

I seriously doubt it will show up in any motions. It sounded to me like it was something not discussed in court. Whatever it was, it was refused. JMO, he was or still is stripping out Jake and Angela's plea agreements and Billy's DP in order to put pressure on the state. I assume any failed plea negotiations that were made behind closed doors will remain off the record. Just a guess.

I'd love to sit down and transcribe his speeches in court because they do contain a lot of information. But I'm super busy these days.

I believe the judge is trying to push the prosecution into a plea deal with Billy. I remember either hearing and/or reading in a motion that the prosecution offered a 50 year plea deal which Billy would not agree to and the judge said there is no way he would impose a 50 year plea deal on a 50 year old man. Billy wanted a set number of years in a deal is what was said. Fifty years is a set number and it seems perfect for him.
He seems to have a lot going for his case at this time thanks to the judge, not sure he would want any deal now unless its one the judge conjures up for him.

I noticed. He seems very confident in himself, as if he thinks he has some control over what's happening to him.

JMO, it sounds like he's telling them what he wants them to litigate. It seems like he's trying to steer the direction the defense is going because he has some pre-determined way he wants this trial to go.

Maybe he wants to push them to a bench trial, maybe he wants to find a way to reduce the charges against Billy. IANAL, but it logically follows his interference to give Jake a reduced sentence and option for parole.

The judge is off, something strange about him. What’s in it for him to reduce the sentence? He clearly let Jake go on and on with his dramatic speech. In other ways he attacked opposing counsel for insignificant actions.

Maybe this is his first televised and noteworthy trial and he just wants to be in the spotlight??

Outrageous. Parole? Billy still no trial? Judges taking liberties.? WTH

They both look different. They forgot kids grow up fast and form their own opinions. Now maybe they realize they cannot control people. I don't know but I think they are only sorry they got caught. They wanted to live free with the kids and get away with it and they probably only regret the mistakes they made in getting caught. Many inmates get "religious" in prison as a way to cope in prison but never would have cared about God had they not been caught. Whatever. Wagner's make me sick. Need my stomach medicine.

Weary 2 Cents

That sounds about right. I recall reading about the 50 year sentence, too. The judge doesn’t understand who he’s dealing with. Billy doesn’t think he should be punished at all, so of course he won’t agree to that.

It doesn’t seem to bother the judge that Billy killed at least three of the Rhodens for no reason other than a custody battle that didn’t involve any of them. As much as I try, I can’t understand why an unrepentant murderer like that deserves redemption.
