Thanks Caylee. I appreciate you too. And I am glad to see that other posters are coming back to this thread because this case is not over yet. It is outrageous that it is getting close to 9 years since the Wagner Crime Family did these 8 murders and still they are not all 4 in prison for life.

1/3/25 Update: Mark Collins, attorney for Wagner, said he received the state's response on the "other acts" question to after midnight. That refers to other potentially criminal actions Wagner may have taken in the past - which he wants to keep those OUT of his upcoming criminal trial. In response, prosecutor Angela Canepa conceded that some of the bad acts evidence presented in the 2022 trial of George Wagner IV would NOT be used in Wagner's trial. Prosecutors don't want to engage much on death penalty given the previous decision to remove it is in appeals court. Defense argues it's not fair to start a case as death penalty then remove it later. On the "other acts" question, Judge Hein said those decisions will be largely be made at trial. He noted several times that he wants the case forward to "move the trains on time." Hein did not reveal a venue or date for Wagner trial.

*George Washington Wagner IV (27/now 33) – Guilty of all charges on 11/30/22 & sentenced on 12/19/22 to 8 Life sentences without the possibility of parole to run consecutively for the murders plus 121 years on other charges. Appeal filed 1/26/23.
*Angela Jo Wagner (48/now 54) – 9/10/21: Plead guilty to a plea deal to Counts 9 thru 22; Counts 1-8 were dismissed. Sentenced on 1/3/25 to 9 years for complicity & 3 years for tampering; 18 months for electronic interception; corrupt activity 9 years prison. Also gets 12 years for firearms specs. All different charges all add up to 30 years. Minor charges run concurrently to major charges to get to 30 years, minus 6 years 6 weeks already spent in jail. Wagner will have no appeal right.
*Edward Jacob “Jake” Wagner (26/now 32) – Plead guilty (4/22/21) to all charges & will testify at the trials & sentenced on 1/3/25 to 8 life terms for aggravated murder. Max sentences for other charges including conspiracy for murder, aggravated burglary, corrupt acts. Instead, he is giving Wagner 32 years, with chance for parole after that. More detail: 12 years on the gun charges for Wagner, 20 years (concurrent) for the eight aggravated murders.
*Rita Jo Newcomb (65/now 71) – Motion hearing on 12/2/19 entered a plea of guilty to all charges. Will testify at the trials. Sentenced on 1/3/25 to no additional jail time & 5 years of supervision & up to $750 in fines .
Fredericka Carol Wagner
(76/now 82) – 6/26/19: Charges were dismissed without prejudice.

2.5 years for a human life...HOW can the courts of Ohio let this happen!? THAT'S what I don't understand. Did the Prosecution refile to have Judge Hein removed after he did this, reduced eight life sentences for 2.5 years for murdering, in cold blood, each victim? How could the Ohio Supremes deny amotion now, after this injustice was done?

Prosecution wants to change what's in the indictment based on previous evidence in trial, including the actual address of one of the crime scenes (which is in Scioto not Pike County).


Canepa says she wants to make the indictment more accurate based on what happens. Defense says the timing is questionable.


Hein will issue a written decision - says he needs to decide if prejudice against defendant. Wagners lived in three different places over course of events, lived in Adams County when murders happened. Moved to Scioto. Evidence destroyed in Adams but hidden in Pike.


Now on to other acts - or alleged crimes possibly not prosecuted by the family - can be admitted. In George's trial it came out family burned down houses, crashed cars, for insurance money and committed forgery.


State wants to show family as long-standing "criminal enterprise" that made next step to the murders.


Defense wants to wait for arguing and severing out some charges, but Hein wants to push ahead. Defense wants tampering evidence, forgery (of custody documents), interception communications (hacking into social media) charges dismissed and severed out.


Defense says Billy Wagner was not involved in those crimes etc. Charges 15-20 is what they want dismissed.


Canepa points out he still faces complicity and conspiracy charges and could be brought under that.


Hein says he's told lawyers he does NOT want this trial to go 10 weeks like George's. Says there was lot of evidence in last trial that may not be as relevant.

Now arguing over how court will handle jury view if venue is changed. Hein ruled it should be moved, but victim's family appealed and waiting on that decision.

In addition to venue appeals decision that's due, prosecution also has appealed Hein's decision to remove death penalty from Billy. Trial can't take place until that happens.


Defense asking for permission to get Billy a specific hearing aid during the trial - he's having issue clarifying words, it's not a volume issue.

Defense lawyer Marc Collins also asking about judge Hein's voir dire jury selection process.


Hein says he will be assertive and lawyers will know what they can and can't do very clearly.

Defense lawyer Hayes asks for help with logistics and possibly nail down trial dates even with everything on hold.


Hein says we're kind of "in limbo or purgatory whether you think we're being punished." But hard to schedule given the current situation with appeals court.


Defense's Collins going through the list Hein put out on possible issues. Doesn't mind remote witnesses, but Billy still wants to go through jury process at least for now. Two sides will come up with list of stipulations, or agreed upon facts.

In a one-hour hearing in Waverly, Ohio, Wagner's attorneys confirmed they've broached the topic of a plea deal with him. "Right now we're going forward with the trial. Mr. Wagner indicated that's what he wants so that's what we're working toward," lawyer Mark Collins said. 3/8


Wagner's attorneys also indicated that he'd prefer a jury trial to a bench trial. On Jan. 14, Visiting Judge Jonathan Hein floated the idea of a bench trial -- one in which he alone would determine a verdict. 4/8

A bench trial is possible in the case because Hein last fall took death penalty off the table as a possible sentence for Wagner. (Death-penalty cases require juries.) Special Prosecutor Angela Canepa is appealing that ruling. 5/8


The other appeal objects to Hein's earlier decision to move the trial out of Pike County. Hein indicated Friday that he's not yet determined the new venue. "I'm hunting," he said. 6/8

Agree!! So I didn't waste more than about 7 min watching this and I had to listen twice to the response of victim atty's reply to judge who is being nice for a change. Then could not hear AC very well. Are we back to the jurisdiction of the crime scenes??? Does anyone else think that we on here know more about this case than the judge and maybe defense attys...don't know how long this group has been with him...just notice different faces. Surprised BW doesn't want a bench trial. Hein would like it done tomorrow taking no more than 6-7 hours to complete...smh. So he's giving hints???

Agree!! So I didn't waste more than about 7 min watching this and I had to listen twice to the response of victim atty's reply to judge who is being nice for a change. Then could not hear AC very well. Are we back to the jurisdiction of the crime scenes??? Does anyone else think that we on here know more about this case than the judge and maybe defense attys...don't know how long this group has been with him...just notice different faces. Surprised BW doesn't want a bench trial. Hein would like it done tomorrow taking no more than 6-7 hours to complete...smh. So he's giving hints???
I'm surprised he doesn't want a bench trial, GW got the harshest sentence of the 3 so far, and at sentencing the judge said in a round about way that GW almost deserved his sentence because he went to trial versus JW and AW who cooperated, he must have forgot about GW constitutional right to a trial,
if I was BW I would be begging for a bench trial after the sentencing of the other 2

I'm putting my faith in a jury. The jury will care about 8 murders.

Billy seems too entitled and stubborn to accept that he has to pay for planning the murders of 8 innocent people, killing one or two in their sleep. He’s such a hardened criminal that he’s able to easily convince himself he didn’t do anything wrong. He has no conscience. It’s why it’s so difficult for him to agree to any plea deal.

I pray the judge doesn’t acquiesce with a bench trial. Billy will definitely kill again, JMO.

New here, but have followed this case since the murders occurred. GW would have to request a bench trial. He's not facing the DP (last I read), and jury trials are easier to appeal upon conviction, and he's already told the court that he wants a jury trial.
