OH - Pike Co - 8 in Rhoden Family Murdered - 4 Wagner Family Members Arrested #89

  • #901
Who ARE BW's lawyers anyway and how have they been able to delay for so long? I still can't believe Junk is the judge on BW's trial. Is being the DA/prosecutor that originally investigated and charged the family to prosecuting, along with AC, AW, E"J"W an GWIV...how can Junk now be a judge at BW's trial?
This is how the courts operate in many of those counties in southern Ohio. It’s how Pike County operated when Junk was prosecutor. It’s a system that can make people feel they’re above the law. JMO

The defense attorneys are accustomed to working in that system. Billy’s lawyers have worked closely with his mothers own attorneys.

JMO
In your first link...

"[Judge]Hein defended his decision, noting that Jake Wagner’s cooperation, including testifying against his brother, warranted a chance at parole. He also criticized Angela Wagner’s 30-year sentence as too lenient, given her failure to stop the plot, and suggested gender bias may have influenced her deal."

Is he seriously saying because E"J"W testified against GW (making sure to say he didn't shoot anyone) and is allowed to spout Christian values to the family members of his EIGHT victims (not to mention the THREE children affected) in court, he only deserves 32 year before he can be eligible for parole!!? In what alternate universe is Hein living in? And the Ohio Supremes just backed him up!? Shocking😡 IMO

Only thing I agree with is AW got off way too easy for what she did, aided and abetted the murders of EIGHT human beings and the abosolute destruction of THREE children's lives.

Now Billy's case is in jeopardy. What in the world is going on in Ohio!? EIGHT people slaughtered in one night at 4 different locations, all planned out and executed by a murderous family of 4 and this is all the justice Ohio courts can muster? It's crushing to the soul. AJMO

The majority of the Ohio Supreme Court has become grossly incompetent in recent years. These kind of decisions are not unusual. Many experts feel nominees in recent years don’t have the necessary experience to serve.

Per my notes:
Defense attorneys Mark C. Collins, Kort Gatterdam & Thomas F. Hayes.

And it is Presiding Judge Jonathan P. Hein. The court site just has NOT updated the "Event Judge"...

Why is Judge Junk scheduling and cancelling hearings for another judge's (Hein) case? What's the difference between a "Presiding" Judge and an "Event" Judge? Given his history on the Rhoden/Wagner case isn't Judge Junk the last judge who should be involved, in any way?

I'm trying to find the criminal court docket for George W. Wagner III. The only criminal cases listed are one in 2009 and another in 2015. BW was arrested in 2018 and is still going through the courts in 2025 but nothing using the Pike County Court Records site. I know they lived in a different county when arrested (well wasn't BW living with his mother in Pike County?) but weren't they all actually charged in Pike County?

Junk is not the judge. Things are delayed right now due to Judge Hein it seems and appeals that had to be filed due to his rulings on the DP. There is also an appeal on Jakes sentence, but I am not sure if that has to be ruled on before Billy's trial can start.

We've had a good run of justice this week with the Kohberger plea and now Brooks Houck convicted in the death of Crystal Rogers (he got the max available--life). Now may justice prevail in Pike County for the Rhoden, Manley, and Gilley families. Ohio, get your act together!

I believe because he is the sitting judge of Pike County that it automatically defaults to him.

In Feb 2023 it's listed as Junk recusing and retired Judge Corbin taking over but Junk was still listed on many of the Status Conferences and Motion Hearings, as if he's the judge at the hearing. Even after Judge Hein took over from Judge Corbin, Junk's name is listed in places as Judge: . It just looks very sloppy to still have his name on events when he recused in 2023.

Yes, took forever to change the court website to his name. Just stupid mistakes.

No way, this has to be an error. Not legal. A prosecutor can not both prosecute and then also try a defendant as the defendant's judge. Bias is everywhere....... Supreme court of Ohio will fix this disgraceful mess.

I believe CO is correct. In Pike County whomever is in charge of how the data is processed to appear online, hasn't bothered to fix an obvious error in data entry. Junk's name is still showing up on some Docket entries. Maybe because the two judges (Corbin and Hein) that have worked it since Deering retired are retired themselves and it's too much bother for the system to have correct info entered in that type of situation. In this day and age, technologically how hard can it be? Rhetorical question😉

It is out of control but I am 100% sure Junk is off this case. For technical reasons his name appears because it's his court.

Key Differences in Authority and Objective

The primary distinction between a prosecutor and a judge lies in their roles as advocate versus neutral referee. The prosecutor is an adversary representing the government, acting as an agent of the executive branch. Their objective is to successfully prosecute the case, which requires building a case and presenting persuasive arguments for a conviction.

A judge, as a member of the judicial branch, must remain detached from the contest, ensuring the legal battle is fought according to the rules. The prosecutor’s authority is rooted in discretionary power, such as the choice to charge an individual or offer a plea deal. This power is exercised early in a case and is subject to few checks.

The judge’s authority is judicial, centered on interpreting the law and making binding rulings that control the proceedings. They decide what evidence the jury can hear and ultimately impose the sentence. While the prosecutor seeks a conviction, the judge seeks to ensure a fair process, and this separation of powers is a check within the legal system.

The judge serves as the impartial arbiter in a criminal case, ensuring proceedings are conducted fairly and according to law. Unlike the prosecutor, the judge does not represent either side. Their objective is to uphold the justice system’s integrity and protect the accused’s constitutional rights. This neutrality ensures the outcome is based on law and the facts presented.

It’s a small rural county and a very big case with worldwide media coverage. No doubt he’s still paying close attention to the case, it’s impossible to avoid.

It’s just the most bizarre case I’ve ever followed. It’s taking so long with the greatest delays and interference coming AFTER two of the defendants giving highly detailed and credible confessions.

It’s like someone tossed a bomb into the midst of the legal proceedings, disrupting a legitimate legal process that should have been completed by now.
Awith the exception of Prosecutor Canepa, everyone in a position of authority to get the final trial back on track has either stood by silently, doing nothing or actively worked to destroy the plea agreements and set the confessed killers free.

It’s a stunning example of either gross incompetence or corruption, JMO, with no end in sight. Another shocking example of our laws being subverted to suit powerful people.

It’s an every day occurrence in Ohio now, not just with this case, but with many laws and legal cases active in the state. The state government ignores the rulings of its own Supreme Court. Billionaires who are unhappy with a law and an active lawsuit preventing them from moving a professional sports team subsidized by a local government simply arrange the state General Assembly to pass another law stating the owners can move the team anyway.

It wouldn’t be surprising if someone pulled a string and had the Ohio House and Senate pass a law declaring all the Wagners innocent and their confessions null and void. And DeWine would sign it. That’s not an exaggeration, JMO.
