Oh I noticed. There were also a couple of times where it appeared as if he was winking at the defense team. He’s confrontational for no reason most of the time & seems to enjoy testing an attorney’s knowledge or using them to convey his dislike of certain legalities. He raked the victim’s attorney over the coals about victim’s financial subject matter but didn’t bat an eye over Billy’s 68k hearing solution. What, solid platinum earbuds now? He should be able to hear his son complaining in WI for that kind of money.

He enjoys testing an attorney’s mettle & knowledge, especially if they’re sitting to his left. Did you observe what looked like him winking at the defense team 2 different times? I wasn’t sure if those were winks or just odd facial ticks.

BW’s hearing is not really a problem. My husband had an inner disease that he had to have surgery on that caused him deaf in one ear for over 35 years. No hearing aids would ever correct the problem . My husband had to turn his head if the room was noisy to hear . As for a courtroom or church he had no issue hearing . I am sympathetic to people with hearing impairments.
IMO BW’s attorneys are trying to milk his hearing problem.

He just seems like such a horrible unlikable man! He was the one actually talking over her. Why is this kind of behavior allowed? He deserves no respect.
I wish the appeals court would watch the videos of how Hein’s conducts these hearing , how disrespectful he is and how he complicates issues by going off in different directions, which I think he does on purpose to throw the state off track.

I have a question. If George ‘s appeal is granted before Billy’s trial starts can that delay Billy’s trial ?

I am not sure that if George got granted an appeal it would make a difference in when Billy's trial would begin. There could be a reason it would I just cannot think of one at this time.

Visiting Judge Jonathan Hein added three additional hearing dates for Wagner after one last Friday. They'll be at 10 a.m. June 27, July 25 and Aug. 22 in the Pike County Common Pleas Courthouse. That's in addition to one already set for May 30. 2/5

Hein worked on the schedule with lawyers at the end of Friday's pretrial hearing, after learning that an appeal in the case is expected to move forward June 12. 3/5

That's when the Ohio Court of Appeals is expected to hear oral arguments on an appeal of Hein's decision to remove death as a possible penalty for Wagner if he's convicted, Wagner attorney Mark Collins said. The appeals court is expected to rule on that 30-60 days later. 4/5

Wagner is facing eight counts of aggravated murder and 14 other charges in the 2016 shooting deaths of seven members of the Rhoden family and one future member. His trial, earlier scheduled to start Jan. 6, has been delayed by challenges of Hein rulings. 5/5

I wonder if the side that loses on the DP appeal will appeal to Supreme Court. I kind of think so.

Well, at least Billy stays in jail as Mark Collins, et al continue to work overtime to delay his trial. They can drag it out as long as they want, but it doesn't get Billy out of jail. At least I hope Collins isn't working on a scheme for that as well.

They're all in prison or jail and will remain there for a very long time.

I thought the DP would be removed if JW testifies.
It would have if Jake testified. Judge Hein removed Billy's DP so Jake might not feel the need or want to testify any longer, or he may still.

Is there some way their testimony from George's trial can be brought it if they don't? I keep wondering that. I do strongly feel that if George's appeal were granted that Jake would not testify against him the 2nd time. Could Jake's testimony from the first trial be brought in.

It seems there is less evidence on Billy than on anyone without Jake or Angela.

I was wondering the same, if parts of their transcripts can be read to the jury. Probably not because the defense couldn't cross examine them to help mitigate their testimony against George.

Billy dealt with their murder truck, gave it to his niece. Got caught in a lie.

From what we learned in George's trial and discovery, I'd say yes. There's still plenty of evidence to convict Billy, JMO, including other witness testimony.

There's evidence of his involvement in planning the murders, including acquiring and fitting out the truck that was used and later giving it to his cousin. Also evidence of his close involvement in the lives of his sons and their families, co-mingling of finances, etc.

I'm sure there's more but I haven't reviewed the evidence lately.

Also, would it be up to the judge if the previous testimony of Jake and/or Angela could be used in court in Billy's trial. If so, I'm not sure he would allow it.

Same with the Walmart shoes. There's a lot of digital evidence, too, as well as testimony from other witnesses, e.g. relatives, people who saw the guns in his room at FW Farms, who overheard his conversations with incriminating evidence.

Yes, there is evidence against him. I think he would be convicted, but I wonder if it would be of something lesser without their testimony.

Good point. With 22 charges the "lesser" charges might not ALL stick. What matters is that the murder - and it is aggravated burglary I think - that the murder and burglary charges stick. Important to prove to jury that Billy was actually AT the crime scenes. Jake's testimony had him killing Gary, Chris Sr. and Kenny.

I can't imagine Jake passing up a chance to be the center of attention and talk.

Everything they had against George that worked for prosecution should be against Billy . With the honorable judge Hein presiding I feel he’s going try to rule against the state as much as possible because he does not agree with the sentence George received.
