Yes, there is evidence against him. I think he would be convicted, but I wonder if it would be of something lesser without their testimony.
All they have to do is convince the jury that Billy was at a crime scene that night. That's all it takes for the murder charges, according to Ohio law. There may be some of the lesser charges that will drop, like something related to his weapon, possibly the charge related to the home made silencer, etc.

JMO, they have enough to convict him on charges related to the cover up, too.

He also says they call him preacher and claims God is working in his life.

He is mentally ill in my opinion.

I think this is all a show for FW. He wants her support and money and she is very religious so this is a good way for him to go about it. He lied for years that other monsters, not him, did the unspeakable.

He probably also thought she would appreciate him insulting the victims families. The families have never heard a word of sympathy or apology from FW.

So is everything going to be decided June 12th, all the arguments laid out and the time, location AND the DP charges decided/ruled on 30-60 after the hearing?? This is the MOST ridiculous case, as far as getting it to trial, I think I've ever seen. Almost 10 years of baloney just to get to trial!!? Is Hein going to be THE judge presiding at trial?

Correct, he's the one who appoints the replacement judge for these trials.

Presiding Judge Jonathan P. Hein replaced (on 5/29/24) Judge R. Alan Corbin [health reasons].

Right. There was a previous judge who only served for one hearing, IIRC, then Hein replaced him.

And he reduced EJW's sentence and took away the DP for G"B"W. I doubt the appeals from the P to reinstate the DP charge will work with Judge Hein. So does that mean EJW won't have to testify against his father? Or does he still have to because of his brother's sentence of LWOP? Is this whole "deal" EJW made negated because of Judge Hein's rulings?

Highlights of allegations:

  • Jurors who were more likely to sign a death penalty verdict and were “statistically more likely to enter a conviction” were selected and then the death penalty option was removed.
  • “Of the jurors who did serve, two of them had direct personal connections to the victims that Jake Wagner and his father, Billy Wagner, shot to death in their sleep.”
  • “For weeks at the start of the trial, the State saturated the minds of the jurors with the images of faces they had seen before in their daily lives, now gruesomely dead, and the reactions of family members who lost loved ones. When the State finally got around to admitting evidence related to George, it was largely meant to connect him to his family members through prior crimes and wrongs under the guise of establishing an ongoing scheme to commit crimes together or to show that he and his family owned a significant arsenal of firearms. Jurors were even given some evidence of firearms the State admitted had nothing to do with the case at hand, which had either been withdrawn from evidence or excluded by the trial court.”
  • During closing arguments, “the State accused defense counsel of knowing that George was lying and coaching his testimony.”
Not meaning to offend but I agree with the defense. George should get a new trial with actual evidence and not depending on two pathological liars like Jake and Angie.

There was more evidence against George than the co—defendant’s testimony.

George is heavily all over in the LE secret recordings incriminating himself. No way he had no clue about the plan. Sat by and let it happen at least.

It is beyond a reasonable doubt that he was privy to the family murder plans.

Conveniently in bed at midnight he said in Montana. On the stand he says he was in bed at 10:00pm with headphones on so did not hear anything but also says his room faces the front door and he could see people come and go. His story changes.

Thanks for that correction. I’m following too many cases these days. That said, it’s the Ohio Supreme Court, so ….
