That is so good of you CC I appreciate your dedication to the families and everyone's hard work.

I think it's important to get an idea of what Angie was saying to Rita. Obviously Angie is worried about what is going to come out at Rita's trial because of how it will effect her and the others. It's all about Angie not what is best for Rita. I have to wonder if Angie set Rita up or did Rita go into it with eyes wide open? Hope a trial will reveal it.

Thanks, CC! Is this a transcript of AC talking in court or Gerlach? Was it in the latter part of the hearing or earlier? Thanks for clarifying.
I did one transcript with Grelach talking about the box of important stuff and he mentioned a Texas Website is where they downloaded the custody documents from. Then I did the transcript where Canepa read off the dates of Angie's phone calls and she gave some information of what the phone calls were about.

According to Canepa Gerlach found out about the box of important stuff from Angie telling Rita on one of those phone calls, then Rita told Gerlach.

This is good because appparently there will still be a trial where hopefully we can learn some things.
11/20/2019 JOURNAL ENTRY -- JURY TRIAL SCHEDULED TO COMMENCE IN THIS ACTION ON NOVEMBER 18, 2019 IS CONTINUED TO A LATER DATE TO BE SCHEDULED BY THE ASSIGNMENT COMMISSIONER; UPON FURTHER AGREEMENT OF THE PARTIES, A HEARING IS SCHEDULED FOR MONDAY, DECEMBER 2, 2019 AT 1:00PM

Ok, I remember which part of the hearing they discussed these things. I didn't recall them talking about having a nickname for FW, but that's possible. AC went on for quite a while about the ways AW manipulated things around so she could talk to as many people as possible. There was also a part where AC describes how AW was able to "conference call" with JW.

That was a long hearing. We have the video posted of it in 2 sections, but the news media IIRC had it all in one video.

Is Rita Newcomb paying for her ankle bracelet each month, someone is paying attorney fees?

Yes, there's some hope they may reach a plea deal or somesuch on Dec. 2. Let's hope that happens. What we've heard about the phone calls doesn't look good for RN.

It was also interesting to read about Gerlach's argument in his Memo to the court about AC's objections to the Dailey evidence dump. He told the Judge that the 198 pages of Dailey evidence was NOT going to be introduced during RN's trial, but was only going to be used to refresh Dailey's memory (assuming Gerlach is putting him on the witness stand). That sounds really odd.

‘IMO it should not matter whether he is paid by the defendant or taxpayers. There are court rules for both sides regarding sharing information in a timely manner and to whom they must be shared, regardless of the distance between offices. Defenders (unless Defendant is indigent) get paid more than prosecutors and it would only cost him $50-$60 for a currier OR it could have been delivered electronically to the team and originals hand delivered to main prosecutor. IMO, it was a delay tactic, not a logistical one. Remember, the state has the request for reciprocal discovery on the bottom of each of her motions (copies are already in our timeline).

Oh, believe me, I totally agree! I've been harping for reciprocal discovery since they were arrested.

As far as a nickname for Fred, the only thing that came up was Angela referred to Fred as Freddie. The phone call part is at the end of part one of the revocation hearing. I don't know if this is the video where Gerlach talks about the box of important stuff. I can find where that is if anyone wants to listen to it.

Yes there was a conference call that Chris N. set up so Angela could talk to Jake.
Notice how Angie doesn't use Fred and Robin to set up calls, she just uses her mom and son. I don't believe Fred and Robin would go along with it.
Nothing was mentioned about Angie talking to Fred. Robin does visit Billy but I don't know who else she visits.

Ha! I brought that up also in an earlier post, that Gerlach said he wasn't going to use--they call them the "Daily Files" -- in court because they were only for Bruce Daily to refresh his memory. I had pointed out how ridiculous it is to say they won't be used in court but then to turn around and say that the witness IS actually going to be using them when he testifies. Flies in the face of reason.... picture bird flying away.....

<modsnip: quoted post was removed due to no link>

Her mother is paying Gerlach?

It took RN a few days just to get out of jail. iirc

I thought her mom was bedridden too.

That call between Angela and Jake happen according to your transcription was December 8th and Chris Newcomb set that call up, JMO

That's also my assumption - that AW and FW are not speaking and that FW would never go out of her way to help AW.

Here's my question: Did Gerlach know AW and RN were having these conference calls? Inquiring minds want to know. Did they know they were being recorded (probably) and if so, did they share misleading information for prosecutors to hear? If so, that was very dumb and risky as they aren't smart enough to know if they were incriminating themselves.

Is there a link that RN's mom is paying for her lawyer?

Win or lose who ever is paying those attorney fees for RN has lost that money for good, am I right or can they recoup attorney fees from the state if RN wins?

Fred knows (when she is not telling the media they are innocent) that Angie had the means to stop the crimes at any time. Fred blames Angela is what I believe. None of Angie's phone calls mentioned her talking to Fred. I have never seen video of Fred at one of Angie's court hearings. I have seen her in court for one or two of Billy's, Jake's, and GW3's hearings.

Normally there are signs up in jails warning inmates that phone calls are recorded and telling them not to incriminate themselves. That what they say can and will be used against them. Angie knew the calls were recorded but when no one said anything for 6 months she probably thought no one was listening to them. That's when she started talking trial strategy and I don't think she made it up to throw off prosecutors.

She told Rita to not testify against them, she told Rita how to explain away the custody documents, she told Rita who her attorneys think may have committed the crimes, she told Rita about her attorneys' trial strategy. Angela's attorneys must be livid. They did not seem upset she lost her phone and mail privileges, (one of them had sent a letter to the other). Her attorneys must be relieved she is off the phone.

Yes Gerlach knew Angela and Rita were talking.
Canepa very specifically said in court that, aside from the search affidavit, Gerlach knew about the box of custody documents from phone calls from Angela Wagner. Angela told Rita, Rita told Gerlach.
It is my impression the box was found during the search of Angela's house.

My 2 Cents from listening to court hearings....
