He did his usual smiling at the judge at the beginning and
end of it.

He's a charmer. When the gruesome details of the murders of 8 people are revealed in court, the public may have a less flattering opinion of him.

Bless Geneva Rhoden, she's always there. Len Manley, too. He was there yesterday.

I still can't fathom losing so many members of your family - children, grandchildren, daughter in law, nephew - in such brutal murders, all in one night. I would lose my mind.

The details have already come out, no? The number of GS and places where they were GS have been released

No, those are very basic, minor details. There will be much worse to come, including details of how the victims were left, how they suffered, how the killers plotted and carried out the murders, how they handled the children and infants, how they covered their tracks. Details about the weapons, the wounds, the gore-strewn homes...

ETA: We'll probably get to hear voice mail messages, read texts, etc. as Jake plans and carries out his deception. How he badgered HMR, how he lied to her and her family, how he tricked her into giving him SR and got her to stay at home so she would be there when he and his family came to murder her, her mom and her brother.

It will be very interesting to finally learn how he planned everything, how he treated HMR and the Rhoden family.

JW may be perceived as a little less charming to the general public if I heard this correctly.

I did not see the entire hearing, but in one of AC's state's response to one of the defense motions, I thought I heard AC say "there is past evidence of violence between Jake and one of the deceased". I'm assuming that refers to domestic violence towards HMR.

Did anyone else hear that?

Yes. AC doesn't let slip any opportunity to remind the public what awful things they have done.

I truly cannot stand or understand the GRIN on his face. This is just so funny.....NOT.

ALSO, What the Public (we) know must be presented to the jury in each case.
We haven't seen any thing more than a listed outline.
Surely the trial(s) will detail all evidence presented.

Defense wants "counsel only" restriction lifted on evidence related to handwriting analysis. Also want them to remove redactions
Am I to take this as meaning the handwriting analysis report by prosecution given to defense has redactions?

I believe that the redactions were on the first 8 pages of "RN's" Grand jury Transcript where she was not actually a witness at that point. The judge has the entire transcript and will decide if the redactions are appropriate and decide on the motion.

It was said during the oral arguments in regards to Motion 23, also theft was mentioned.

DEFENDANT'S MOTION #23 MOTION TO EXCLUDE ANY EVIDENCE RELATING TO OTHER CRIMES, WRONGS OR ACTS FILED

Canepa:

" I think he threw into the Motion that there is some evidence that Mr. Wagner was violent with one of the victims prior to the homicides. And that there was some theft issues there's certainly other, other acts, um..information. "

I thought I heard theft from neighbor(s). I still need ear buds.

ETA: BRAVO to both of you and everyone.
Thank you

Sorry. You could be totally correct. I'd assume after thinking longer they did handwriting analysis on other defendants in this case.

I should have thought about it before responding. Thank you.

There is theft involving Billy:
Father charged in Pike County murders had past brushes with law

"..Billy Wagner pleaded no contest to two counts of receiving stolen property (another was dismissed). One count involved a stolen dirt bike, the other alleged he received various stolen property from several entities, including Carter Lumber and Eastern High School.."

"..Among the items listed for seizure on the 2001 search warrant were a variety of mechanic and carpenter tools, a concrete saw, a portable generator reportedly stolen from a high school, dirt bikes, a compound bow and a cross bow.."

In another article I read, the stolen items were found in Billy's shed and after he was caught red handed he asked the officer: "can I just pay a fine? "
Entitled much?

I think AW had the same charges with Billy. The records as I'm sure you know are on Court View. Ugh. I know it wouldn't have stopped this massacre, but I wish they got more than a don't do that again.

Motions to be heard in Jake Wagner's murder case in Pike County (with clip)

October 8th 2019

"WAVERLY, Ohio (WKRC) -- Jake Wagner returned to court for the latest round of motions hearings in his murder case. The judge heard arguments on approximately 40 motions....

The motions mostly dealt with what could be included or excluded during trial and what language can be used. For example, there are two phases to a death penalty trial, often referred to as the guilt and mitigation phases.

The defense didn't want the first phase to be called the guilt phase, calling it prejudicial.

The defense also didn't want the prosecution to be able to include "past acts" allegedly by Jake Wagner to any of the murder victims. They did not detail what those might be.

Crime scene photographs were also discussed. The defense said it didn't want too many of them shown to the jury. The prosecution argued that the defense was basically trying to keep them from showing any of them.

Judge Randy Deering is taking the motions under consideration. He didn't rule on any of the contested motions. The prosecution agreed with a couple of them."

Both of them had Tampering with Evidence charges dropped for lack of speedy trial. As for the stolen property, Billy got off lightly, jail suspended and off probation 2 years early. (Summarized if anybody interested doesn't feel like going to Court View)
