11/4/22 Evidentiary Hearing: Prosecutor Wilson also says the defense will get the case Monday or Tuesday. A black 2010 GMC pickup truck sent sparks flying Friday morning in the trial. During a hearing Friday, with the jury out, it seemed evident that Wagner's defense team plans to argue their client was too big six years ago to fit under the false pickup bed. "I'm not a farmer," attorney John Parker said. "I don't pretend to be one. But I do know that bales of hay weigh a certain amount. I'm told 40, 50 pounds is not unusual for a bale of hay." The defense team criticized prosecutors for not being more forthcoming with photos of investigators recreating the false truck bed. Prosecutors said the photos show that someone who's 6 feet tall & weighs 252 pounds, which is how big George was six years ago, could easily fit in the back of the truck.
Judge Deering says if he allows truck pictures, jury needs to be instructed to provide weight as they see fit. On the transcripts and snippets - they have the weekend to review. He is going to allow truck pictures as long as foundation laid with jury instruction.

Aside from that issue, Deering recognized the defense team needs additional time to review extensive wiretap recordings (2018 wiretap transcripts recorded while JW & GW4 were driving for R+L Carriers). As a result, he sent jurors home without hearing any testimony Friday. Final decision on the transcripts & wiretap snippets would be played will be made Monday. Defense will be calling their witnesses starting Monday - out of order but the jury will be made aware of that.

Here are the reports where GW refused his food tray. 08/01/22 (Monday) 05:12 and 10/29/22 (Saturday) 16:37
That's them! Thank you, I can't read them even enlarging them, I'm desperately in need of new glasses, I know it.

Pike is on video, but no audio. Seems
as if a lot of back and forth was happening and it looked real interesting.

Got you covered on tweets today.

Looks like the 49ers had bye week yesterday. Good luck to SF in week 10. Cincinnati got a must needed win yesterday!

Good morning from Pike Co. murder trial. We're getting defense witnesses first due to scheduling issues. First up is Andrew Carson, who called Jake Wagner morning of the murders. Friend of both brothers. He's opted out of video.

Second witness is Michael Ramsey Walters - who is Jake's employer in Alaska. Third is Sean Fisher. All have opted out.
all are defense witnesses.

Wow that was the quickest witness ever!

OMG the scorpion on GW3s finger.

This trial has got to go down as one of the most mismanaged of all time. Why take another day off to decide something that should have been decided months ago, concerning these tapes? It is ridiculous. The prosecutors handed over the evidence. This is not something new they are trying to add. It isnt the prosecutors responsibility to give a play by play of their strategy. Jmo
I totally agree!

As much as I dislike the opt outs, I totally understand anyone testifying on G4's behalf opting out.

So is this the tattoo guy on the stand now and not the employer? It's hard to tell with no sound and just evidence photos.

I'm also confused why there are 3 defense witnesses today, did they all have a schedule issue? I was thinking it was one from Alaska and I could understand that if flights were booked, then dates change over and over that makes it difficult and costly.

So, all the concerns about prosecution witnesses opting out still apply to defense witnesses?

It is a pain, having to wait hours for some tweets. Hard for reporters, too.
;)

This trial is unusual in that the prosecution hasn't rested its case and the defense now is calling its witnesses to the stand

Just guessing, it appears, they drove past witness #1's house in coming or going, or both, that night. Bet he was weirded out.
