I want the defense team to provide GW4 the best defense they can come up with. Then, there is little that can be appealed.

Is this an OH thing? I watch trials all of the time and the state always plays a defendant's interview when they don't testify. The only time they don't is if the defendant was not properly mirandized.
The state always wants to show the defendants interviews with LE especially if they lie in the interview, the prosecution could have played GW interview if they chose to, as they haven't it says to me that his interview at the border has nothing in it which helps the state

There was a similar murder case a few years ago in Ohio...Summer Inman was killed by her husband, FIL, MIL. I believe over custody of the children. The defense attorney for one of them did an excellent defense...,but guess what...that Inman person is serving LWOP (both husband and FIL. MIL had a lesser sentence b/c she confessed and led LE to the body).. I want the same thing to happen here.

Oh well. The recording is not a factual statement, so it can't be submitted as such. It has to be subject to cross examination. GW4 is the only one who can do that.
GW is not required to do anything, the state has the full burden to prove all charges, the state has the choise to play his interview they chose not too

Being Mirandized: The purpose of the warning is to preserve the matter of the admissibility of the suspect's statement in the event of prosecution and trial.

Nor is the state required to allow defense to play his interview. So everybody gets what they want. GW4 doesn't have to testify, state doesn't have to play the interview. Win-Win.

I bet he either wasn't mirandized or there's something in there that has to do with G3's trial that they don't want out. I feel uncomfortable about it, since we don't know why. Humans are fallible.

I believe they were all mirandized at the border. No way they didn't do that after all the trouble they took to get the recording devices and move from one state to the other and separate them for this interview. I want to say the BCI agent was asked about that also and he said they were read their rights. I'll see if I can find it!

The state was showing how their investigation unfolded. They were showing that each step of the way, this happened and made us look further into something else. Billy's interview in the car was self explanatory.. he was all over the place telling them to look at this or that drug dealer. They did look into that, but it never made sense. I think they played that interview to show how and WHY they proceeded to focus on the W's, but also to show they were not having tunnel vision. They looked into all those people he threw out and it didn't add up.

Then they played Angela's border interview to show she lied about the shoes. That was what was most significant about all 4 border interviews. She got rattled when they brought up the shoes, the shell casings, and the custody docs. I think they all 4 lied that day. They could play all of them, but that wasn't the point of playing her interview, it was to show she admitted to buying the shoes and throwing them away. I believe previously it was said the boys both said they never saw those shoes. Angela gets rattled in that interview and asks for a lawyer.

The state wasn't playing it just to show she lied, they were showing how they went from point A to point B in the investigation.

The defense wanted to play Jake's interview to discredit him before he took the stand. They all lied before so it really was low.. George lied too, but George won't take the stand to be able to be asked about his lies so playing his to attempt to separate him from the others and show BCI said he was different.. yet he did lie too. He had the same story Jake did.

I must have misunderstood what was said Thursday or Friday. I thought George had 2 what I called ticket but maybe it was infractions for refusing food where he's locked up and not while he is here in court.
I figured he put in his request for lunch--his ticket.

I understand that, but G4 is the one on trial. He's the one I'd want to hear most. We heard those garbled truck tapes. I'd just like to hear what he had to say, it's perfectly legal for them to submit them. If they mirandized him, then something is in there about G3 that they don't want out yet. Personally, I'd like to hear G4's border interview, even if he just hims and haws. If he had JW's same story, let's hear it. We've heard the one's not on trial, lie. G4 has not been coached by the prosecution either. Jw and Aw have. You could tell with AW especially. She was trying to please but put her 2¢ in about them saving S from certain s/a, same as JW, who seemed to forget a lot more than his older mother.

Yes, that was another trick the defense pulled. Making demands that required a lot of busy work, tying up the prosecutor's office beyond reason. Defense just sat around whining and finding more busy work, more unreasonable demands. That's how they dragged out the pre-trial phase for nearly 4 years.

He's guilty. He deserves to spend the rest of his life in prison. JMO
I'm certainly glad there are defense attorneys who take their jobs seriously. Thank God for them.

I do believe they are guilty but all cards on the table, no chance for getting out of this. No appeals b/c something didn't get in that should have. Jm2 If y'all think that the Prosecution won't do what they have to to win as well, then watch some videos of folks who have been exonerated and see if the prosecuting attorneys jump for joy that new evidence has been found?

The state could have played GW's interview if they wanted to. They played BW and AW's. BW did not testify. The state chose not to play GW's interview.

Is the trial over? I thought it was still ongoing. I don't understand how it can be assumed that, if the recording exists, it won't be played at some point. Prosecution is preparing to play quite a few recordings next week. AFAIK, they haven't finished presenting their case.

Defense can also play this recording when they present their case.

Is this what they were discussing on Friday when the jury was sent home? Or was that a closed hearing - and no body tweeted on this?


Question - ? Who is George Washington Wagner the 2nd - and who is the first one? Since Billy changed his - who were these people - anyone know? Just curious!

on Friday they were discussing the wiretap evidence from Jake and GW4’s truck, after they returned to OH.


They we’re also testifying and arguing about the murder truck used the night of the murders and later gave to relatives.

George Washington Wagner, jr., went by Bob and is GWIII’s father. GWIII’s given name was William but he changed it to George Washington Wagner III at age 15, I think. That is why they call him Billy.
George Washington Wagner IV is GWIII’s (Billy’s)son. Edward Jacob Wagner(Jake) is GWIII's son.
There sure are a lot of them that do not go by their given name…

Out of the blue. No reason... She'd asked them to look out for a truck for her, perfect opportunity for them. Gw4 was huge then. This is not what I thought they were arguing at all. I was believing it was about the border crossing interview. I want to see the false bed b/c if it's as small as it appears that it would be, my s/o would barely fit in it at 6'1 190#. They retained evidence imo. He couldn't properly question JW about the bed without the bed stats.

I want to hear the border crossing Ms AC objected about about in opening as well but I guess it doesn't suit her in this trial.
