All jail calls, State prison calls and Federal prison calls can be used against a defendant in court.

You can even get other charges added if you are trying to plan crimes over phone or video.

Also, letters you write can be used against you.

All inmates are normally advised of this and warned all calls are recorded.

Inmates even must be careful what they tell other inmates who might be snitches and use the evidence against you to lighten their own sentence.

Wagner’s attorney has raised concerns about “jailhouse snitches," saying inmates at the Franklin County Jail where Wagner is being held are trying to get information out of him about the case. The so-called “snitches” are trying to draw the information out of Wagner, his attorney says, so they can trade it for “liberty in their own cases”.

I understand this too and I think she tries. Did you see the look on George's lawyers face as she asked some questions. Like a kid finding out he's getting what he really wanted for Christmas. Then writing things down and whispering to George. I mean he seems like he is sitting there critiquing her the entire time and giving off many facial expressions that seem inappropriate also. Feels like a bully and then she finally stands up to him. I know she is supposed to not let this get to her, but after all this time, I think even the best of us get flustered with those shenanigan's he is pulling.
I like her, and I am rooting for her every step of the way. You can't be in law without having a strong backbone and she has been in it for over 30 years. That speaks volumes. I am a fan! We're human, and I know that bullies are very difficult to deal with and even harder to ignore.

do we know if there will be a penalty phase upon conviction, even if the DP is not a sentence will there be a penalty phase for all the charges, I imagine there are a lot of family members who wish to give victim impact statements

He was making a "statement" ...so to speak..., doubt he will be fired. just my opinion

I guess the judge didn't see it that way.

There will be no penalty phase trial if the DP is off the table. Let's say George gets convicted of XYZ but the DP is off the table.

What will happen is that a sentencing hearing will be set for George and at that time the prosecution will argue for the harshest sentence and the defense will argue for the lightest sentence.

It is at this sentencing hearing that the judge will listen to the victim impact statements. Expect alot, there are a ton of relatives and friends.

No wonder this is taking a long time,,,between starting late everyday and ending fairly early most days and all of the interruptions, they hardly get more than 4-5 hrs in each day. For those on the jury who are still working and took or was granted a leave for this trial, it's going to be a long one.

Personally, I figured 3-4/hrs per day of real court time. When starting late, break times, lunch, break, side bars. This is our court system. And we wonder why prosecutors would rather a plea; many different obstacles to work around/with. I think they're now a week/8days behind.

I think they might be done, I can't find a link for the feed on the L & C channel. They didn't even bring the audio back up, just saw everyone standing and grabbing their jackets.

Edit; In fact, there's nothing about the trial on their channel right now. Did the judge throw all media out?

Jmo the fb block and not block evidence complete waste of time. I currently have close family members blocked cause they get on my nerves with fb sometimes but talk to them every week. The tattoos we seen how well that worked in the Casey A trial. When the state tries to make everything and anything evidence then in my opinion weakens a case. Jmo
